RULE V

PENAL PROVISION AND
ENFORCEMENT OF THE ACT

SEC. 33. Penal Provision.-The following, shall be punished by a fine of not less that Two hundred thousand pesos (200,000.00) not more that Five hundred thousand pesos (P500,000,00) or to suffer imprisonment for a period of not less than two years and one day nor more than five years, or both in the discretion of the court: (a) Any person who shall practice

dentistry, dental hygiene or dental technology in the Philippines as defined in R.A. No. 9484, without a certificate of registration and professional identification card and

a

in special permit issued accordance with the provisions of R.A. 9484 and this "RR", or has been declared exempt;

(b) Any person who practice the professional to whom the definition of the practice of dentistry, dental hygiene or dental technology does not apply;

(c) Any registered and licensed dentist who shall abet the illegal practice of dentistry;

(d) Any person presenting or using as

his/her own the certificate of registration and professional identification card and special permit of another;

(e) Any person who shall give any false or forged evidence to the Board in obtaining a certificate of registration; Any person who shall impersonate

any registrant of like or different name;

append to his name the letters
D.D.S., B.D.S., L.D.S., or D.M.D.
without having been conferred such
title or

(i) Any person who advertises any title or description tending to convey the impression that he/she is a dentist without holding valid certificate of registration and professional identification card and special permit from the Board.

SEC. 34. Enforcement of R.A. No. 9484.— It shall be the duty of all constituted officers of the law of the national, provincial, city, municipal or barangay level of the government, to enforce the provisions of R.A. No. 9484 as well as the rules and regulations pertinent thereto, this "RR" and to prosecute any person violating the same. The Secretary of Justice shall act as the legal assistance as may be necessary in carrying out the provisions of R.A. No. 9484.

RULE VI

MISCELLANEOUS PROVISIONS

SEC. 35. Funding Provision.—The Chairperson of the Professional Regulation Commission shall immediately include the Commission's programs for the implementation of R.A. No. 9484, the funding of which shall be included in the Annual General Appropriations Act.

SEC. 36. Transitory Provision.—The existing Board shall continue to function in the interim until time that the new Professional Regulatory Board of Dentistry shall have been constituted pursuant to R.A. No. 9484.

SEC. 37. Implementing Rules and Regulations.-The Board, in coordination

policies or part(s) thereof issued pursuant to R.A. Nos. 4419 and 768, R.A. No. 8981, and the other laws which are inconsistent with this "RR" (the "Rules and Regulations of the Philippine Dental Act of 2007" or "RR of R.A. No. 9484, or "RRPDA of 2007", are hereby superseded, repealed, or amended accordingly.

SEC. 40. Effectivity.-This "RR" shall take effect after fifteen (15) days following its full and complete publication in the Official Gazette or in any newspaper of general circulation in the Philippines.

SPECIAL PROCEEDINGS No. SP7-041-MN.- In Re: Petition for Admission as Citizen of the Philippines.

KWOK YEUNG CHING, Petitioner.

AMENDED ORDER

Before the Court is a petition for admission filed by Kwok YEUNG CHING praying that after due notice, publication and hearing, a decision be rendered admitting him as citizen of the Republic of the Philippines.

It is alleged that petitioner is of legal age and presently residing at No. 10 Macopa Road, Potrero, Malabon City; that he has continuously resided in the said address since his arrival sometime in 1989; that petitioner is a businessman and consultant from which he derives income; that petitioner was born in Fujian, People's Republic of China, on October 1, 1973 and is, at present, a citizen of said country under whose laws prior permission to renounce

nationality is not required and Filipinos may become naturalized citizens; that petitioner is married to Wong Chuk Ching with whom he has three (3) children, namely: Yi Man, 11 years old; Yi Tung, 8 years old; and Ka Wing, 6 years old, all surnamed Kwok who are all enrolled in a school recognized by the Government where Philippine History and Government are taught and is not limited to any race or nationality; that petitioner is registered with the Bureau of Immigration having been issued ACR No. E-130144 on August 21, 1997 and ICR No. 318692 at Manila; that petitioner is able to speak and write English, Chinese and Tagalog and is of good moral character; that petitioner believes in the principles underlying the Philippine Constitution and had conducted himself in a proper and irreproachable manner during the entire period of his relations with the constituted government as well as the community in which he lives; that he has mingled socially with the Filipinos and has evinced a sincere desire to embrace the customs, traditions and ideals of the Filipinos; that petitioner has all the qualifications under Sec. 2, and none of the disqualifications under Section 4 of Commonwealth Act No. 473; that petitioner has not heretofore made any petition for naturalization/citizenship with any court; and that Maricel N. Domingo and Lily Lingad Rodriguez both of whom are Filipino citizens will appear and testify as witnesses at the hearing of this petition.

Wherefore, finding the petition to be sufficient in form and in substance, notice is hereby given that this petition is set for hearing on November 18, 2008 at 8:30 o'clock in the morning before this Court sitting at the Justice Building, Catmon, Malabon City, at which time and date,

all persons interested may appear and show cause, if they have any, why this petition shall not be granted.

Let a copy of this Order together with that of the petition and its annexes be published, prior to said date of hearing, at petitioner's expense, once week for three (3) consecutive weeks in the Official Gazette and in a newspaper of general circulation in Metro Manila, to be determined by raffle pursuant to P.D. 1039. Likewise, let the same be posted at the City Hall of Malabon, at the bulletin boards of the main entrances of Branches 72, 73, 74, 169 and 170 of this Court.

PETITION FOR NATURALIZATION

I hereby apply for naturalization as a citizen of the Philippines and to this Honorable court, respectfully alleges:

1. My full name is Kwok YEUNG CHING; I have no other name or alyas;

2. My present place of residence is at No. 10 Macopa Road, Potrero, Malabon City, where I resided since I arrived in the Philippines on July 24, 1989 up to the present and before said date, and from birth to July 1989. I resided in Fujian Province, People's Republic of China;

3. I have a gainful occupation

as a businessman and consultant from which I derived income sufficient to support me and my family, and from which I derived savings deposited in the bank;

4. I was born on October 1, 1973 in Fujian, People's Republic of China;

I am at present a citizen or subject of the People's Republic of China under whose laws prior permission to renounce nationality is not required and Filipinos may become naturalized citizens or subjects thereof;

5. I am married to Wong Chuk Ching, a Chinese citizen and we have 3 children born in the Philippines namely: Kwok Yi Man-11 years old; Kwok Yi Tong -8 years old and Kwok Ka Wing - 6 years old; and they are studying in a school recognized by the government where Philippine history and Government are taught and is not limited to any race or nationality;

6. I am able to speak and write English, Chinese and Tagalog;

7. I filed a declaration of Intention to become a citizen of the Philippines on August 02, 2006 with the Office of the Solicitor General pursuant to Commonwealth Act 473, as amended; I emigrated to the Philippines from China on September 16, 1996 and my last foreign residence was in Fujian, China;

8. I am a person of Good Moral Character, I believe in the principles underlying the Philippine Constitution; I have conducted myself in a proper and irreproachable manner during the entire period of my residence in the Philippines in my relation with the constituted government as well as with the community in which I am living; I have mingled socially with the Filipinos and have evinced a sincere desire to learn and embrace the customs, traditions and ideals of the Filipino people; I have all the qualification required under Section. 2 and none of the disqualifications provided under Section 4 of Commonwealth Act 473, amended;

9. I am not opposed to organize government or affiliated with any association or group of persons who uphold and teach doctrines opposing all organized governments; I am not defending or teaching the necessity or propriety of violence, personal assault or assassination for the

success or predominance of men's ideas; I am not a polygamist or a believer in the practice of polygamy; I have not been convicted of any crime involving moral turpitude; I am not suffering from any incurable contagious diseases or from mental alienation; the nation of which I am a citizen is not at war with the Philippines;

10. It is my intention in good faith to become a citizen of the Philippines and to renounce absolutely and forever all allegiance and fidelity to any foreign prince, potentate, state or sovereignty, and particularly to China of which at present I am a citizen or subject; I will reside continuously in the Philippines from the time of the filing of this petition up to the time of my admission as citizen of the Philippines;

11. Maricel N. Domingo, of legal age, Filipino citizen and residing at no. 116-B Bagong Sibol, Marcela, Caloocan City, and Lily Ligad Rodriguez, of legal age, Filipino and residing at No. 72C Ilang-Ilang St., Meycauayan, Bulacan, will appear and testify as my character witnesses at the hearing of my petition;

12. Attached hereto are copies of my Birth Certificate, Alien Certificate of Registration and Immigration Certificate of Residence;

WHEREFORE, petitioner respectfully prays that he be admitted as citizen of the Philippines.
