ARTICLE XVI.

MASTERS.Penalties on them for not paying their Servants Wages in Money, &c.

A

LL Perfons concerned in the Manufactures of Hemp, Flax, Linen, &c. or any Manufactures made up of Hemp, Flax, Linen, &c. to pay all Persons by them employed, the full Wages or Price agreed on, in Money, and not in Goods, or by Way of Truck;-and, on the Master's failing to pay the full Wages in Money, the fame to be levied by Diftrefs and Sale of his Goods; and, failing fuch Distress, he to be committed to Prifon for fix Months. -Any Perfon concerned in the Manufacture, paying Wages either in Goods or by Way of Truck, or in any other Way than in Money, to forfeit 10/ Geo. II. § 12. p. 113.

ARTICLE XVII.

SERVANTS employed in any Branch of the Linen Manufacture.-Penalties on them for embezzling Materials, or not performing their Work, or entering into Combinations to raife their Wages, &c.

NY Perfon hired or employed to prepare or

work up any Linen, Hemp, Flax, &c, or any Manufactures made up of Hemp, Flax, &c. or of any of thefe Materials mixed one with another, purloining, embezzling, &c. or otherways unlaw fully difpofing of any of the Materials with which they are intrufted, being convicted by the Oath of the Owner, or of any credible Witnefs, or voluntary Confeffion, to be imprisoned, publickly whipped,

c.And any Perfon knowingly buying, or receiving any Manner of Way, fuch Materials, from any Servant, to forfeit 201. for the firft Offence, and 40 l. for the fecond; and in cafe of Non-payment, to be publickly whipped, &c. Juftices may grant Warrant to fearch the Houses of any Perfons convicted of purloining, &c.-Workmen not returning Materials remaining after finishing their Work, within 21 Days after the Work is finished, to be adjudged Embezzlers of fuch Materials, and punished accordingly. 22 Geo. ANY Journeyman neglecting or refufing to perform the Work he engaged for, and hiring himself to another Master before completing his Work, being convicted by the Oath of one credible Wit

nefs, to be sent to the House of Correction, and there kept at hard Labour for a Month.-Any Servant leaving his Service before Expiry of the Time for which he was hired, or quitting or returning his Work before it is finished, to be committed to the Correction-house, and kept at hard Labour for a Time not exceeding Three Months. 22 Geo. II. $9. & 12. p. 111. & 113.

ALL Contracts, Agreements, &c. for advancing Wages, or leffening ufual Hours of Work, &c. to be void; and all Perfons figning, or prefuming to execute the fame, or any unlawful Combination of that Kind, to be imprisoned and kept at hard Labour, for a Time not exceeding Three Months.→ Any Servant who fhall wilfully damnify, fpoil, or deftroy any Goods or Work with which he fhall be intrufted, to forfeit double the Value to the Owner; and if not paid, to be committed to the Correction-house, and kept at hard Labour for a Time not exceeding Three Months-Any Perfon affaulting or abufing any Mafter Weaver or Manufacturer, for not complying with illegal Bye-laws, Rules, &c. or threatening to destroy fuch Masters Houses, &c. for not complying with the Demands of their Workmen, &c being convicted within 12 Months from the Time of the Offence, to be adjudged guilty of Felony, and tranfported for feven Years. 22 Geo. OFFICERS appointed by the Trustees.-Penalties for obftructing them in the Execution of their Duty.

A

NY Perfon or Perfons obftructing any Officer appointed by the Trustees, in the due Execution of his Duty, forfeits a Sum not exceeding 50l. nor less than 51. for every Offence. 24 Geo. II. § 24 p. 138.

OFFICERS demanding any Reward or Gratuity, for examining, viewing, or figning Certificates, to intitle to Bounties under this Act, to forfeit their Office, and 100%. Sterling. 19 Geo. III. c. 37. § 10. p. 261.

FFENCES against Acts 13 Geo. I. & 24 Geo II. to be determined by one or more Justice or Justices of the Peace, or Magiftrate or Magistrates of any Borough, fubject to an immediate Appeal to the Quarter-Seffions, whofe Decifion to be final.

If the Sentence be affirmed, the Appellant to pay full Cofts, and double the Penalty in the original Sentence.-Sentences cannot be ftopped by any Sift, Sufpenfion, or other Procefs.-If fufficient Diftrefs cannot be found, the Offender to be commit

ted to the Houfe of Correction, or next Tolbooth, for any Space not exceeding one Year. 13 Geo. I. $31. & 32. p. 42. & 44. & 24 Geo II. § 25. p. 139. -Offences against both these Acts may be alfo determined by any Sheriff or Stewart depute, or their Subftitutes, fubject to an Appeal to the Circuit Courts. 24 Geo. JUDGES neglecting or refufing to execute the Powers given by Acts 13 Geo. I. & 24 Geo. II. or not putting these Acts in Execution, in the most beneficial Manner for promoting the Linen and Hempen Manufactures, may, with the Approbation of the Trustees, be profecuted before the Lords of Jufticiary at Edinburgh, or in the Circuit Courts, and fined in any Sum not exceeding 100 l $33. P. 45. ; & 24 Geo. II. § 28. p. 140.

ALL Offences against Act 17 Geo. II. to be determined by one or more Juftice or Juftices of the Peace. And the Offender convicted upon the Oath of one or more credible Witness or Witnesses. § 2. P. 53.
