Petitioner alleges that he is a Filipino, of legal age and a resident of No. 40 6th Street, Barangay Mariana, New Manila, Quezon City; that he is the registered owner of the aforesaid parcel of land covered by TCT No. R-2650; that the said TCT was derived from TCT No. 113060 (1023) which was also registered under the name of herein petitioner; that he was in possession of the said parcel of land which is consequently by registered mail to the person/s named covered by Tax Declaration No. B-016168884; that a Deed of Absolute Sale dated November 20, 2008 was duly executed by the petitioner in favor of his children; that when the vendees facilitated the transfer of TCT No. R-2650, the Register of Deeds for Malabon City refused the registration of the aforesaid deed insofar as TCT No. R-2647, R-2648, R-2649 and R-2650 on the ground that there was no file existing on their records; that the Original Copy of TCT No. R-2650 under the custody of the Register of Deeds was missing. Hence, this instant petition.

Wherefore, finding the petition to be sufficient in form and substance, the same is re-set for initial hearing on March 30, 2012 at 8:30 o'clock in the morning before this Court sitting at the New Justice Hall Bldg., Sisa Extension, Barangay Tinajeros, City of Malabon and anyone who has objection to the application should file his opposition thereto with the statement of his grounds therefore on or before said date of hearing.

A compliance was filed by Atty. Virgilio J. Lagunilla, counsel for the petitioners, submitting to the Court the affidavit of the representative of the petitioner, Corazon R. Estrella, the tax declaration involving the subject title and the Real Property Tax Receipt for tax years 2010 and 2011, pursuant to the Order dated September 26, 2011, directing him to comply with Section 5 of Republic Act No. 26, as amended.
