English Guineas weighing five pennyweights fix grains, Spanish piftoles weighing four pennyweights fix grains, 000040 106 016 French milled pilloles weighing four pennyweights and four grains, o t O 8 O But if any of the coins aforefaid, should hereafter be rendered lefs vainable than they are at prefent, either by leffening their weight, or therewith ing a greater quantity of alloy than is in them refpeftively at prefent, then for ch of any of the faid coins, the value of which is fo reduced, to be received for the tolls aforefaid, as is equal in value to the faid coins in their present state of fineness and weight, shall be payable for the faid tolls at their reduced value only. And in cafe of refufal or neglect to pay the tolls at the time of offering to pass through any of the faid places, and previous to the veffel's paffing through the fame, the Collectors of the faid tolls may lawfully refufe paflage to fuch veffels, and if any veffel shall pafs without paying the faid toll, then the faid Collectors may feize fuch veffel wherever found, and fell the fame at auction for ready money, which fo far as is neceffary shall be applied towards paying the faid toll and all expenfes of feizure and fale, and the balance, if any, shail be paid to the owner; and the perfon having the direction of fuch veffel, shall be liable for fuch toll, if the fame is not paid by fale of fuch veffel as aforefaid. Provided, That the faid proprietors or a majority of them, holding at leaft three hundred shares, shall have full power and authority at any general meeting, to leffen the faid tolls or any of them, or to determine that any article may pafs free of toll. X. AND be it enacted, That the faid river and the works to be erected thereefteamed a public high on in virtue of this Act, when completed, shall forever thereafter be esteemed and taken to be navigable as a public highway, free for the tranfportation of all goods, commodities, or produce whatsoever, on payment of the tolls impofed by this Act, and no other toll or tax whatever for the ufe of the water of the faid River, and the works thereon erected, shall at any time hereafter be imposed by both or either of the faid States, fubje&t nevertheless to fuch regalations, as the Legislatures of the faid States may concur in, to prevent the onportation of prohibited goods, or to prevent fraud in evading the payment of duties impofed in both or either of the faid States on goods imported into either of them. AND WHEREAS it is neceflary for the making the faid canal, locks, and other works, that a provifion should be made for condemning a quantity of land for the purpose; How the neceffary lande may be acquired by the Company. XI. BE it enacted, That it shall and may be lawful for the faid Prefident and Directors, or a majority of them, to agree with the owners of any land, through which the faid canal is intended to pafs, for the purchase thereof, and in cafe of difagreement, or in case the owner thereof shall be a feme-covert, under age, non-compos, or out of the State, on application to any two Juftices of the County, in which fuch land shall lie, the faid Juftices shall iffue their warrant, under their hands, to the Sheriff of their County, to fummon a Jury of twenty-four inhabitants of his County, of property and reputation, not related to the parties nor in any manner interested, to meet on the land to be valued, at a day to be expreffed in the warrant, not less than ten, nor more than twenty days thereafter; and the Sheriff, upon receiving the faid warrant, shall forthwith fummon the faid Jury, and when met, provided that not less than twelve do appear, fhall adminifter an oath or affirmation to every Juryman that shall appear, "That he will faithfully, juftly and impartially value the land (not exceeding in any cafe the width of one hundred and forty feet) and all damages the owner thereof shall fuftain by the cutting the canal through fuch land, according to the best of his fkill and judgment, and that in fuch valuation he will not spare any perfon, through favor or affection, nor any perfon grieve through malice, hatred or ill-will." And the inquifition thereupon taken, fhall be figned by the Sheriff, and fome twelve or more of the Jury, and returned by the Sheriff to the Clerk of his County, to be by him recorded; and upon every fuch valuation, the Jury is hereby directed, to defcribe and afcertain the bounds of the land by them valued, and their valuation fhall be conclufive on all perfons, and fhall be paid by the faid Prefident and Directors to the owner of the land, or his legal reprefentative, and on payment thereof, the faid Company fhall be feized in fee of fich land, as if conveyed by the owner to them and their |
