of carrying on and improving the British White Herring Fisheries, and to impower the faid Society, by a voluntary Subscription, to raise the Sum of Five hundred thousand Pounds, to be the Capital Stock of the faid Society; it is, amongst other Things, enacted, That for an Encouragement to fuch Perfons as fhould become Subscribers to the Stock for carrying on the faid Fisheries, that the Sum of Three Pounds by the Year for each Hundred Pounds which fhould be actually employed in the faid Fishery, and proportionably for any greater or leffer Sum, fhould be paid to the Proprietors of the faid Stock, for and during the Space of Fourteen Years from the Date of their Charter, out of the Customs, by the Receiver-General of His Majefty's Cuftoms, by equal Halfyearly Payments, provided that the faid Society fhould employ the Sum of One hundred thousand Pounds, at least, in the faid Fisheries, within the Space of Eighteen Months after the Date of fuch Subfcription; and it is, by the said Act, enacted, That no Transfer fhould be made of any of the Stock or Share of or in the faid Five hundred thousand Pounds, for the Space of Five Years from the Date of the faid Charter, but that the fame fhould be abfolutely void to all Intents and Purposes whatsoever; provided that it fhould be lawful for the Executors, and Adminiftrators,

ftrators, or Devifees, of any Perfon or Perfons who fhould happen to die poffeffed of, or interested in, any fuch Stock or Share of or in the faid Five hundred thoufand Pounds, and alfo for the Affignees under any Commiffion of Bankrupts, to transfer fuch Stock or Shares, and difpofe of the Produce thereof in fuch Manner, as they might by Law difpofe of any other Effects of fuch Teftator inteftate or Bankrupt; and as a further Encouragement to all Perfons to engage in the faid White Herring Fisheries, a Bounty of Thirty Shillings per Ton is by the faid Act given, and made payable as therein mentioned, to the Owner or Owners of all decked Veffels, from Twenty to Eighty Tons Burthen, which fhould be built after the Commencement of the faid Act, for the Ufe of the faid Fisheries, whether by the faid Society, or any other Perfon or Perfons, in Manner, and under the Regulations, and upon fuch Conditions, as in the faid Act are after mentioned; fuch Bounty to be paid yearly, during the Space of Fourteen Years from the Commencement of the faid Act, and no longer, upon conforming to the Regulations of the faid Act: And whereas, amongst other Qualifications by the faid Act made neceffary for obtaining a Licence and Authority for Buffes or Veffels to proceed *(E 2)

on the faid Fishery, Oath is to be made by fuch Perfons as in the faid Act mentioned, that fuch Buffes or Veffels fhall proceed either to Braffey Sound in Shetland, and be at the Rendezvous of the faid Fishery there, on or before the Eleventh Day of June, and fhall not fhoot or wet their Nets before the Thirteenth Day of the faid Month of June, and fhall continue following and fishing amongst the Shoals of Herrings as they move Southward, to the First Day of October; or fhall proceed to Campbelltown in Argylefhire, and be at the Rendezvous of the faid Fisheries, on or before the First Day of September, and fhall continue fishing among the Shoals of Herring as they move, to the Thirty-firft Day of December, unlefs they fhall have fooner completed their Loading of Fifh; and that on the Return of fuch Veffel into any Port of Great Bri-tain for her Difcharge, Oath fhall be made by the Mafter of fuch Veffel, that fuch Vetfel was at One of the Places before mentioned, at the Time appointed by the faid Act, and had not fince been on any other Voyage, or purfued any other Defign or View of Profit, and that they did remain fishing according to the Direction of the faid Act: And whereas, by another Act made in the Twenty-fixth Year of the Reign of His faid Majesty, intitu

led, An Act to explain, amend, and render and 26 more effectual, an Act made in the Twentythird Year of the Reign of His prefent Majefty, intituled, "An Act for the Encouragement of the British White Herring Fishery; and for regulating the faid Fishery ac"cording to the Kalendar now in Ufe; and for other Purposes therein mentioned;" it is enacted, That the Oath and Oaths by the faid first mentioned Act required to be taken with Refpect to the Days thereby appointed for the Rendezvous of the faid Society's Buffes or Veffels, and for the Commencement and Duration of the faid Fisheries, fhould be varied and made conformable to the Kalendar then and now in Ufe in thefe Kingdoms; that is to fay, That the Oath to be made in Order to the procuring a Licence to proceed on the faid Fishery, fhould import that it is the firm Purpose and determined Refolution of the Perfons making fuch Oath, that the Bufs or Veffel applying for Licence and Authority to proceed on the faid Fishery, fhould proceed either to Braffey Sound in Shetland, and be at the Rendezvous of the faid Fishery there on or before the Twenty-second Day of June, and fhould continue fishing, as in the faid Act mentioned, to the Twelfth Day of October, or fhould proceed to Campbelltown in Argylefhire, and be at the Rendezvous of the

faid Fisheries on or before the Twelfth Day of September, and fhould continue fishing to the Eleventh Day of January, unless they fhould have fooner completed their Loading of Fish; and that the Oath 7 by the faid first-mentioned Act required to be made by the refpective Masters of the faid Buffes or Veffels, at their Return into Port, for their Discharge, might and fhould from the Commencement of the faid laft mentioned Act, be varied and made conformable to the Alterations thereby made in refpect of fuch feveral Days of Rendezvous: And whereas, pursuant to the Powers by the faid firft-mentioned Act given to His faid Majefty, a Society by the Name of The Society of the Free British Fishery, hath been incorporated by Charter, bearing Date the Eleventh Day of October, One thoufand feven hundred and fifty, and a very confiderable Sum of Money hath been fubfcribed and paid in towards carrying on the Purposes of the faid Act and Charter, in which the faid Society did actually expend and employ, within Eighteen Months from the Date of their Subfcription, the Sum of One hundred and four thoufand five hundred and nine Pounds, and the faid Society have accordingly, in purfuance of the faid Two feveral Acts herein before recited, receivedof the Commiffioners of
