§ 2671. Authorization of appropriations.

In order to make the grants to carry out the purposes of section 2670 of this title, there are authorized to be appropriated $60,000,000 for the fiscal year ending June 30, 1971, $105,000,000 for the fiscal year ending June 30, 1972, $130,000,000 for the fiscal year ending June 30, 1973, and $32,500,000 for the fiscal year ending June 30, 1974. § 2677. Payments to the States for planning, administration, and services.

(b) (1) Except as provided in paragraph (2), the "Federal share" with respect to any State for purposes of this section for any fiscal year shall be 75 per centum of the expenditures, other than expenditures for construction, incurred by the State during such year under its State plan approved under this subchapter during each of the fiscal years ending June 30, 1971, and June 30, 1972, and 70 per centum of such nonconstruction expenditures during each of the fiscal years ending June 30, 1973, and June 30, 1974.

AMENDMENTS

PART A.-GRANTS FOR CONSTRUCTION

§ 2681. Authorization of appropriations.

There are authorized to be appropriated, for grants for construction of public and other nonprofit community mental health centers, $35,000,000 for the fiscal year ending June 30, 1965, $50,000,000 for the fiscal year ending June 30, 1966, $65,000,000 for the fiscal year ending June 30, 1967, $50,000,000 for the fiscal year ending June 30, 1968, $60,000,000 for the fiscal year ending June 30, 1969, $70,000,000 for the fiscal year ending June 30, 1970, $80,000,000 for the fiscal year ending June 30, 1971, $90,000,000 for the fiscal year ending June 30, 1972, $100,000,000 for the fiscal year ending June 30, 1973, and $20,000,000 for the fiscal year ending June 30, 1974. (c) Programs for drug addicts and other persons with drug abuse and other dependence problems. After June 30, 1973, the Secretary may not approve any State plan unless it provides for treatment and prevention programs in the field of drug abuse and drug dependence, commensurate with the extent of the problem, and it includes the provisions required by section 246(d) (2) (k) of this title for State plans submitted under section 246(d) of this title. § 2687. Nonduplication of grants.

No grant may be made after January 1, 1964, under any provision of the Public Health Service Act, for any of the fiscal years in the period beginning July 1, 1964, and ending June 30, 1974, for construction of any facility described in this part, unless the Secretary determines that funds are not available under this part to make a grant for the construction of such facility. PART B.-GRANTS FOR INITIAL COST OF PROFESSIONAL AND TECHNICAL PERSONNEL OF CENTERS

PART REFERRED TO IN OTHER SECTIONS This part is referred to in section 3795 of this title. § 2688a. Applications and conditions for approval.

(b) Restriction upon making grant.

No grant may be made under this part after June 30, 1974, with respect to any community mental health center or with respect to any type of service provided by such a center unless a grant with respect thereto was made under this part prior to July 1, 1974.

(c) Programs for drug addicts and other persons with drug abuse and other drug dependence problems; authorization of appropriations.

If an application for a grant under this part for a community mental health center is made for any fiscal year beginning after June 30, 1972, and

(1) the Secretary determines that it is feasible for such center to provide a treatment and rehabilitation program for drug addicts and other persons with drug abuse and other drug dependence problems residing in the area served by the center and that the need for such a program in that area is of such a magnitude as to warrant the provision of such a program by the center, such application may not be approved unless it contains or is supported by assurances satisfactory to the Secretary that the center will provide such program in such fiscal year; or

(2) the Secretary determines that it is feasible for the center to assist the Federal Government in treatment and rehabilitation programs for drug addicts and other persons with drug abuse and other drug dependence problems who are in the area served by the center, such application may not be approved unless it contains or is supported by assurances satisfactory to the Secretary that the center will enter into agreements with departments or agencies of the Government under which agreements the center may be used (to the maximum extent practicable) in treatment and rehabilitation programs (if any) provided by such departments or agencies.

For the purpose of making grants under this part to assist community mental health centers to meet the requirements of this subsection there are authorized to be appropriated $60,000,000 for the fiscal year ending June 30, 1973, $60,000,000 for the fiscal year ending June 30, 1974, and $60,000,000 for the fiscal year ending June 30, 1975. § 2688d. Authorization of appropriations.

(a) There are hereby authorized to be appropriated $19,500,000 for the fiscal year ending June 30, 1966, $24,000,000 for the fiscal year ending June 30, 1967, $30,000,000 for the fiscal year ending June 30, 1968, $26,000,000 for the fiscal year ending June 30, 1969, $32,000,000 for the fiscal year ending June 30, 1970, $45,000,000 for the fiscal year ending June 30, 1971, $50,000,000 for the fiscal year ending June 30, 1972, $60,000,000 for the fiscal year ending June 30, 1973, and $49,131,000 for the fiscal year ending June 30, 1974, to enable the Secretary to make initial grants to community mental health centers under the provisions of this part. For the fiscal year ending June 30, 1967, and each of the fourteen succeeding years, there are hereby authorized to be appropriated such sums as may be necessary to make grants to such centers which have previously received a grant under this part and are eligible for such a grant for the year for which sums are being appropriated under this sentence.

PART C.-GRANTS FOR FACILITIES FOR ALCOHOLIC REHABILITATION

PART REFERRED TO IN OTHER SECTIONS This part is referred to in section 2688t of this title. § 2688j-1. Grants to public or nonprofit private agencies for developing specialized training programs, training personnel, conducting surveys and field trials, and programs of special significance. The Secretary is authorized during the period beginning July 1, 1970, and ending June 30, 1974, to make grants to any public or nonprofit private agency or organization to cover part or all of the cost of (1) developing specialized training programs or materials relating to the provision of public health services for the prevention or treatment of alcoholism, or developing inservice training or short-term or refresher courses with respect to the provision of such services; (2) training personnel to operate, supervise, and administer such services; (3) conducting surveys and field trials to evaluate the adequacy of the programs for the prevention and treatment of alcoholism within the several States

§ 2688k. Grants for treatment facilities.

(a) Construction or leasing costs; compensation of professional and technical personnel. Grants from appropriations under section 26880 of this title may be made to public or nonprofit private agencies and organizations to assist them in meeting the costs of construction or leasing of treatment facilities (including facilities for emergency medical services, intermediate care services, or outpatient services, or posthospitalization treatment facilities) for narcotic addicts and other persons with drug abuse and drug dependence problems within the States, and to assist them in meeting the costs, determined pursuant to regulations of the Secretary, of compensation of professional and technical personnel for the initial operation of such facilities constructed or leased with grants made under part A or this part or of new services in existing treatment facilities for narcotic addicts and other persons with drug abuse and drug dependence problems.

(b) Administration of grant program; application; conditions for approval.

The grant program for construction or leasing of facilities authorized by subsection (a) of this section shall be carried out consistently with the grant program under part A except to the extent, in the judgment of the Secretary, special considerations make differences appropriate; but (1) before the

Secretary may make a grant under such subsection for the construction of a treatment facility for narcotic addicts and other persons with drug abuse and drug dependence problems he must find that the application for such grant meets the requirement of section 2685 (a) (5) of this title (relating to the payment of prevailing wages), and (2) the amount of any such grant with respect to any project shall be such percentage of the cost thereof, but not in excess of 663 per centum (or 90 per centum in the case of a facility providing services for persons in an area designated by the Secretary as an urban or rural poverty area), as the Secretary may determine.

§ 26881. Grants to public or nonprofit private agencies for developing specialized training programs, training personnel, conducting surveys and field trials, and programs of special significance. The Secretary is authorized, during the period beginning July 1, 1968, and ending with the close of June 30, 1974, to make grants to any public or nonprofit private agencies and organizations to cover part or all of the cost of (A) developing specialized training programs or materials relating to the provision of public health services for the prevention and treatment of narcotic addiction, drug abuse, and drug dependence, or developing in-service training or short-term or refresher courses with respect to the provision of such services; (B) training personnel to operate, supervise, and administer such services; (C) conducting surveys and field trials to evaluate the adequacy of the programs for the prevention and treatment of narcotic addiction, drug abuse, and drug dependence within the several States with a view to determining ways and means of improving, extending, and expanding such programs; and (D) programs for treatment and rehabilitation of narcotic addicts and other persons with drug abuse and drug dependence problems which the Secretary determines are of special significance because they demonstrate new or relatively effective or efficient methods of delivery of services to such narcotic addicts and other persons with drug abuse and drug dependence problems. (d) Authorization of appropriations.

To carry out the purposes of this section, there are authorized to be appropriated $3,000,000 for the

fiscal year ending June 30, 1971, $12,000,000 for the fiscal year ending June 30, 1972, $14,000,000 for the fiscal year ending June 30, 1973, and $1,700,000 for the fiscal year ending June 30, 1974. (As amended Pub. L. 93-45, title II, § 205(b), June 18, 1973, 87 Stat. 94.)

§ 2688n-1. Special projects for narcotic addicts and drug dependent persons.

(e) Authorization of appropriations.

There are authorized to be appropriated to carry out this section not to exceed $20,000,000 for the fiscal year ending June 30, 1971; $30,000,000 for the fiscal year ending June 30, 1972; $60,000,000 for the fiscal year ending June 30, 1973; and $60,000,000 for the fiscal year ending June 30, 1974. (As amended Pub. L. 92-255, title IV, § 401(c), Mar. 21, 1972, 86 Stat. 76; Pub. L. 93-45, title II, § 205(c), June 18, 1973, 87 Stat. 94.)

AMENDMENTS

1973-Subsec. (e). Pub. L. 93-45 decreased appropriations authorization for fiscal year ending June 30, 1974, from $75,000,000 to $60,000,000.

1972-Subsec. (e). Pub. L. 92-255 increased appropriations authorization from $35,000,000 to $60,000,000 for fiscal year ending June 30, 1973, and authorized appropriation of $75,000,000 for fiscal year ending June 30, 1974.

PART E.-GENERAL PROVISIONS

§ 26880. Authorization of appropriations.

(a) There are authorized to be appropriated $15,000,000 for the fiscal year ending June 30, 1969, $15,000,000 for the fiscal year ending June 30, 1970, $40,000,000 for the fiscal year ending June 30,1971, $60,000,000 for the fiscal year ending June 3, 1972, $80,000,000 for the fiscal year ending June 30, 1973 and $36,774,000 for the fiscal year ending June 30, 1974, for project grants for construction and staffing of facilities for the prevention and treatment of alcoholism under part C or the prevention and treatment of narcotic addiction, drug abuse, and drug dependence under part D and for grants under sections 26881 and 2688j-1 of this title. Sums so appropriated for any fiscal year shall remain available for obligation until the close of the next fiscal year.

(b) There are also authorized to be appropriated for the fiscal year ending June 30, 1971, and each of the next ten fiscal years such sums as may be necessary to continue to make grants for staffing with respect to any project under part C or D for which a staffing grant was made from appropriations under subsection (a) of this section for any fiscal year ending before July 1, 1974.

§ 2688t. Approval by National Advisory Mental Health Council.

Grants made under this subchapter (other than parts C and D thereof) for the cost of construction and for the cost of compensation of professional and technical personnel may be made only upon recommendation of the National Advisory Mental Health Council established by section 218(a) of this title. Grants under part C of this subchapter for such costs may be made only upon recommendation of the National Advisory Council on Alcohol Abuse and Alcoholism. Grants under part D of this subchapter for such costs will undergo such review as is provided by section 218(e) of this title. (As amended Pub. AMENDMENTS

1972-Pub. L. 92-255 substituted "parts C and D" for "part C" in first sentence, struck out "established by such section" at end of second sentence, and added third sentence for review under section 218(e) of this title of grants under part D for costs, respectively.

PART F.-MENTAL HEALTH OF CHILDREN

§ 2688u. Grants for treatment facilities.

(d) Authorization of appropriations.

(1) There are authorized to be appropriated $12,000,000 for the fiscal year ending June 30, 1971, $20,000,000 for the fiscal year ending June 30, 1972, $30,000,000 for the fiscal year ending June 30, 1973, and $16,515,000 for the fiscal year ending June 30, 1974, for grants under this part for construction and for initial grants under this part for compensation of professional and technical personnel, and for training and evaluation grants under section 2688v of this title.

(2) There are also authorized to be appropriated for the fiscal year ending June 30, 1972, and each of the next nine fiscal years such sums as may be necessary to continue to make grants with respect to any project under this part for which an initial staffing grant was made from appropriations under paragraph (1) for any fiscal year ending before July 1, 1974. SHORT TITLE OF 1972 AMENDMENT Section 1 of Pub. L. 92-424, Sept. 19, 1972, 86 Stat. 688, provided: "That this Act [which enacted sections 2702b, 2813-2815, 2827, 2971b-2971d, 2981-2985, and 29952995d of this title, amended sections 2724, 2742, 2749, 2771, 2791, 2809, 2812, 2824, 2836, 2837, 2862, 2864, 2871, 2907, 2932, 2933, 2943, 2949, 2965, 2966, 2974, 2991, 2992a, 2993, 2993a, 2994b, 2994d, and 3044b of this title, repealed sections 2763-2768 and 2826 of this title, and enacted provisions set out as notes under sections 2942 and 3044b of this title] may be cited as the 'Economic Opportunity Amendments of 1972"."

EXECUTIVE ORDER NO. 11470

Ex. Ord. No. 11470, May 26, 1969, 34 F.R. 8227, set out as a note under this section, which made arrangements for the structure and conduct of a National Voluntary Action Program, was superseded by Ex. Ord. No. 11603, June 30, 1971, 36 F.R. 12675, set out as a note under section 2501 of Title 22, Foreign Relations and Intercourse. & 2702b. Authorization of appropriations.

(a) For the purpose of carrying out parts A, B, and E of subchapter I of this chapter (relating to work and training) there are authorized to be appropriated $900,300,000 for the fiscal year ending June 30, 1973, and $950,000,000 for the fiscal year ending June 30, 1974.

(b) (1) For the purpose of carrying out the Project Headstart program described in section 2809(a) (1) of this title, there are authorized to be appropriated $485,000,000 for the fiscal year ending June 30, 1973, and $500,000,000 for the fiscal year ending June 30, 1974.

(2) The Secretary of Health, Education, and Welfare shall establish policies and procedures designed to assure that not less than 10 per centum of the total number of enrollment opportunities in the Nation in the Headstart program shall be available for handicapped children (as defined in paragraph (1) of section 602 of the Elementary and Secondary Education Act of 1965, as amended) and that services shall be provided to meet their special needs. The Secretary shall implement his responsibilities under this paragraph in such a manner as not to exclude from any project any child who was participating in the program during the fiscal year ending June 30, 1972. Within six months after September 19, 1972, and at least annually thereafter, the Secretary shall report to the Congress on the status of handicapped children in Headstart programs,
