The petition alleges among others that: petitioner is of legal age, Filipino, married and with address at Antipona, Bocaue, Bulacan represented by his sister and Attorney-in-fact Dr. Erlinda Villanueva Chiong likewise of legal age, Filipino, married and resident of the same given address where Court processes maybe served, as per Special Power of Attorney (Annex A); she is the registered owner of a parcel of land situated at Barangay Antipona, Municipality of Bocaue, Province of Bulacan which lot is more particularly described as follows: OCT NO. P-4678 (M) A parcel of land (Lot No. 238, Cad-332) situated in Antipona, Bocaue, Bulacan, Island of Luzon. Bounded on the S., along line 1-2 by R. Matanda St., on the W., along line 2-3 by P. Zamora St., on the NW., & NE., along lines 3-4-5 by Lot 237, Cad332 (Ap-20760); and on the E., along line 5-1 by Lot 239, Cad-332. Beginning at a point marked "1' of Lot 238, Cad-332 being N. 18-07 E., 07.85m. from BLLM No. 1, Cad-332 thence S. 72-56., 16.97m to point 2; N. 20-50 W., 14.54m. to point 3; N. 70-57 E., 17.52m. to point 4; S. 22-50 E., 06.86m. to point 5; S. 15-09 E., 08.30m to point 1 point of beginning. Containing an area of Two Hundred and Fifty-Nine (259) Square Meters more or less" his title thereto is evidenced by Original Certificate of Title No. P-4678 (M) issued in his favor by the Registry of Deeds for the Province of Bulacan, Meycauayan Branch (Annex B); the original copy of said Original Certificate of Title No. P-4678 (M) held by the Registry of Deeds for the Province of Bulacan, Meycauayan Branch could not be located in the files of the registry inspite of diligent search, hence the title was considered lost as evidenced by a certification issued (Annex C); the property is declared for taxation purposes under Tax Declaration No. 2006-04002-00135 (Annex D) and the taxes due thereon has been fully settled as evidenced by tax receipt (Annex E); the said land is possessed/occupied by the petitioner and the names and addresses of the boundary owners are the following: Sps. Rodolfo & Carmelita Villanueva Francisco Esguerra on the NW., and NE., by Lot 237 of Antipona, Bocaue, Bulacan; on the East by Lot 239, of Antipona, Bocaue, Bulacan; on the South by Raja Matanda Street on the West by P. Zamora Street the Original Certificate of Title was in full force and effect at the time it was lost or destroyed; before and after the loss of the original copy of the title kept by the Registry of Deeds, Meycauayan Branch there is no deed or other instrument affecting the property has been presented or pending for registration with the said Registry of Deeds; no co-owner's, mortgagee's or lessee's duplicate certificate had been issued involving the said lot; the original copy of Original Certificate of Title No. P-4678 (M) may be reconstituted on the basis of the provisions of Section 2 (a) in relation to Section 9, 10 and other provision of Republic Act 26. Wherefore, let the petition for reconstitution of original copy of Original Certificate of Title No. P-4678 (M) be set for hearing on October 24, 2007 at 8:30 o'clock in the morning. Let a copy of this Order be published in two (2) consecutive issues of the Official Gazette and be posted by the Deputy Sheriff of this Court at the main entrance of the Provincial Capitol Building of Malolos, Bulacan, at the Municipal Building of Bocaue, Bulacan and at the bulletin board of this Branch of Court at least thirty (30) days prior to the scheduled date of hearing at the expense of the petitioner.
