NOTICE OF HEARING

A verified petition dated May 15, 2006, had been filed with this Court by Juanito A. Daclan, and Milagros Daclan-Ucol for the replacement of lost original owner's copy of Transfer Certificate of Title No. T-30713. That the petitioners are the surviving heirs of Felipe Daclan who appears the registered owner of that parcel of land covered by Transfer Certificate of Title No. 30713 of the Registry of Deeds of La Union. That the petitioner was the one who was tasked to keep the owner's duplicate copy of said title. He kept the same inside a drawer in their house at Acop, Tublay, Benguet. However, in 1999, their house was engulfed by fire. They were not able to salvage most of their personal belongings including subject title. Petitioners prays that after due notice and hearing, the Honorable Court orders the Registry of Deeds of La Union to issue a new owner's duplicate copy for Transfer Certificate of Title No. T-30713 and that is shall contain a memorandum of the fact that it is issued in place of the lost duplicate certificate, but shall in all respects be entitled to like faith and credit as the original duplicate, and shall thereafter be regarded as such for all legal purposes.

Now, therefore, in accordance with the Department of Justice Circular No. 88, dated December 20, 1955 and in compliance therewith, let this Notice of Hearing be posted at the main entrance of the Municipal Hall of Luna, La Union at least two (2) weeks prior to the date of hearing

This is a petition for the reconstitution of Original Certificate of Title No. 7754 of the Register of Deeds of Leyte of Lot No. 6800 filed by petitioner through counsel on March 14, 2007. Petitioner alleged, among others; that she is of legal age, married, Filipino and resident of Brgy. Sta. Cruz, Baybay, Leyte; that she is presently the owner of a portion of Lot No. 6800 of the Baybay Cadastre covered by Original Certificate of Title No. 7754 of the Leyte Land Registry in the name of Ariston Tabudlong (Annex "A"); that she has previously acquired the entire Lot No. 6800 of the Baybay Cadastre by succession from the late Ariston Tabudlong, the registered owner of said lot, being the sole heir of the latter; petitioner has already quitclaimed a portion of the aforesaid lot with an area of 5,610 sq. m. to her daughter, Elizabeth T. Calipayan which copy of the Extra-Judicial Adjudication by Sole Heir Diodada Tabudlong and Waiver/ Quitclaim made an integral part of the

petition (Annex "B"); that the portion of said lot owned by the petitioner has an area of 3,855 sq. m. that she sought the voluntary registration of her rights and interest and in fact desired the cancellation of OCT No. 7754 to conform to her name and ownership but could not do so because the original copy of said title is no longer existing in the Office of the Register of Deed of Leyte as borne out by the certification issued by said office (Annex "C"); that the owner's copy of the title is in her position; that petitioner and her daughter are in actual possession of the same; that the adjacent lots of Lot 6800 and their owners were furnished copy of the petition, namely: Rolando Onipa; Dr. Roberto C. Guarte; Spouses Zachary and Melimer Maratas, all of Brgy. Sta. Cruz, Baybay, Leyte; Perfecto Bartolini of Brgy. San Agustin and Eufemia Po c/o Dr. Pacienda P. Milan of LSU, Baybay, Leyte. Petitioner most respectfully prayed before this Honorable Court that after due notice, posting, publication and hearing, an order be issued:

1. declaring the original copy of Original Certificate of Title No. 7754, which is supposedly in the position of the Register of Deeds of Leyte, as missing, lost destroyed and/or obliterated, null and void;

2. ordering the judicial reconstitution in like faith and credit per Annex "A" Original Certificate of Title No. 7754, and other reliefs just and equitable under the premises.

Petition being sufficient in form and substance, notice is hereby given that this petition is set for initial hearing on November 6, 2007 at 8:30 o'clock in the morning at the session hall of this Court. Any person who may have an interest in this petition may file an opposition and show cause why this petition should not be granted.

Let a copy of this order be published in the Official Gazette once a week for two consecutive weeks at the expense of the petitioner and copies of this order be posted in the bulletin boards of the Municipal Hall, the Post Office and of this Court, all at Baybay, Leyte, and the Provincial Capitol, Tacloban City.

Furnish copy of this Order to the Solicitor General, the Land Registration Authority, the

DENR, the Register of Deeds of Leyte, the Assistant Provincial Prosecutor, Baybay, Leyte, all the adjacent lot owners, the petitioner and counsel.

This is a verified amended petition for reconstitution of the original and owner's duplicate Certificate of Title No. 326628, filed by petitioner, through counsel, alleging, among others, that:

Petitioner is residing at No. 56 19th Avenue, Murphy, Quezon City and the owner of the real property covered with Transfer Certificate of Title No. 326628 issued by the Register of Deeds of Quezon City, the original copy of which was lost while being kept in the office of the Registry of Deeds of Quezon City due to fire;

Petitioner herein is duly represented by his Attorney-in-Fact Imelda P. Manuel (Annex "A");

The location, area and boundaries of the subject property are as follows:

"A parcel of land (Lot 13-A as shown on the Subd. plan Psd-04-001937, being a portion of Lot 13, Block P-3, Bsd-2029, LRC Rec. No. 917), situated in the Dist.. of Quirino, Quezon City, Now Metro Manila, Island of Luzon.

Bearings true, date of original survey Nov. 10, 1920-Jan. 31-March 13, 1924 that of the subdivision, date of survey October 5, 1979 as surveyed by Engr. M. Valera Batoon, and approved on April 8, 1980."

The corresponding owner's copy of the said Transfer Certificate of Title No. 326628 was also lost while in the possession of custody of petitioner's Attorney-in-Fact, Imelda P. Manuel, as per "Affidavit of Loss" (Annex "B" to the petition);

Submit herewith are the following papers in support of this petition:

a) Technical description (Esteban J. Manuel, et al.) issued by the Land Management Services, Department or Environment and Natural Resources (Annex "C");

b) Copies of the Real Property Tax Bill Receipts representing full payment of at least two (2) years prior to the filing of the petition (Annexes "D" to "D-3", inclusive);

c) Tax Declarations of Real Property (Annexes "E" to "E-1", inclusive);

There is no mortgage or encumbrance of any kind whatsoever affecting said land, nor any other person having any interest therein, legal or equitable, or in possession, other than the owner hereof, the herein petitioner;

The petitioner has acquired said land by virtue of a deed of conveyance from the People's Homesite and Housing Corporation (PHHC) and in accordance with Sec. 14 of Presidential Decree 1529 the same property is exclusive property of the petitioner;

The names and addresses of the owners of the adjoining property are the following:

The petitioner's property in the application is bounded by a public road No. 4 and the applicant has no claim whatsoever of any

Finding the petition to be sufficient in form and substance, the same is hereby set anew for hearing on October 3, 2007 at exactly 8:30 o'clock in the morning, before this Court sitting at Basement 12-14, Hall of Justice, Quezon City, Metro Manila. interested parties are directed to appear and show cause why the petition should not be granted.

Further, let copies of this Amended Order, be furnished the Offices of the Solicitor General, Land Registration Authority, Department of Environment and Natural Resources, Register of Deeds of Quezon City, and the City Prosecutor of Quezon City, as well as the boundary owners, respectively.

The petitioner shall coordinate with the Process Server, Florencio S. Beltran for posting and service of this Amended Order.

A verified petition having been filed on January 2, 2007 by the petitioner for judicial reconstitution of the original copy of Transfer Certificate of Title No. 173668 of the Register of Deeds of Quezon City, alleging:

That they are all Filipinos, of legal age, currently residents of the United States of

America and represented by their Attorneyin-fact; that they are the registered owners in fee simple of a certain real property covered by TCT No. N-173668 issued by the Register of Deeds of Quezon City and more particularly described as follows:

"A parcel of land (Lot 24, Blk 15, of the subd. Plan. Psd-57293, being a portion of Blk. M-21, New Psd-53250, LRC (GLRO) Rec. No. 7681), situated in the Dist. Of Diliman, Quezon City. Bounded on the SW., along line 1-2 by Lot 25, Blk 15, along line 2-3 by Lot 22, Blk. 15, on the NW., along line 3-4 by Alley Lot 15, on the NE., along line 4-5 by Alley 17, and on the SE., along line 5-1 by Lot 26, Blk. 15, all of the subd. Plan. Beginning at a pt. Marked "1" on plan, being N. 1 deg. 12' E., 2751.69 m. from BLLM No. 7, Quezon City; thence N. 12 deg. 53 min.. W., 1.66 m. to pt. 2; thence N. 12 deg. 54 min. That the Owner's Duplicate of TCT No. N-173668 which was issued to petitioners by the Register of Deeds of Quezon City was lost when they were busy preparing to migrate to the United States; that notwithstanding diligent efforts of the petitioners, the original Owner's Duplicate

of T.C.T. No. N-173668 cannot be located, and is now beyond recovery; that the original certificate on file with the Register of Deeds was destroyed by fire that razed its office sometime in 1998; that no coowner's duplicate of said title had been issued, the property is free and clear of all liens and encumbrances; that the subject owner's duplicate original has not been delivered to any person or entity to secure the payment or enforcement of any obligation, nor has any document relating to the same been presented for or pending registration with the Office of the Register of Deeds of Quezon City; that Notice of loss as well as the circumstances surrounding the same was duly conveyed to the Register of Deeds of Quezon City and duty annotated on the pertinent title; that the names and addresses of adjoining owners of the subject parcel of land are as follows:

Wherefore, Notice is hereby given that this petition will be heard this Court sitting at the 3rd Floor, Room 320, Hall of Justice Building, Quezon City on September 18, 2007 at 8:30 o'clock in the morning, at which place, day and time, the petitioner is hereby ordered to appear and produce all proofs for the reconstitution of the original copy of Transfer Certificate of Title No. 173668 and that all persons having an interest in the property shall appear and file their claims or objections on the petition, as they may have.

Let this Order be published at the expense of the petitioner, twice in the successive weekly issues of the Official Gazette, while a separate copy of said Order shall be posted in the main entrance of this Court and at the Bulletin Board in the main entrance of the Hall of Justice of Quezon City and Quezon City Hall Building, and further served upon the petitioners, the owner of the adjacent properties, the Office of the Solicitor General, the Register of Deeds of Quezon City, the Regional Executive Director of the Department of Environment and Natural Resources, Regional Office (Director of Lands Management Bureau), the Commissioner of Land Registration Authority, the City Prosecutor of Quezon City and the City Attorneys of Quezon City, at least thirty (30) days before the scheduled date of hearing, all at the expense of the petitioner.

This is a verified petition filed by the petitioner, praying this Court that after due notice, publication and hearing, an Order be issued directing the Register of Deeds of this province to reconstitute the original and the owner's duplicate copies of TCT No. RT-17 (T-2334), containing an area of 160 square meters, more or less, registered in the name of Fortunata Macaraig, situated in Ibaba East (Pob.) Calapan City, Oriental Mindoro, bounded on the North by property owned by Pedro Caringal, on the East by Renato Lopez, Demetrio Lucas and Simplicio Abaja; on the South by Road; and on the West by Maximo Perez, all of Ibaba Calapan City, on the basis of existing owners duplicate copy of the said title.
