Finding the petition to be sufficient in forrn and substance, the same is set for hearing on February 15, 2012 at 8:30 o'clock in the morning before this Court, sitting at the Hall of Justice, Regional Trial Court, Balayan, Batangas, at which time, date and place any interested person is hereby ordered to show cause why the petition should not be granted.

The petitioners are hereby directed to have this Order published at its expense thrice in the Official Gazette, once a week for three (3) consecutive weeks in a newspaper of general circulation in the Philippines, and once a week for three (3) consecutive weeks in a newspaper of general circulation in the province of Batangas.

Let this Order be posted at the main door of the Provincial Building of Batangas, at the Bulletin Board of the Hall of Justice, Regional Trial Court, Balayan, Batangas, and at the Bulletin Board of the Municipal Building of Tuy, Batangas, at the expense of the petitioners.

Notify the Office of the Solicitor General, the Land Registration Authority, and the Bureau of Lands, who may file, within fifteen days from receipt hereof or from the last date of publication, their opposition.

The petitioners are hereby ordered to furnish the Office of the Solicitor General, the Land Registration Authority, the Bureau of Land, and the adjoining owners of the subject land, within fifteen (15) days from receipt hereof, with a copy of the application and its annexes and manifest to this Court compliance herewith.

Before the court is the petition filed by Sps. Aquino Sy Lee and Veronica Ong Lee, Sps. Manuel Sy Lee and Ruby Chan Lee, Sps. Edmund Sy Lee and Dolores Cheng Lee, Sps. Andres Sy Lee and Hester Go Lee, Ada Gan and Ivy Gan, Koe Lion Hoc, Sps. Dee Kong Hi and Wong Suk Min, Sps. Wilfred Lee and Doris Cua Lee represented by Miriam S. Tan praying that, the Court render its judgment authorizing the petitioner to sell Lot 1-B of subdivision plan Psd 03128816 covered by Transfer Certificate of

Title No. 431404 in favor of Wilbert Jayson B. Chan and authorizing the closure of Lot 1-B of subdivision plan Psd 03-128816 covered by Transfer Certificate of Title No. 431404 designated as access road. The petitioners likewise pray for other relief just and equitable under the circumstances.

Petitioners alleged that: they are all of legal age and the registered co-owners of a parcel of land covered by Transfer Certificate of Title No. 431404 (Annex C) located at Barangay Libtong, Meycauayan City, Province of Bulacan while respondent Office of the Register of Deeds of Meycauayan, Bulacan with address at Meycauayan, Bulacan is hereby impleaded merely as a nominal party; they are represented for the purpose of the instant case by their attorney-in-fact, Miriam S. Tan likewise of legal age, with address at 22 Sitio Malinis, Lawang Bato, Valenzuela City, where she may be served with summons and other court processes as evidenced by the special power of attorney (Annex A); Transfer Certificate of Title No. 431404 covers Lot B of subdivision plan Psd 03128816 being a portion of Lot 1, Pcs-03006322; it appears from the said subdivision plan (Annex B) that the subject parcel of land was designated as passage way of Lot 1-E, Lot 1-C, Lot 1-D and Lot 1-F of the same subdivision plan going to the main road; the said Transfer Certificate of Title No. 431404 has an annotation that the same is subject to the limitation imposed by Section 50, Presidential Decree No. 1529; they transferred or disposed of the said parcel of land covered by TCT No. 431404 in favor of Wilbert Jayson B. Chan for which reason they hereby asked for court approval; attached to the petition is the deed of absolute sale (Annex D); all portions of Lot 1 (Lot 1-E, Lot 1-C, Lot 1-D and Lot 1F) of the subdivision plan as evidenced by the certificate of title (Annexes E to E-3) was already consolidated to one owner named Wilbert Jayson B. Chan who is incidentally the buyer of the property subject of the instant case, thus, the very purpose for which the road lot was constituted no

longer exists as the same is not being used and will no longer be used as road lot; there is no intention to use the same as road lot; Lot 1-E, Lot 1-E, Lot 1-C, Lot 1-D and Lot For any other portion of the subdivision plan is no longer using the subject parcel of land as their access road or road lot; as a matter of fact, the same will be consolidated into one property and covered by (1) transfer certificate of title; no person or party will be in any way affected or prejudiced by the sale of the said property and closure of the said road lot; moreover, constitution of the subject property as road lot or passage way is no longer relevant and necessary, it is respectfully submitted that the same may be closed and disposed of.

Wherefore, finding the petition to be sufficient in form and substance, let the same be set for hearing on December 13, 2011 at 8:30 o'clock in the morning at which date and time, all interested persons are enjoined to appear and show cause, if any, why the petition should not be granted.

Let a copy of this Order be published in two (2) consecutive issues of the Official Gazette and be posted by the Deputy Sheriff of this Court for at least thirty (30) days before the scheduled date of hearing at the main entrance of the Provincial Capitol Building, Malolos City, Bulacan, at the Municipal Building of Meycauayan, Bulacan and at the bulletin board of this Branch of Court at the expense of the petitioner.
