NOTE. At the general election held in November, 1873, Judge MONELL and Mr. GILBERT M. SPIER were elected to fill the places which would become vacant on the first of January, 1874, by the expiration on that day of the terms for which Chief Justice BARBOUR and Judge MONELL had been elected.

On the first of January, 1874, Chief Justice BARBOUR retired from the bench. An account of the proceedings had on his retirement will be found in volume 36 of these Reports.

Shortly after January 1st, 1874, Judge MONELL was selected by his associates to be chief justice of the court.
