Notice is hereby given that said petition is set for hearing before this court sitting at the 3rd Floor of the Municipal Building of Agoo, La Union on September 20, 2007 at 8:30 o'clock in the morning at which time, date and place all interested persons or entities shall appear to file their objections, if there be any why said petition should not be granted.

Let copies of this Order be furnished the Office of the Solicitor General, Prosecutors Office; Register of Deeds, the LRA, and those persons residing at the aforedescribed lot, including the adjoining lot owners, and

let it be posted at the main entrances of the Municipal Hall of Agoo, La Union; the Provincial Capitol Building, San Fernando City, and of this Court, at the expense of the petitioner.

It is likewise ordered that the Notice of Initial Hearing be published at the expense of the petitioner in the Official Gazette for two (2) consecutive issues and that the editor of the said Official Gazette is hereby earnestly requested to submit to the Court the Certificate of Publication on or before the aforesaid date of Initial Hearing.

"2. A parcel of land (Lot 49-A, Block 8 of the subdivision plan Psd-24849, Sheet No. 2, being a portion of Lot 16, Block 3 described on plan Psd16662, G.L.R.O. Rec. No. 287), situated in the District of Malate, City of Manila. Bounded on the NE., by Lot 16-B, Block 3 of the subdivision plan; x x x containing an area of Nineteen Square Meters and Fifty Square Decimeters (19.50), more or less.

ORDER

Before the Court is a verified "Second Amended Petition for Reconstitution and Issuance of the Owner's Duplicate of Transfer Certificate of Title No. 281895 of the Register of Deeds for the Province of Rizal" filed by petitioner Anicia Nolasco Mercurio, thru her Attorney-in-Fact Manuel V. Manalo, through counsel.

In her second amended petition, petitioner alleges that she is the widow of the late Resty O. Mercurio, the registered owner of that parcel of land covered by Transfer Certificate of Title No. 281895 of the Register of Deeds for the Province of Rizal. Lacking in funds to pay the real estate taxes for the parcel of land, the late Resty O. Mercurio borrowed money from former Masbate Representative Antonio Kho and pledged his Owner's Duplicate Copy of TCT No. 281895 to the former Congressman. Sometime in 2003, the late Resty O. Mercurio and the petitioner, together with their Attorney-in-Fact Manuel V. Manalo, retrieved the Owner's Duplicate Copy of TCT No. 281895 from Rep. Kho and the same was entrusted to Manuel V. Manalo. Unfortunately, Manuel V. Manalo lost the owner's Duplicate Copy of TCT No. 281895 and despite earnest and diligent efforts, the same could no longer be located. Manuel V. Manalo executed an Affidavit of Loss and caused the same to be registered and annotated at the back of the original of TCT No. 281895 with the Registry of Deeds for Marikina City. However, petitioner's attorney-in-fact received a letter from the Acting Register of Deeds for Marikina City informing him that the original copy of TCT No. 281895 is not among the certificates of title being kept in the Registry.

Upon verification made by petitioner's attorney-in-fact with the Land Registration Authority, the latter's Chief, Property Section issued a Certification to the effect that Judicial Form No. 109-D with Serial No. 1667410 was issued to the Registry of Deeds for the Province of Rizal on April 6, 1970. The same serial number appears in the upper left portion of TCT No. 281895, thus, proving the existence, authenticity and due execution of said title. The Chief, Technical Record and Statistics Section, Bureau of Lands, issued a reproduction of the Relocation Plan of Lot 50-A-7, Psd-18247 in the name of Resty O.

Mercurio. On the face of the Relocation Plan appears a Certification that it is a true and correct reproduction of Plan REL-04000200: Appearing on the upper left portion of the Relocation Plan is the technical description of the subject property which is exactly the same technical description appearing in TCT No. 281895, further proving that the same is in order and was regularly issued.

The petitioner is now before the Court praying for the lost Owner's Duplicate Copy of TCT No. 281895 be declared null and void and that the Registry of Deeds for Marikina City be ordered to reconstitute and issue a new Original Copy and Owner's Duplicate Copy of TCT No. 281895 in the same terms and conditions as contained in the Certified true copy thereof and the approved Relocation Plan, after payment of all proper fees therefore.

Finding the 2nd Amended Petition to be sufficient in form and substance, pursuant to Section 13, Republic Act No. 26, the Court hereby sets the same for initial

hearing on August 29, 2007 at 8:30 o'clock in the morning before this Court sitting at the Third Floor of the New Hall of Justice of the Regional Trial Court, Marikina City at which date, time and place aforesaid, all interested persons are hereby cited to appear, file their comment/answer to the petition and show cause, if any they have, why the instant petition should not be granted.

Accordingly, this Court hereby directs that a copy of this Order be published twice in successive issues of the Official Gazette

(O.G.) and once in a newspaper of general circulation in the Philippines, and to be posted together with a copy of the 2nd Amended Petition and Notice of Initial Hearing at the main entrance Bulletin Board of the Marikina City Hall, the bulletin board of this Court and at the lot subject of this case at least thirty (30) days prior to the scheduled initial hearing, at the expense of the petitioner.

Further, let copies of the Amended Petition and its supporting documents, together with copies of this order and the Notice of Initial Hearing be served to the Registry of Deeds for Marikina City, the Office of the Solicitor General, the Office of the City Prosecutor of Marikina City, Land Registration Authority, Philmed Laboratories, Inc. at Legion of Mary cor. C.Y.O. Sts. Pagasa Subd. No. 1 Valenzuela, Metro Manila, and to former Rep. Antonio Kho at Dalton St., Filinvest East Subdivision, Marcos Highway, Antipolo City, likewise, at the expense of the petitioner, at least thirty (30) days prior to the scheduled initial hearing of this case, at the expense of the petitioner.

ORDER

This is a verified "Petition for the Reconstitution of the Original and Issuance of Original and New Owner's Duplicate Copy of Transfer Certificate of Title (TCT) No. T-182316 of the Registry of Deeds of Quezon City in Lieu of the Lost Title" filed by the petitioners, Government Service Insurance System (GSIS).

Petitioner is an assignee of a parcel of land including all the improvements existing thereon, situated in the District of Novaliches, Quezon City, more particularly

described as follows:

"Transfer Certificate of Title No. T-182316 Registry of Deeds of Quezon City

A parcel of land (Lot 13, Blk 12 of the consolidationsubdivision plan (LRA) Pcs-12965 being a portion of Lots 1 & 4 (LRC) Pcs-12892 L.R.C. Record No. 6563), situated in the District of Novaliches, Municipality of Quezon City, Island of Luzon. Bounded on the N., points 1 to 2 by road Lot 13, on the E., points 2 to 3 by Lot 14, Blk. 12; both of the cons-subd. Plan; on the S., points 3 to 4 by Lot 687, Tala Estate; and on the W., points 4 to 1 by Lot 12, Blk 12 of the consolidation-subd. Plan. Beginning at a point marked "1" on plan, being S. 11 deg. 02'W., 2,114.52 m. from LM No. 13, Piedad Estate, thence due east 10.00 m. to point 2; thence due south 15.00 m. to point 3; thence due west 10.00 m. to point 4; thence due north 15.00 m. to the point of beginning, containing an area of one hundred fifty (150) square meters; more or less. x x x"

Petitioner further alleges that is a social insurance institution created under Commonwealth Act No. 186, as amended, and operating under its present charter, R.A. No. 8291, otherwise known as the GSIS Act of 1997; that the said parcel of land is

duly registered in the name of Lagro Development and Realty Corporation and assigned to the petitioner under a Deed of Absolute Sale with Assignment and in turn, sold the same on installment basis to Mr. Jose L. Nunez under a Deed of Conditional Sale; that it keeps in possession and custody the owner's duplicate copy of the subject TCT for the duration of the term of the loan; that the loan, having fully paid, it is now under the obligation of the petitioner to release the said TCT to Mr. Jose L. Nunez; that the owner's duplicate copy of TCT has been discovered to be missing and could not be found despite exhaustive and diligent efforts to locate the same; that a joint affidavit of loss was executed and was duly registered with the Registry of Deeds of Quezon City; that upon verification with the Registry of Deeds of Quezon City, it was found that the original of said TCT was among those burned during the fire that razed and gutted the Quezon City Hall Building last June 11, 1988; that no coowner's copy or other duplicate of said title has been issued; that there is no building or improvement existing on said parcel of land which do not belong to the assignee; that subject property is free from all liens and encumbrances of any kind whatsoever, except that due the petitioner, as assignee;

that there exists no other deed or instrument affecting the property which has been presented for and pending registration to this date with the Registry of Deeds of Quezon City; that the lot corresponding to the subject title has been declared for taxation purposes.

As further alleged by the petitioner, the adjoining owners of the property are as follows:

Quezon City to reconstitute the original copy and issue a new owner's duplicate copy of Transfer Certificate of Title No. T-182316 in the name of Lagro Development and Realty Corporation.

Wherefore, finding the verified petition to be sufficient in form and substance, the same is set for hearing on September 14, 2007 at 8:30 o'clock in the morning, Session Hall of Branch 223 of this Court, at which date and time, petitioner and counsel are directed to appear to substantiate the allegations of the petition and to produce proofs of ownership of the subject parcel of land. Likewise, all interested persons may appear and show cause why the petition should not be granted.

Further, within five (5) days from receipt of this Order, the Register of Deeds of Quezon City and the Administrator of the Land Registration Authority are hereby directed to file their comment on the aboveentitled petition.

Let a copy of this Order be published in two (2) successive issues of the Official Gazette, and let the same be posted at the main entrance of the Quezon City Hall and at the bulletin board of the Office of the

Clerk of Court, Regional Trial Court of Quezon City and at the Barangay Hall of the barangay where the property is located for a period of thirty (30) days prior to the date of the initial hearing of the petition, all at the expense of the petitioner.

Before this Court is a verified petition dated April 17, 2007 filed by the petitioner, praying that after due notice and publication in the Official Gazette, an order be issued directing the Register of Deeds of the Province of Negros Occidental to reconstitute the original Certificate of Title No. 12895, covering Lot No. 1429 of Pontevedra Cadastre in the names of Miguel Millamina, Claudia Millamina, Bernardino Millamina and Caridad Millamina which was allegedly lost during the last world war.

Finding the petition to be sufficient in form and substance, let the hearing of this petition be set on August 30, 2007 at 9:00 o'clock in the morning before this Court, RTC, Branch 63, La Carlota City at which date, time, and place all persons interested in the said petition may appear and show cause why this petition should not be granted.

Let a copy of this Order be furnished, the Commissioner of Land Registration Commission who is directed to cause the appropriate notice to be published in the Official Gazette at petitioner's expenses and copies of the same to be served to all the co-owners, namely: Miguel Millamina, Claudia Millamina, Bernardino Millamina and Caridad Millamina and adjoining owners namely: Sotero Azuelo of Ponteverda, Negros Occidental and Antonio Villanueva of Brgy.
