gracious message fent to the commons assembled in parliament, to fig nify his pleasure, either to agree to a regulation of it, or to the taking it wholly away, as should be thought moft convenient by the faid commons. And whereas upon mature deliberation, the faid commons do find, That the faid revenue cannot be fo regulated, but that it will occafion many difficulties and questions, and that it is in itfelf not only a great oppreffion to the poorer fort, but a badge of flavery upon the whole people, expofing every man's house to be entred into, and fearched at pleasure by perfons unknown to him.

II. We your Majesty's most dutiful and loyal fubjects the commons, being filled with a most humble and grateful fenfe of your Majesty's unparallelled grace and favour to your people, not only by restoring their rights and liberties which have been invaded contrary to law, but in defiring to make them happy and at eafe, by taking away fuch burthens as by law were fixed upon them, by which your Majefty will erect a lafting monument of your goodness in every houfe in the kingdom; do most humbly beseech your Majefty, That the faid revenue of bearth-money may be wholly taken away and abolished.

III. the fifteenth year of his faid late Majesty's reign, intituled, An 15 Car.2. c.13. additional act for the better ordering and collecting the revenue arifing

by hearth-money; and another act made in the fixteenth year of

the reign of his faid late Majefty, intituled, An act for collecting 16 Car. 2. c. 3. the duty arifing by hearth-money, by the officers to be appointed by bis Majefty; and all and every the articles, claufes and things in the said several acts contained, fhall be, and are hereby wholly repealed and annulled, and utterly made void, and are hereby enacted and declared to be null and void to all intents and purposes whatfoever.

IV. Provided always, and be it declared and enacted, That Hearth money nothing in this act contained, fhall be taken or conftrued to hin- due next der or prejudice the collecting, levying, answering or paying the March exfaid revenue arifing by hearth-money, which fhall grow due on cepted. the five and twentieth day of March in the year of our Lord one thousand fix hundred eighty nine, and all arrears of the faid duty which now are due and payable by the said acts; but that all and every the powers, clauses, articles and matters in the faid former acts, fhall continue and remain in force for the collecting, levying and recovering of the faid duty of hearth-money fo growing due on the faid five and twentieth day of March one thousand fix hundred eighty nine, and all the arrears of the faid duty already due, as by the faid acts they might have been col

CAP. XII.

An act for the encouraging the exportation of corn.

Forafmuch as it hath been found by experience, that the exporta

tion of corn and grain into foreign parts, when the price thereof is at a low rate in this kingdom, hath been a great advantage not only to the owners of land, but to the trade of this kingdom in general.

II. Be it therefore enacted by the King's and Queen's most excellent majesties, by and with the advice and confent of the lords fpiritual and temporal, and of the commons, now afsembled in parliament, and by the authority of the fame, That when malt or barley, Winchefter measure, is or fhall be at four and twenty fhillings per quarter, or under; rye at two and thirty fhillings per quarter, or under; and wheat at eight and forty fhillings a quarter, or under, in any port or ports of this kingdom or dominion of Wales; every merchant or other perfon, who fhall put on fhip-board in English shipping, the master and two thirds of his mariners at leaft being their Majefties fubjects, any forts of the corn aforefaid, from any fuch ports where the rates shall not then be higher than as aforefaid, with intent to Exporter gives export the faid corn to parts beyond the feas: Every fuch mercertificate of chant or other person shall bring a certificate in writing under quantity, and his or their hands, containing the quantity and quality of corn

III. IV. And for the better fecuring their Majefties perfons and keep no arms. government; be it further enacted and declared, That no pa→ pift or reputed papist, so refusing or making default, as aforefaid, fhall or may have or keep in his houfe, or elsewhere, or in the poffeffion of any other person to his ufe, or at his difpo fition, any arms, weapons, gunpowder, or ammunition (other than fuch neceffary weapons, as fhall be allowed to him by order of the juftices of the peace, at their general quarter sessions, for the defence of his houfe or person) and that any two or more justices of the peace, from time to time, by warrant under their hands and feals, may authorize and impower any perfon or perfons in the day-time, with the affiftance of the conftable or his deputy, or the tythingman, or headborough, where the fearch fhall be (who are hereby required to be aiding and affifting herein) to fearch for all arms, weapons, gunpowder, or ammunition, which shall be in the houfe, cuftody, or poffeffion of any fuch papift or reputed papist, and feize the fame for the use of their Majefties, and their fucceffors; which faid juftices of the peace fhall from time to time, at the next general quarter feffions to be held for the county, riding, divifion, or liberty, where fuch feizure fhall be made, deliver the faid arms, weapons, gunpowder, and ammunition, in open court, for the ufe aforefaid.

V. ing, contrary to the statute in this behalf made, shall be committed to the common gaol of the county or place where he shall commit fuch offence, by warrant under the hands and feals of any two juftices of the peace, there to remain, without bail or mainprize, for the space of three months, and fhall also forfeit and lofe the faid arms, and pay treble the value of them to the ufe of their Majefties, and their fucceffors, to be appraised by the juftices of the peace, at the next general quarter feffions to be held for the faid county, riding, or divifion, to their Maje* fties and their fucceffors.

VI. And be it further enacted, That every person who fhall Penalty upon conceal, or be privy, or aiding, or affifting to the concealing, or who knowing thereof, fhall not discover or declare to fome of their Majesties juftices of the peace, the arms, weapons, gunpowder, or ammunition of any perfon fo refufing, or making default, as aforefaid, or fhall hinder or difturb any person or perfons, authorized as aforefaid, in searching for, taking, and feizing the fame, shall be committed to the common gaol of the county or place where he shall commit fuch offence, by warrant under the hands and feals of any two juftices of the peace, there to remain without bail or mainprize for the space of three months; and fhall also forfeit and lose treble the value of the faid arms to their Majefties and their fucceffors.

VII. And be it further enacted, That if any perfon or per- Reward to dif fons fhall discover any concealed arms, weapons, ammunition, coverer of refufers arms. or gunpowder, belonging to any refufing or making default as aforefaid, fo as the fame may be feized as aforefaid, for the ufe of their Majefties and their fucceffors, the juftices of the peace, upon delivery of the fame at the general quarter feffions as aforefaid, fhall have power, and they are hereby required, as a reward for fuch a discovery, by order of feffions, to allow to him or them a fum of money, amounting to the full value of the arms, weapons, ammunition, or gunpowder fo difcovered; the faid fum to be affeffed by the judgment of the said juftices at their faid feffions, and to be levied by diftrefs and fale of the goods of the perfon offending against this act, rendring the overplus which fhall arise by fuch fale, above the faid fum fo allowed, and above the neceffary charges of taking such distress, to the owner. VIII.
