ORDER AND NOTICE OF HEARING

Notice is hereby given, that on April 25, 2012 at 8:30 o'clock in the morning hearing shall be held on the verified petition for naturalization pursuant to Commonwealth Act No. 473, filed through counsel by petitioner Mihir Ashok Kumar Khanchandani who alleges, among others, that he is an Indian national, single, 21 years of age, having been born on November 24, 1986 at Anand-Kaira, India and presently residing at 701 Orient Mansion, Tordesillas Street, Salcedo Village, Makati City since August 2003. He arrived in the Philippines on April 26, 1992 and stayed at Unit 1136, Cityland 8, Sen. Gil Puyat Avenue, Makati City from 1992 to 1995; from 1996 to 1998 resided at Unit 743, Cityland 8, Sen. Gil Puyat Avenue, Makati City and at Unit 735 Cityland 9, Dela Rosa Street, Makati City from 1998 to 2008.

he was then admitted and stayed in the Philippines under Section 9(a) of the Philippine Immigration Act of 1940. While still a minor, he was granted legal residence under Republic Act No. 7919, otherwise known as "The Alien Social Integration Act of 1995" on January 31, 1997, and was issued his Alien Certificate of Registration (ACR) No. 112585 and Immigrant Certificate of Residence (ICR) No. 312181 on April 2, 1997, His legal residence was derived from his father, Ashok Kumar Taranchand Khanchandani, who applied for the social integration under said act on October 17, 1996, which was approved by the Bureau of Immigration on January 31, 1997, thus, petitioner is eligible for Philippine citizenship under Sec. 10 of R.A. No. 7919.

Intended witnesses proposed to be introduced are Mr. Tariq Mian, a resident of No. 7 Juan Luna Street, San Lorenzo Village, Makati City and Michael P. Yukong, an outsourced pilot and with residence at Block 5, Lot 3, Camella, E-Aldana, Tramo Road, Las Piñas City,

Hearing shall be held before this court sitting at the 33rd (13th) Floor of the City Hall Bldg., Makati City, F. Zobel Street corner J. P. Rizal Avenue, Makati City.

The Clerk of Court and Ex-Officio Sheriff of this court, is instructed to publish a copy of the verified petition and its annexes as well as this order, at the expense of the petitioner, in three (3) consecutive issues of the Official Gazette and once a week for three (3) consecutive weeks in a newspaper of general circulation, the last publication to be at least six (6) months before the aforesaid scheduled date and to have copies of the same be posted in public and conspicuous places in the Office of the Clerk of Court and in the building where said office is located. 1.3. Unit 735 Cityland 9, Dela Rosa Street, Makati City, from 1998 to 2003.

2. He has as yet no occupation, but owns a real estate in the country which is worth not less than Five Thousand Pesos (P5,000.00).

3. He is more than twenty-one years of age, having been born on November 24, 1986 at Anand-Kaira, India.

4. He first arrived in the Philippines via Cathay Pacific Airlines with Flight No. CX901, at the Ninoy Aquino International Airport (NAIA), Manila on April 26, 1992. He was then admitted and stayed in the Philippines under Section 9(a) of the Philippine Immigration Act of 1940.

5. While still a minor, petitioner was granted legal residence under Republic Act No. 7919, otherwise known as "The Alien Social Integration Act of 1995" on January 31, 1997, and was issued his Alien Certificate of Registration (ACR) No. 112585 and Immigrant Certificate of Residence (ICR) No. 312181 on April 2, 1997. A copy of his ICR is hereto attached as Annex A. His legal residence was derived from his father, Ashokkumar Taranchand Khanchandani, who applied for the social integration under said act on October 17, 1996, which was approved by the Bureau of Immigration on January 31, 1997. Petitioner is thus eligible for Philippine citizenship under Sec. 10 of R.A. No. 7919.

5.1. Petitioner was subsequently issued ACR No. E 267530 on August 20, 2002, pursuant to R.A. No. 7919, and a computerized one bearing the same ACR number of January 18, 2007, hereto attached as Annexes B and C.

6. He has the qualifications required by Commonwealth Act (CA) No. 473, specifically under Sec. 2, to wit:

6.1. He is more than twenty-one years of age at the time this petition may be heard;

6.2. He resided in the Philippines for a continuous period of not less than ten (10) years;

6.3. He is of good moral character and believes in the principles underlying the Philippine Constitution. He has conducted himself in a proper and irreproachable manner during the entire period of his residence in the Philippines in his relation with the constituted government as well as with the community in which he is living; has mingled socially with Filipinos, and has evinced a sincere desire to learn and embrace the customs, traditions and ideals of the Filipino people.

6.4. He owns a real estate in the Philippines worth not less than five thousand pesos, Philippine currency; and

6.5. He is able to speak and write English and Pilipino, or Tagalog as he finished his elementary and high school in the Philippines, having attended the St. Mary of the Woods School located at Makati City, and earned the degree of Bachelor of Science in Business Administration major in Marketing Management at the De La Salle College of Saint Benilde, Manila.

7. He shall not become a public charge. He is not disqualified for naturalization under the provisions of CA No. 473; he does not possess any or all of the following disqualification provided under Sec. 4 of the said Act; (a) he is not opposed to organized government or affiliated with any association or group of persons who uphold and teach doctrines opposing all organized government; (b) he is not a person defending or teaching the necessity or propriety of violence, personal assault, or assassination for the success and predominance of their ideas; (c) He is not a polygamist or a believer in the practice of polygamy; (d) he has not been convicted of any crime or crimes involving moral turpitude; (e) he is not suffering from mental alienation or incurable contagious diseases; (f) he is a person who, during the period of his residence in the Philippines, has mingled socially with the Filipinos, and has evinced a sincere desire to learn and embrace the customs, traditions, and ideals of the Filipinos; (g) he is a subject of India, a country which is not at war or has never been at war with the Philippines; and (h) he is a citizen or subject of said country whose laws grant Filipinos the right to become naturalized citizens or subjects thereof.

8. He has complied with the requirements of Sec. 5 of CA No. 473, or has filed his declaration of intention with the Office of the Solicitor General (OSG) (more than) one year prior to the filing of this petition. The Declaration of Intention dated October 8, 2007, filed with the OSG on October 8, 2007, hereto attached as Annex D, and its attachments, are made integral parts of this petition. The Certification dated March 12, 2009, in lieu of the Certificate of Arrival, issued by the Bureau of Immigration is attached as Annex E.

9. It is his intention in good faith to become a citizen of the Philippines and to renounce absolutely and forever all allegiance and fidelity to any foreign state, prince, potentate or sovereignty, particularly to the Indian Government of which at this time he is a subject or citizen. He will reside continuously in the Philippines from the date of the filing of this petition up to the time of his admission to Philippine Citizenship.

10. The affidavits of two credible persons, namely, Tariq Mian and Michael P. Yukong, stating that they are citizens of the Philippines and personally know the petitioner to be a resident of the Philippines for a continuous period of not less than ten (10) years and a person of good repute and morally irreproachable, and that said petitioner has in their opinion all the qualifications necessary to become a citizen of the Philippines and is not in any way disqualified under the provisions of CA No. 473, are attached as Annexes F and G hereof. The post office address of the said witnesses the petitioner desires to introduce at the hearing are, No. 7 Juan Luna Street, San Lorenzo Village, Makati City and Block 5, Lot 3, Camella, E-Aldana, Tramo Road, Las Piñas City, respectively.

11. The two photographs of the petitioner duly signed by him are attached as Annexes

H and H-1.

PRAYER

WHEREFORE, premises considered, it is respectfully prayed of the Honorable Court that after giving due course to the petition, publication and hearing, the Honorable Court issue an order granting the petition for admission as citizen of the Philippines and/or issue a Certificate of Naturalization in favor of the petitioner pursuant to R.A. No. 7919 and Commonwealth Act. No. 473.

Other relief and remedies just and equitable in the premises are likewise prayed for.

1. I have a bona fide intention to become a citizen of the Republic of the Philippines.

2. I am 20 years old, student, single and no issue. I was born on November 24, 1986 at Anand-Kaira India with last foreign residence in India and owe allegiance to the Republic of India. My physical descriptions are:

of which is hereto attached as Annex "B". The Bureau also issued a Certification dated September 27, 2007, establishing my lawful entry into the Philippines through social integration under Republic Act No. 7919 on October 17, 1996, which was approved on January 31, 1997. The original copy of said Certification is hereto attached as Annex "C" and made integral part hereof.

6. I was first issued Alien Certificate of Registration No. E112585 on April 2, 1997. I was issued another Alien Certificate of Registration No. E 267530 pursuant to R.A. No. 7919 on August 20, 2002 at Manila, a photocopy of which is hereto attached as Annex "D". A new or computerized Alien Certificate of Registration E267530 was issued on January 18, 2007, a photocopy of which is hereto attached as Annex "E".

7. I am permanently residing in the Philippines since my first arrival and admitted as an immigrant at the port of Manila on April 2, 1997 pursuant to R.A. No. 7919, as shown by the photo copy of my Immigrant Certificate of Residence No. 312181 issued on April 2, 1997, hereto attached as Annex "F".

8. My recent 2x2 pictures with signature across its bottom are attached at the upper left side of every first page of this Declaration.

9. I am executing this Declaration of Intention to be filed with the Office of the Solicitor General in compliance with Section 5 of Commonwealth Act No. 473, otherwise known as the Revised Naturalization Law, preparatory to the filing of my petition for admission to Philippine citizenship under said law or under R.A. No. 7919, and for such other valid and legal purpose it may

serve.

I, TARIQ MIAN, of legal age, Filipino citizen, married, and a resident of No. 7 Juan Luna Street, San Lorenzo Village, Makati City, after having been sworn to in accordance with law hereby depose and say that:

1. I am a citizen of the Republic of the Philippines.

2. I have personally known and have been closely acquainted in the Philippines with MIHIR ASHOK KUMAR KHANCHANDANI a.k.a. TONY KHANCHANDANI, the petitioner in the above-entitled naturalization case, for a continuous period of more than (10) years.

3. To my personal knowledge, the petitioner has resided continuously in the Philippines, particularly in Metro Manila, where the petition is made, for a period of more than ten (10) years preceding the date of the filing of said petition of which this affidavit forms part.

4. I have personal knowledge that the petitioner is and, during all such periods, has been a person of good repute and morally irreproachable, attached to the principles underlying the Philippine Constitution, and well disposed to the good order and happiness of the Philippines.
