That however, such request was not heeded or acted upon because according to the Office of the Register of Deeds, their office file copy was already mutilated and could not be read because some of the contents are beyond recognition.

That consequently, a Certification to this effect was issued by the same office and gave the advice to the petitioner to re-file this petition in court so that OCT No. 7627 can be reconstituted; hence, this petition:

That the taxes on the property has been paid by petitioner up to the time of this filing as can be evidenced by a photocopy of the receipts issued by the Treasurer's Office of Tanjay City.

That the Original Certificate of Title was in full force and effect at the time the same was considered to be lost and has always been covered by a tax declaration regularly issued by the Assessor's Office of Tanjay City, Negros Oriental.
