ORDER

In this verified petition, petitioners pray that after due publication and hearing, an order be issued, directing the Register of Deeds of Caloocan City to reconstitute the original Transfer Certificate of Title No. 28263 in the name of the petitioners herein on the basis of the certified copy of the same transfer certificate of title previously issued by the Registry of Deeds of Caloocan City and once accomplished, the Registry of Deeds of Caloocan City be further directed to issue in lieu thereof a new original of said title which petitioners prays, be regarded in all respect as the original certificate that was lost/destroyed.

It appearing that the petition is sufficient in form and substance, let the same be set for hearing on December 13, 2011 at 8:30 o'clock in the morning before this Court

(Branch 122), 2nd Floor, Caloocan Judicial Complex, 10th Avenue, Caloocan City and all persons interested in the said petition may appear on the above-scheduled date, hour and place and to show cause, if they have, why the petition should not be granted.

That Branch Clerk of Court is hereby directed to furnish copy of the Order the Office of the Clerk of Court so that this order be published at the expense of the petitioners once a week for three (3) consecutive weeks, in any newspaper of general circulation and in the Official Gazette, after a raffle had been conducted by the Executive Judge of the Regional Trial Court of Caloocan City, pursuant to the provisions of P.D. 1079 dated January 28, 1977.

Let copy of the petition, its annexes and this Order be posted by the Sheriff of this Court in accordance with law in three (3) conspicuous places in Caloocan City.

Likewise, let a copy of this Order together with the copy of the petition and its annexes be served upon the Office of the Register of Deeds of Caloocan City, the Office of the Solicitor General and the Office of the City Prosecutor of Caloocan City.

ORDER

In a verified petition, the petitioner asked the Court to render judgment after due notice and hearing declaring the owner's duplicate copy of Transfer Certificate of Title No. 53411 of the Office of the Registry of Deeds of Legazpi City lost, and directing the issuance, in lieu thereof, of a new owner's duplicate copy of TCT No. 53411 with like faith and credit as the previous copy.

The petitioner further asserted that the real property subject of TCT No. 52411 was originally the subject of Cadastral Case No. 2 then filed with the Court of First Instance of Albay acting as a land registration court, the records of which proceedings are no longer existing as certified to by the Office of the Clerk of Court, this Court. For which reason, the petitioner could no longer comply with the mandatory provision of the second paragraph of Section 108 of Presidential Decree No. 1529. Thus, the Court issued an order treating the instant petition as a new land registration case to be proceeded upon in an in rem fashion and for which reason it directed the redocketing of the petition as a voluntary registration proceeding instead of a cadastral proceeding.

The Court finds the petition to be sufficient in form and in substance, and hereby sets

the same for initial hearing on 1 December 2011 at 8:30 o'clock in the morning, at which date and time, any interested party may appear and show cause why the Court should not grant the petition.

Wherefore, the Court hereby directs the publication of this order at the expense of the petitioner in the Official Gazette in accordance with Section 23 of Presidential Decree No. 1529 so the Court may acquire jurisdiction over the res.

The Court further hereby directs the Branch Clerk of Court to send notices of hearing to the petitioner, the office of the Solicitor General, 134 Amorsolo St., Legaspi Village, Makati City, the Land Registration Authority, Quezon City, the City Prosecutor of Legazpi City, Bonot, Legazpi City and the Register of Deeds of Legazpi, to serve as notice to them of the institution of the

Before this Court is a Petition for Judicial Reconstitution of Lost Original Certificate of Title No. 19030 and Issuance of Second Owner's Duplicate Copy of the same title. The same was filed by petitioner Antonio A. L. Lopez, alleging that he is one of the children and compulsory heirs of deceased Luis N. Lopez who died intestate and Luis N. Lopez was one of the children and compulsory heirs of deceased Manuel Lopez who likewise died intestate and a co-owner of a parcel of land covered by Original Certificate of Title No. 15030, identified as Lot No. 3700, of the Register of Deeds of Nasugbu, Batangas, more particularly described as follows:

Finding the petition to be sufficient in form. and substance, the same is set for hearing. on February 28, 2012 at 8:30 o'clock in the morning, before this Court sitting at the Hall of Justice, Regional Trial Court, Balayan, Batangas, at which time, date and place any interested person is hereby ordered to show cause why the petition should not be granted.

Notify the Office of the Solicitor General, the Land Registration Authority, and Office of the Register of Deeds of Nasugbu, Batangas, who may if desired, file within fifteen (15) days from receipt hereof or from last date of publication of their opposition.

The petitioner is hereby directed to furnish the Office of the Solicitor General, the Land Registration Authority and the Register of Deeds of Nasugbu, Batangas, and the adjoining owners of the subject land, within fifteen (15) days from receipt hereof, a copy of the instant petition and its annexes and manifest to this Court compliance herewith.

The Registrar of Deeds of Nasugbu, Batangas is hereby required to make a report to this Court and interpose his timely objection if anomaly is found after proper investigation.

Petitioner is hereby directed to have this Order published, at his expense, twice (2) in successive issues of the Official Gazette and once a week for three consecutive weeks in a newspaper of general circulation in the Province of Batangas.

Let this Order be posted at the main door of the Provincial Building of Batangas, and Bulletin Board of the Hall of Justice, Regional Trial Court, Balayan, Batangas and at the Bulletin Board of the Municipal Building of Balayan, Batangas, at least thirty (30) days prior to the date of hearing at the expense of the petitioner.

ORDER

A verified petition for reconstitution of Transfer Certificate of Title Nos. T-269013 and T-269009 of the Registry of Deeds of Bulacan containing an area 10,290 and 2,447square meters located at San Ildefonso, Bulacan has been filed with this Court by petitioner.

Wherefore, premises considered the said petition is set for hearing on January 18, 2012, at 8:30. o'clock in the morning, at which time and date, any and all interested persons must appear and show cause why the above petition should not be granted.

Let copy hereof be published twice in the successive issues of the Official Gazette, and that the same be. posted by the Court's Sheriff IV at the Bulletin Board of this court, at the Municipal Hall of San Ildefonso, Bulacan at the Provincial Capitol Bulletin Board at Malolos City, Bulacan, at least thirty (30) days prior to the above hearing; and that copies hereof be served to the Prosecutor's Office, Office of the Solicitor General, the Director of Lands, Manila, Registry of Deeds, Bureau of Lands, Tabang, Guiguinto, Bulacan, Land Registration Authority, and to the registered owner/petitioner and her counsel, and to the boundary owners namely Oracio Gonzales, Jose Valmocina and Felicio Catimbang for TCT No. T-269013 and Jovita Marquez, Onofre Valmocina and Zenaida Marquez for TCT No. T-269009.

ORDER

A verified petition was filed on August 12, 2011 by the petitioners, through counsel, praying for, among other things, that after due notice and hearing, an Order be issued directing the Office of the Register of Deeds of Bulacan to reconstitute the original copy

of OCT No. 8309 which was lost and/or

destroyed during the fire on March 7, 1987 in the Office of the Register of Deeds of Bulacan as well as to issue a second owner's of the said title in lieu of the lost one which is beyond recovery.

Petitioners alleged that they are the legal heirs of deceased Sps. Andres Dionisio and Toribia delos Santos who are the registered owners of a parcel of land covered by OCT No. 8309. Petitioners further alleged that the original copy of OCT No. 8309 was burned in the Office of the Register of Deeds of Bulacan while the owner's duplicate copy thereof was lost by Geodetic Engineer Oscar Saveron who conducted the survey of the property which can no longer be found despite diligent search. Petitioners claimed that no mortgagee, lessee and/or co-owner's duplicate copy of the certificate of title has been issued by the Register of Deeds of Bulacan and that there is no document presented and pending registration therewith affecting the property. Petitioners also claimed that the owner's duplicate copy of the said certificate of title has not been delivered to any person or financial entity to answer for an obligation.

Finding the same to be sufficient in both form and substance, Notice is hereby given that the foregoing petition shall be heard on February 9, 2012 at 8:30 o'clock in the morning before this Branch of the Court sitting at the Bulwagan ng Katarungan, Capitol Compound, Malolos City, Bulacan, on which date, time and place, all interested parties may appear and show cause, why the said petition should not be granted.

Let copies of this Order be published in two (2) successive issues of Official Gazette at the expense of the petitioners with the

last issue not less than thirty (30) days prior to the date of the aforestated hearing. Likewise, let copies of this Order be posted at the bulletin board of this Court, at the main entrance of the Municipal Hall of Malolos, Bulacan at the lobby of the Provincial Capitol Building of Bulacan, and in a conspicuous place where the property is located.

Furthermore, let copies of this Order be furnished the Office of the Solicitor General. the Office of the Land Registration Authority, the Office of the Register of Deeds of Bulacan, the Office of the Provincial Prosecutor of Bulacan and the Regional Technical Director, Department of Environment and Natural Resources (DENR), San Fernando, Pampanga and the adjoining owners of the property subject of this petition.

The petitioners are hereby directed to furnish the above agencies with copies of the petition with annexes and to submit their compliance in Court before the date of the scheduled hearing.
