7HEREAS the term of St. Hilary, in the year of our Lord EXP. one thousand fix hundred eighty-eight, could not be bolden and kept, for which, if due provision be not made, great delay of justice, and confequently great expences to the fuitors in the feveral courts ufually held at Weftininfter will enfue: therefore for the continuing

and reviving all manner of actions or pleas lately depending, and all Proclamation manner of process that were returnable or depending in any of the upon fines faid courts, and which were discontinued and put without day by the fhall be acnot holding the faid term, &c.

counted made. Judgments by confeffion to be entred in Eafter term. All offences and actions, during the Interregnum fuable. The year of our Lord to be inferted instead of the King's reign. Indictments, &c. contra pacem Regni. Bonds, &c. made to King James, in force. All procefs, &c. of Michaelmas term, good. Bail bonds taken by a judge before the 11th of December, and commitments upon them, good. The time betwixt the 10th of December and 12th of March not reckoned in Quare Impedit or statute of limitations.

CAP. VI.

An act for establishing the coronation oath.

WHEREAS by the law and ancient usage of this realm, the Kings and Queens thereof have taken a folemn oath upon the evangelifts at their respective coronations, to maintain the ftatutes, laws, and cuftoms of the faid realm, and all the people and inhabitants thereof, in their fpiritual and civil rights and properties: but forafmuch as the oath itfelf on fuch occafion adminiftred, bath heretofore been framed in doubtful words and expreffions, with relation to ancient laws and conftitutions at this time unknown to the end therefore that one uniform oath may be in all times to come taken by the Kings and Queens of this realm, and to them refpectively adminiftred at the times of their and every of their coronation : may it please your Majefties that it may be enacted:

II. And be it enacted by the King's and Queen's most excellent majefties, by and with the advice and confent of the

An oath to be lords fpiritual and temporal, and the commons, in this prefent taken by the parliament affembled, and by the authority of the fame, That King and the oath herein mentioned, and hereafter expreffed, fhall and Queen. may be adminiftred to their most excellent majesties King William and Queen Mary (whom God long preferve) at the time of their coronation, in the presence of all perfons that shall be then and there present at the folemnizing thereof, by the archbishop of Canterbury, or the archbishop of York, or either of them, or any other bishop of this realm, whom the King's majesty fhall thereunto appoint, and who fhall be hereby thereunto refpectively authorized; which oath followeth, and shall be adminiftred in this manner; that is to fay,

The archbishop or bishop shall say,

III. Will you folemnly promife and fwear to govern the people of this kingdom of England, and the dominions thereto belonging, according to the ftatutes in parliament agreed on, and the laws and cuftoms of the fame ?

The King and Queen shall say,

I folemnly promife fo to do.

Will you to your power caufe law and juftice in mercy to be executed in all your judgements?

King and Queen.

I will.

Archbishop or bishop.

Will you to the utmost of your power maintain the laws of God, the true profeffion of the gospel and the protestant reformed religion eftablished by law? and will you preferve unto the bishops and clergy of this realm, and to the churches committed to their charge, all fuch rights and privileges as by law do or fhall appertain unto them, or any of them?

All this I promise to do.

After this, the King and Queen laying his and her hand upon the holy gofpels, fhall fay,

And be it further enacted, That the faid oath fhall be All Kings,&c. in like manner adminiftred to every King or Queen, who to take the fhall fucceed to the imperial crown of this realm, at their refpective coronations, by one of the archbishops or bishops of this realm of England, for the time being, to be thereunto appointed by fuch King or Queen respectively, and in the prefence of all perfons that shall be attending, affifting, or otherwife present at fuch their respective coronations; any law, ftatute, or ufage to the contrary notwithstanding.

An act for impowering his Majefty to apprehend and detain fuch perfons as he thall find just cause to suspect are confpiring against the government. EXP.

CAP. VIII.

An act for the abrogating of the oaths of fupremacy and allegiance, and appointing other oaths.

THEREAS by a flatute made in the first year of the reign of Eliz. c. 1. our late fovereign lady Queen Elizabeth, intituled, An act to reffore to the crown the ancient jurisdiction over the estate ecclefiaftical and spiritual, and abolishing all foreign powers repugnant to the fame, the perfons therein mentioned were obliged to take an oath therein mentioned, commonly called the Oath of Supremacy: and whereas by another ftatute made in the third year of the reign of our late fovereign lord King James the firft, intituled, An 3 Jac. 1. c.4. act for the better difcovering and repreffing popish recufants, another oath, commonly called the Oath of Allegiance or Obedience, was required to be taken by the perfons therein mentioned:

Be it enacted by the King's and Queen's moft excellent The old oaths majefties, by and with the advice and confent of the lords fpi- of allegiance ritual and temporal, and the commons, in this prefent parlia- and fupremament affembled, and by the authority of the fame, That from cy abrogated. henceforth no perfon whatsoever fhall be obliged to take the faid oaths, or either of them, by force or virtue of the faid ftatutes, or either of them, or any other ftatute whatsoever, but that the said statutes, and every other ftatute, for fo much only as concerns the faid oaths, and the faid oaths themselves, fhall be and are hereby repealed, utterly abrogated, and made void.

clock and twelve in the forenoon, before the end of Trinity term next, or at the general quarter feffions to be holden for that county or place where he or they fhall be, inhabit, or refide, in open court, between the faid hours of nine and twelve of the clock in the forenoon, before the first day of August next= all which shall be put on record in the refpective courts.

IV. And all and every other fuch perfon and perfons fhall the new oaths take the faid oaths, and make, repeat, and fubfcribe the faid den, and de- declaration by this prefent act required to be taken, made, and claration to be fubfcribed, before fuch perfon or perfons refpectively, as by any act or acts were authorized or impowered to tender the faid oath of allegiance now abrogated and made void; which faid perfon or perfons fo refpectively authorized to minister or tender the faid oaths and declaration, are hereby required to minifter and tender the fame accordingly.

V. And be it further enacted by the authority aforesaid, That all perfons (other than fuch concerning whom other provifion fhall be made in this act, or in any other act of this prefent feffion of parliament) that shall hereafter be admitted into any office or employment ecclefiaftical or civil, or come into any capacity, in refpect or by reafon whereof they should have been obliged by any ftatute to take the faid abrogated oaths, or either of them, fhall take the oaths hereby appointed, in fuch manner, at fuch times, before fuch perfons, and in fuch courts and places, as they fhould or ought to have taken the faid former oaths, or either of them, in cafe the fame had not been abrogated, as aforefaid. And that every fuch perfon, who shall neglect or refufe to take the fame, thall incur and be liable to the fame penalties, forfeitures, difabilities, and incapacities as by any fuch ftatute was appointed, for or upon neglect, or refufal to take the faid former oaths hereby abrogated, or either of them.

VI. And be it further enacted, That if any perfon now have ing any office or employment, civil or military, thall neglect or refufe to take the faid oaths hereby appointed to be taken, in fuch manner as by this act is directed, before the first day of Auguft. in the year one thoufand fix hundred eighty-nine, or fooner if required thereunto by any order from his Majefty in council, before fuch perfons as by the faid order fhall be appointed to take and receive the fame, that in every fuch case the faid office and employment of every perfon fo neglecting or refusing, shall be void, and is hereby adjudged void.

VII. And be it further enacted by the authority aforesaid, That if any archbishop or bishop, or any other perfon now having any ecclefiaftical dignity, benefice, or promotion, shall neglect or refufe to take the oaths by this act appointed to be taken, in fuch manner as by this act is directed, before the first day of August, in the year one thousand fix hundred eightynine, every fuch perfon and perfons fo neglecting or refufing, thall be, and is, and are hereby declared and adjudged to be, fufpended from the execution of his or their office by the space of fix months, to be accounted from the faid first day of Auguft:

and if the faid perfon or perfons (fo having neglected or refused) shall not within the said space of fix months take the faid oaths in fuch manner, court, or place, as they ought to have taken vel the fame, before the faid first day of Auguft; then he or they fhall be ipfo facto deprived, and is, and are hereby adjudged to be deprived of his and their offices, benefices, dignities, and fr promotions ecclefiaftical.

And be it further enacted, That if any perfon or per- Perfone who fons now being mafter, governor, head, or fellow of any col- are now malege or hall, in either of the two univerfities, or of any other fters of colcollege, or mafter of any hofpital or school, or profeffor of di- leges, &c. neglecting, vinity, law, phyfick, or other fcience in either of the faid how punithed. univerfities, or in the city of London, fhall neglect or refufe to take the oaths by this act appointed to be taken, in such manner, and before fuch perfons as by this act is directed, before the first day of Auguft, in the year one thousand fix hundred eighty nine; every fuch perfon and perfons fo neglecting or refufing, fhall be, and is and are hereby declared and adjudged to be, fufpended from the execution of his or their office and employment, and from his or their mastership, government, fellowship, and professorship respectively, for the space of fix months, to be accounted from the faid firft day of August: And if the faid perfon or perfons (fo having neglected or refufed) fhall not within the said space of fix months take the said oaths in fuch court or place, and before fuch perfons, and in fuch manner, as they ought to have taken the fame before the faid first day of Auguft, that in every fuch cafe the faid office and employment, mastership, government, fellowship, and profefforship of every perfon fo neglecting or refufing, thall be void, and is hereby adjudged void.

IX. And be it further enacted, That if any fuch other per- Perfons refufon or perfons (other than the perfons fpecially above-mention- fing to take the ed) fhall refufe to take the faid oaths, or either of them, when oaths upon tendred to him or them by any perfons lawfully authorized, as committed. tender, to be is aforefaid, to adminifter or tender the fame; the perfon or perfons fo tendring the faid oaths, or either of them, fhall commit the faid perfon and persons so refufing to the common gaol or houfe of correction, there to remain without bail or mainprize for the space of three months, unless fuch offender shall pay down to the faid perfon or perfons fo tendring the faid oaths, or either of them, fuch fum of money, not exceeding forty fhillings, as the faid perfon or perfons fo tendring the faid oaths, or either of them, fhall require fuch offender to pay for his or her faid refufal; which money fhall be paid to the churchwar- Second refudens or overfeers of the poor, for the relief of the poor of the fal. parish or place where fuch offender did laft inhabit: And if at the end of three months after fuch refufal, the perfon and perfons fo refufing fhall again refufe to take the faid oaths, or either of them, when lawfully tendered to him or them, as is aforefaid; the faid perfon or perfons fo tendring the faid oaths, or either of them, fhall commit the faid perfon and perfons fo re
