Dividing and Inclofing certain Open and Com-
mon Fields, Commonable Lands, and Waste
Grounds, in the Parish of Wootton in the
County of Oxford.

HEREAS there are lying and being within the Preamble. Parish of Wootton, in the County of Oxford, certain large open and common Fields, commonable Lands, and wafte Grounds, which confift of, and are reputed to contain together Forty Yard Lands, or thereabouts and several other Pieces and Parcels not diftinguished by the Name of Yard Lands.

And whereas the Warden and Fellows of St. Mary Winton College, commonly called New College, in Oxford, are seised of and in the perpetual Advowfon, Right of Patronage, and Presentation of, in and to the Rectory, of the Parish of Wootton aforesaid, and the Rev. John Banks, Clerk, is Rector of the Rectory of Wootton, and is feised in Right of the faid Rectory, of, in and to all the Rectorial and small Tithes arifing and renewing within the Parish of Wootton aforesaid, or to fome Compofition in lieu thereof; and the faid John Banks, in Right of his faid Rectory, is also feised of certain Glebe Lands lying in the faid common Fields, common Paftures, and common Meadows of

limme And whereas His Grace the Moft Noble George Duke of Marlborough, Knight of the Most Noble Order of the Garter, is Lord of the Manor to of Wootton aforefaid, and the Reverend Thomas Gregory, Thomas Southam, 22 Chriftopher Wildman, William Southam, and Wilham Forfhew, together with the faid John Banks, and divers other Freeholders, and Land-owners, are feifed of all the Lands lying in the common Fields, common Paftures, Meadow Grounds, and wafte Grounds, in the Parish of Wootton aforefaid, in and by this Act appointed to be inclofeditooM 1. poscut ye

And whereas the faid common Fields, commonable Lands, and wafte Grounds, lie intermixed and are inconveniently fituated with respect to the feveral Houfes of the Proprietors thereof in the Parish aforefaid, and 1in their prefent Situation are incapable of Improvement; and the Propri ១.រ etors of the feveral common Fields, commonable Lands, and wafte Grounds, are defirous that the fame Lands and Grounds may be divided 910 and inclosed, and that specific Shares thereof may be allotted and affigned to and among them in feveralty, in lieu of, and in Proportion to their refpective Lands, Tithes, common Rights, and Intereft therein.

But although fuch Divifion, Allotments, and Inclosure, will tend greatly to the Advantage of the feveral Parties concerned, and be a great Improvement of their refpective Properties and Interefts in the faid Lands and Grounds before defcribed; Pet, as the fame cannot be effectually made and established without the Aid and Authority of Parliament;

That it may be Enacted; And be it Enated, by the KING's Moft Excellent MAJESTY, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons in this prefent Parliament affembled, and by the Authority of the fame, That the faid open and common Fields, and all Common, Arable, Meadow, and Pafture Grounds, commonable Lands, and wafte Grounds, fituate, lying, and being, within the faid Parish of Wootton, fhall on or before the Twenty-ninth Day of September, One Thousand Seven Hundred and Seventy (or as foon after as conveniently may be) be divided, fet 190out, and allotted by Francis Burton, of Aynhoe, in the County of Northampton, Gentleman; the Reverend Henry Jephcott, of Kiflingbury, in the faid County, Clerk; John Watts, of Sulgrave, in the faid County, Gentleman Samuel Benwell, of New Woodstock, in the County of Oxford, Gentleman; and John Mitchell, of Great Tew, in the faid County, Gentleman; Commiffioners appointed by this Act, and their Succeffors, or any three or more of them, in the Manner,
