A verified amended petition was filed by the petitioner through counsel praying among others that after due notice and hearing a judgment be rendered in favor of the herein petitioner ordering the Register of Deeds of Quezon City to reconstitute the original copy of TCT No. 30226 and to declare the lost title in the name of the petitioner be annulled.

The petition alleged that the petitioner is the owner of a parcel of land covered by Transfer Certificate of Title No. 30226 of the Registry of Deeds of Quezon City located at Brgy. Salvacion, La Loma, Quezon City.

The petitioner acquired the said property by virtue of an Affidavit of Self-Adjudication dated November 23, 2010; that the original copy of the said title could not be found in the Register of Deeds of Quezon City which was allegedly not included among those saved titles during the fire that razed the Quezon City Hall on June 11, 1988; that the owner's copy of the said certificate was lost and all efforts to locate the same proved futile, an Affidavit of Loss executed by the petitioner and submitted to the Register of Deeds for registration purposes, the latter refused to accept the said affidavit of loss on the ground that the original copy which was under their custody was burned during the fire; that no co-owner's, mortgagee's lessee's duplicate had been issued.
