SY, Petitioner On 03 October 2005, a verified petition was filed by petitioner Josefin Sy, praying among others that after due notice and hearing, petitioner be admitted as citizen of the Philippines. It appearing that the Petition is sufficient in form and substance, the parties are hereby notified, that this case is set for hearing on 27 March 2008 at 8:30 o'clock in the morning, before this court located at the 4th Floor, Hall of Justice Building, F. B. Harrison St., Pasay City, on which date, time and place, interested parties may appear and show cause why this petition should not be given due course. Let this Notice of Hearing and the Petition be published once a week for three (3) consecutive weeks in a newspaper of general circulation in Metro Manila and in the Official Gazette, and be posted in a public and conspicuous place in the petitioner's office or in the building where said office is located, all at the expense of the petitioner. Witness, the Hon. PEDRO DE LEON GUTIERREZ, Pairing Judge of this Court, this PETITION COMES NOW, the Petitioner, assisted by the undersigned and to this Honorable Court, most respectfully alleges, that: 1. Petitioner's full name is Josefin Sy y Yap, 50 years of age, single and presently residing at 524-Inocencio Street, Pasay City; 2. Petitioner was born in the Philippines particularly in Barangay Poblacion, Municipality of Masinloc, Province of Zambales on December 16, 1955 as evidenced by the certified true copy of her Certificate of Birth issued by the Office of the Civil Registrar-General, a copy of which is hereto attached as Annex "A" hereof; taught as part of the school curriculum, said enrollment having lasted during the entire period of her required residence in the Philippines; Copies of her Elementary Pupils Permanent Record and her Secondary student's permanent record are hereto attached as Annex "B" and "C" respectively; 6. Petitioner is a holder of a Native Born Certificate of Residence as well as Alien Certificate of Registration both issued by Bureau of Immigration, copies of which are hereto attached as Annex "D" and "E" respectively; 7. She speaks and writes English and Tagalog as well as Zambaleño dialect; 8. She is a businesswoman/merchant and engaged in the business of buy and sell of fabrics and ready to wear clothes for local and export market of which she earns income of Thirty Thousand (P30,000.000) a month. She is presently the financier and marketing consultant of ANTEK's Boutique, an entity engaged in wholesale trading of women's dresses with market office situated at stall 1-A-10, GF Berna Shopping Mall, Redemptorist Road, Baclaran, Parañaque City. She is also the operator/financier of the Dress Sculpture Shoppe, a shop engaged in large scale sewing and wholesale of womens' dress located at Tutuban Center Mall, Tondo, Manila and from which she derives an combined average annual income as trader and financier in the amount of Php.600,000.00; 9. She is also a registered owner of a condominium unit described as Unit 5-C Fifth Floor, Bay Gardens, Metro Bank Ave., Metropolitan Park, Roxas Boulevard, Pasay City with an area of Fifty and a half square meters and the parking area of Twelve and a half square meters with an estimated market value of Three Million (P3,000,000.00). A photocopy of the condominium titles are hereto attached as Annex-F and F-1. 10. She is also a holder/owner of savings and current accounts at Metrobank - Roxas Boulevard Branch with total amount of One Million Eight Hundred Eight Thousand Five Hundred Seventy One and Sixty Five Centavos (P1,808,571.65) under account No. 3-715-50036-2 and 7-715-50036-8 as well as in the International Exchange Bank, Tutuban Branch, Manila under account No. 043-020-003997 in the for the amount of Six Hundred Eight Thousand Four pesos and three centavos (P608,004.03). A photocopy of the Bank certificates are hereto attached as Annex-G and G-1. 11. She believes in the principles underlying the Philippine Constitution; had conducted herself in a proper and irreproachable manner during the entire period of her residence in the Philippines in her relations with the constituted government as well as with the community in which she lives; has mingled socially with Filipinos, and has evinced a genuine desire to learn and embrace the custom, traditions and ideas of the Filipinos; 12. She is not opposed to organized government or affiliated with any association or group of persons who uphold and teach doctrines opposing all organized governments; that she does not defend or teach the necessity or propriety of violence, personal assault, or association for the success and predominance of their ideas; that she is not a polygamist or a believer in polygamy or in the practice of polygamy, that she has never been convicted of any crime involving moral turpitude; that she is not suffering from mental alienation or incurable contagious diseases; and that she is not a citizen or subject of a nation at war with the Philippines; 13. As foresaid, she was born in the Philippines and received primary and secondary education in the Philippines schools and has resided at least 50 years in the Philippines hence the compliance with the requirements of the Naturalization Law (CA. No. 473) regarding the filing with the office of the Solicitor-General of her bonafide intention to become a citizen of the Philippine is not applicable to petitioner pursuant to Commonwealth Act No. 535; 14. It is her intention in good faith to become a citizen of the Philippines and to renounce absolutely and forever all allegiance and fidelity to any foreign state or sovereignty, if this petition is granted, and particularly to China of which at this time she is a citizen or subject and that she will reside continuously in the Philippine from the date of the filing of this petition up to the time of her admission to Philippine citizenship; 15. She has not heretofore made petition for citizenship to any court; 16. Mayor Jessu E. Edora and Aida Del Rosario both of legal age and residing at North Poblacion, Masincloc, Zambales and 524-J Inocencio St., Pasay City, respectively and who are Filipino Citizen will appear and testify as witnesses at the hearing of this petition; a copy their joint affidavit is hereto attached as Annex "H" hereof; 17. To further support her petition, attached hereto are two (2) photographs of her duly autographed and signed by her marked as Annex "I" I-1" respectively. 4. In compliance with the Supreme Court Administrative Circular No. 04-94, she further certifies that: A. She has not heretofore commenced any other action or proceeding involving the same issues in the Supreme Court, the Court of Appeals or any other tribunal or agency; B. To the best of her knowledge, no such action or proceeding is pending in the Supreme Court. the Court of Appeals or any other tribunal or agency: C. If there is any such action or proceeding which is either pending or may have been terminated, she will state the status thereof, and D. If she should thereafter learn that a similar action or proceeding has been filed before the Supreme Court, the Court of Appeals, or any tribunal or agency, she undertakes to report that fact within five (5) days therefrom to Honorable court.
