Deeds, while the owner's duplicate copy of the said certificate of title was lost and/or misplaced and the same can no longer be located despite diligent search thereof. The attorney-in-fact and co-heir Felicidad C. Gatdula executed an Affidavit of Loss to attest to the fact of loss of the owner's duplicate copy of said certificate of title. ORDER

Before this court is a verified Petition for Reconstitution of TCT No. T-296506 and the issuance of Owner's Duplicate Copy thereof.

Petitioners alleged that they are both of legal age, married, Filipino and resident of Makinabang, Baliuag, Bulacan represented by Elvira Bautista pursuant to a Special Power of Attorney; that they are the owners of a parcel of land described as Lot 3343A (LRC) Psd-255832 being a portion of Lot 3343, Baliuag Cadastre LRC Cad Record No. 2114, situated in Brgy. Makinabang, Baliuag, Bulacan containing an area of 1,692 square meters and embraced under TCT No. T-296506 of the Registry of Deeds of Bulacan; that they acquired the said property by purchase from the Baliuag Rural Bank, Inc. pursuant to a Deed of Absolute Sale dated August 29, 1991; that the said parcel of land described as Lot 3343-A situated in Makinabang, Baliuag, Bulacan was acquired by Baliuag Rural Bank, Inc. to which the said bank was issued TCT No.

T-296506 and the bank subsequently conveyed the said property in favor of the petitioners; that the original copy of the said certificate of title TCT No. T-296506 on file with the Registry of Deeds of Bulacan was lost when the said office was gutted by fire in March 1987 as certified to by the Register of Deeds; that the owner's duplicate copy of the said certificate of title was likewise lost by their attorney-in-fact Elvira Bautista. (Elvira); that when they entrusted to the custody of Elvira the owner's duplicate copy of TCT No. T-296506 to look for interested purchasers thereof, however, the said owner's duplicate copy was lost when Elvira renovated her house and the said certificate of title was lost in the course of the renovation and the same can no longer be located despite diligent search thereof; that consequently, Elvira executed an Affidavit of Loss and submitted the same to the Office of the Register of Deeds of Bulacan for record and/or registration purposes; that the said property described as Lot 3343-A is covered by Tax Declaration No. 200603008-014221 covering an area of 1,692 square meters situated in Makinabang, Baliuag, Bulacan registered in the name of Baliuag Rural Bank, Inc. and embraced under TCT No. T-296506 of the Registry of Deeds of Bulacan has been declared for taxation purposes for the Year 2006; that real estate tax due on the said property was duly paid for by Elvira Bautista, their attorney-in-fact for the Year 2010 as evidenced by Official Receipt No. 4197873; that the said parcel of land subject of the petition is duly covered by the Technical Description duly verified to and approved by the Land Registration Authority and the Plan prepared for the Baliuag Rural Bank, Inc. by the Licensed Geodetic Engineer on the basis of approved technical description of the property; that they are in actual possession of the said property and the building erected on the said property; that no mortgagee or lessee and/or co-owners duplicate copy of the said certificate of title has been issued by the Register of Deeds of Bulacan; that there is no document presented and pending registration with the

A verified petition, dated May 06, 2011 was filed by Sps. Alberto and Virginia Chua represented by Elvira Bautista, through counsel, Atty. Sinfronio A. Barranco, praying that after due notice, publication and hearing, an Order be issued to the Register of Deeds of Guiguinto, Bulacan authorizing the reconstitution of TCT No. T-112352 of the Register of Deeds of Bulacan in lieu of the lost original copy of the said certificate of title which should be declared null and void, and to issue the owner's duplicate copy thereof in favor of the petitioners in lieu of the lost owner's duplicate copy of said certificate of title which should likewise be declared null and void, pursuant to Sec. 110 of PD 1529.

The petition alleged among others the following:
1. That petitioners are all of legal age, married,
Filipino and resident of Makinabang, Baliuag,
Bulacan herein represented by Elvira
Bautista, pursuant to a Special Power of
Attorney hereto attached as Annex "A";

2. That petitioners are the registered owners of
a parcel of land described as Lot 3342-A of
the subdivision plan (LRC) Psd-14183 being
a portion of Lot 3342, Baliuag Cadastre LRC
Cad Record No. 784, situated in Barangay,
Makinabang, Baliuag, Bulacan containing an
area of 573 square meters and embraced
under TCT No. T-112352 of the Registry of
Deeds of Bulacan, hereto attached as Annex
"B";

3. That original certificate of title TCT No. T112352 on file with the Office of the Register of Deeds of Bulacan was lost when the said Office was gutted by fire sometime in March, 1987 as certified to by the Register of Deeds of Bulacan herewith attached as Annex "C"; 4 That the owner's duplicate copy of the said certificate of title was lost in the possession

of petitioners attorney-in-fact Elvira Bautista to whom petitioners entrusted the custody of the said certificate of title to look for possible purchaser, however, the same was lost when Elvira Bautista renovated her residence and the said owner's duplicate copy of TCT No. T-112352 was lost in the course of the renovation and the same can no longer be located despite diligent search thereof accordingly, Elvira Bautista executed and Affidavit of Loss and submitted the same to the Office of the Register of Deeds of Bulacan for record and/or registration purposes, copy of the said Affidavit of Loss is hereto attached as Annex "D";

5. That the said parcel of land subject of the petition with an area of 573 square meters and covered by TCT No. T-112352 is covered by Tax Declaration No. 2006-03008-01425 registered in the name of the petitioners and declared for taxation purposes for the Year 2006, and real estate tax due on the said property was duly paid for by the petitioners for the Year 2010 under Official Receipt No. 4197874 copies of said Tax Declaration and Official Receipt of tax payment are herewith attached as Annexes "E" and "F"";

6. That the said parcel of land subject of the petition, is covered by Technical Description duly verified to and certified correct by the Land Registration Authority hereto attached as Annex "G";

7. That said property is likewise covered by a plan prepared for Alberto S. Chua by a licensed Geodetic Engineer covering a parcel of land situated in Barangay Makinabang, Baliuag, Bulacan covering an area of 573 square meters, copy of the said plan is herewith attached as Annex "H";

8. That the said property is in actual possession of the petitioners and the building erected on the said property;

9. That no mortgagee, lessee and/or co-owners duplicate copy of the said certificate of title has been issued by the Register of Deeds of Bulacan;

10. That there is no document presented and pending registration with the Office of the Register of Deeds of Bulacan affecting the said property;

11. That the names, and the respective addresses of the boundary owners are as follows:

Finding the petition to be sufficient in both form and substance, the court hereby orders that the said petition be set for hearing on November 15, 2011 at 8:30 a.m. before Branch 14 of of this court, here at Bulwagan ng Katarungan, Provincial Capitol Compound, Malolos City, Bulacan at which date, time and place all persons having interest therein are required to appear and show cause if any, why the petition should not be granted.

Let copies of this order be furnished the petitioner, Atty. Sinfronio A. ORDER

A verified petition was filed by Flora L Esguerra praying that after due publication, notice and hearing, an order be issued directing the Registrar of Deeds of Bulacan to reconstitute the original Transfer Certificate of Title No. T-7186 and to issue another owner's duplicate copy thereof in lieu of the lost and/or missing owner's duplicate copy.

The petition alleges among others that petitioner is of legal age, widow of the late Alejandro Esguerra, Filipino citizen and a resident of San Miguel, Bulacan; she is the registered co-owner of a parcel of land described in TCT No. T-7186 (Annex A) of the Register of Deeds of Bulacan, situated in the Barrio of San Jose, Municipality of San Miguel, Province of Bulacan with an area of three hundred fifteen (315) square meters as evidenced by the said title, the original copy of the subject title was one among those destroyed and/or burned in a conflagration which gutted the Office of the Register of Deeds of Bulacan on March 7, 1987 as per the certification (Annex B) issued by the Register of Deeds; the owner's duplicate copy of said title has been missing and/or lost as attested to by the petitioner in her affidavit of loss (Annex C); the property described in the subject title has been declared for taxation purposes under Tax Declaration of Real Property ARP No. 2006-22037-00084 (Annex D) issued by the Municipal Assessor of San Miguel, Bulacan and the realty tax (Annex E) for the year 2011 duly paid; the subject property and title have not been encumbered nor subject to any lien or claim by third parties and that there are no deeds or instruments affecting the subject properties which are presented or pending registration with the Office of the Register of Deeds of Bulacan; no co-owner's mortgagee's or lessee's copy thereof has been issued nor there are buildings and/or structures erected thereon which do not belong to the petitioner as she is in physical possession of the subject property, the names and addresses of the owners of the adjoining properties are as follows:

the subject property measures three hundred fifteen (315) square meters and the meters and bounds thereof are clearly delineated in the technical description of lot and its sketch plan.

Wherefore, let the petition for reconstitution and issuance of second owner's copy of TCT No. T-7186 of the Registry of Deeds of Bulacan be set for hearing on September 27, 2011 at 8:30 o'clock in the morning.

Let a copy of this Order be published in two (2) consecutive issues of the Official Gazette and be posted by the Deputy Sheriff

of this Court at the main entrance of the Provincial Capitol Building of Malolos, Bulacan, at the Municipal Building of San Miguel, Bulacan and at the bulletin board of this Branch of Court at least thirty (30) days prior to the scheduled date of hearing at the expense of the petitioner. This is a verified petition filed by the petitioner, through counsel, praying that after due notice, publication and hearing, the Register of Deeds of Bulacan be ordered and directed to reconstitute the original of Transfer Certificate of Title No. 3294 and after payment of the proper fees prescribed by law, to declare null and void the owner's duplicate certificate of TCT No. 3294 and to issue in lieu thereof new owner's

duplicate certificate which shall in all respect

be entitled to like faith and credit as the

original duplicate thereof.

The petition alleged that petitioner is a farmer beneficiary with an Emancipation Patent awarded to him as evidenced by the List of Farmer-Beneficiaries with Emancipation Patent with SN No. 007905601 (Transfer Certificate of Title No. 15807(8-7-08) which was issued by the Department of Agrarian Reform on May 5, 2008 which covers an agricultural land with an area of 12.879 sq.m. located at Bulihan, Malolos City, Bulacan. That the said Emancipation Patent No. 00790601 issued in the name of Herly M. Bruno was submitted to the Registry of Deeds of Bulacan on August 7, 2008 and with the supposed Title Number as TCT No. 15807(8-7-08) is noted on the face of the title but was not yet signed by the Register of Deeds of Bulacan because the original of TCT No. 3294 which covers Lot 10-11586-C has yet to be reconstituted. The owner's duplicate copy of the said title was lost or misplaced and which circumstances as the subject of an Affidavit of Lost executed by the petitioner. The original copy of TCT No. 3294 registered in the name of Loreto Tanjosoy vda. De Bautista, et al., on file with the Registry of Deeds of
