Fernando, Pampanga, the status of Decree Nos. 519393 and 519428 and she was informed that there are no available records showing that the subject decrees were registered in the Registry and given corresponding title numbers.

Thereafter, on December 16, 2011, upon their counsel's request, the Registry of Deeds issued a more categorical certification that there are no available records in the Office of the Registry of Deeds showing that Decree Nos. 519393 and 519428 issued for lots 3336 and 3425, respectively, were registered and issued corresponding Original Certificate of Title.

Further, the records of the Department of Environment and Natural Resources, CENRO, San Juan Juan Baño, Arayat, Pampanga show that Lot Nos. 3336 and 3425 Arayat Cadastre located at Arayat, Pampanga are not covered by any public land applications or patent titles.

That the petitioners engaged the services of licensed Geodetic Engineer who prepared and certified a sketch plan of the subject lots 3336 and 3425, Arayat Cadastre on the basis of the technical description stated on the certified true copy of Decree Nos. 519393 and 519428 on file with the Land Registration Authority.

Petitioners further alleged that Lots 79 and 80 adjoining subject lots 3336 and 3425 are also part of the Berenguer estate, owned and occupied by the petitioners. The petitioners and their predecessor-in-interest have been in open, actual, public, adverse, continuous, and uninterrupted possession as owners of subject parcels of land since time immemorial and that they have never been disturbed in their possession of the subject properties by anyone since the time of acquisition by them up to the present time. At present, the subject lots are unoccupied and have no improvements.

Moreover, the subject lots 3336 and 3425 were declared for taxation purposes and the corresponding real estate taxes on the

properties have been paid up to the end of 2011. And, the subject lots have not been mortgaged or encumbered nor any deed or other instrument affecting the subject properties have been presented for or is pending registration in the Office of the Registry of Deeds for the Province of Pampanga.

Wherefore, finding the petition to be sufficient in form and substance, the Court hereby sets the hearing thereof on September 25, 2012 at 1:30 o'clock in the afternoon at the Session Hall of this Court located at the Ground Floor of the Hall of Justice, Capitol Compound, City of San Fernando, Pampanga, on which date, time and place, any and all persons who may have an interest therein are hereby commanded to appear and show cause, if any, why the petition should not be granted.

The Register of Deeds of Pampanga or any of his/her duly authorized representative is hereby ordered to appear and bring with him/her the available records/documents

pertaining to the aforesaid title and to testify at the hearing thereof.

Upon receipt of this Order, the petitioners shall cause the notice of the Petition and the initial hearing to be published in the Official Gazette once a week for two (2) consecutive issues before the date of the hearing and be posted on the bulletin board of the Office of the Clerk of Court, City of San Fernando, Pampanga; Municipal Hall of City of Arayat, Pampanga for two (2) consecutive weeks or at least thirty (30) days prior to the hearing, all at the expense of the petitioners.

The petitioners are hereby ordered to furnish the Office of the National Land Registration Authority, Quezon City and to submit other requirements pursuant to LRA Circular No. 35 dated June 13, 1983 to enable said office to submit its report/ recommendation on the Petition on/or before the scheduled initial hearing on September 25, 2012 at 1:30 o'clock in the afternoon.

"A parcel of land (Lot No. 66-A of the subdivision plan Psd-43626, being a portion of Lot 66 of Jolo Townsite, G.L.R.O. Record No. ), situated in the Barrio of Asturias, Municipality of Jolo, Province of Sulu. Bounded on the NE., by Public Land; on the SE., by Lot 67 of Jolo Townsite; on the SW., by General Arolas St., and on the NW., by Lot 66-B of the subdivision plan. Beginning containing an area of Two Hundred Seventy-Six (276) square meters."

that the Original copy of the above described parcel of land covered by TCT No. T-675, which used to be kept in the custody of the Office of the Register of Deeds of Sulu, has been destroyed during the Jolo, Sulu, conflagration on February 7, 1974; that the owner Original copy is still intact and in the possession of the Petitioner; that no co-owners of other duplicate of said Transfer Certificate of Title has been issued; that the following boundary owners of above parcel of land are as follows: to the N.E. - by Public Land; to the S.E. by Lot 67-JTS; to the SW.,- by General Arolas St., to the N.W.- by Lot 66B property of M. Mahagon.

Wherefore, finding the petition to be in due form and substance, let the hearing of this petition be set on September 26, 2012, at 8:30 o'clock in the morning at the session Hall of the Regional Trial Court, Branch 3, Jolo, Sulu, Hall of Justice Bldg., Jolo, Sulu, at which date, time and place. Any person or persons having interest on the said petition may appear and show cause why the said petition should not be granted.

Let notice of hearing in this case be published in the Official Gazette, and in any newspaper of general circulation at the expense of the petitioner, once a week for two (2) consecutive issues, and the same be posted together with this order in the

Bulletin Board of this Court, and other conspicuous places required by law for the information of all concerned.

The Officer-in-Charge of the Office of the Clerk of Court is hereby directed to furnish a copy of this Order together with a copy of the petition to the Office of the Solicitor General, Makati City; the Land Registration Authority, Diliman, Quezon City; the Land Management Bureau, DENR-ARMM, Cotabato City; thru PENRO, Jolo, Sulu, the Provincial Prosecutor of Sulu, and the Register of Deeds of Sulu.

ORDER

This is a verified petition filed by the petitioner, Hja. Juhaira T. Ajijul, thru counsel, praying this court that after due notice, publication and hearing, this Honorable Court directs and orders the

Register of Deeds of Sulu, to reconstitute Lot No. 1720 covered by TCT No. 130; the petitioner alleges that she is of legal age, married, Filipino and a resident of Bilaan, Talipao, Sulu, Philippines; that she is the owner of a parcel of land Lot No. 1720 of the Cadastral survey of Mt. Dajo covered by TCT No. 130, acquired from the heirs of Luis M. Delgado and Teresa J. Delgado, more particularly described as follows:

"A parcel of land (Lot No. 1720 of the Cadastral Survey of Mount Dajo), with improvements existing thereon, situated in the Municipal District of Gitung. Bounded on the NE. by road; on the SE. by Lot No. 1719; on the S. by Lot No. 1727; on the SW. by Lot No. 1728; on the W. by Lot No. 1721; Beginning

containing an area of Fifty Five Thousand Four Hundred Fifty Nine Square Meters (55,459), more or less.

the purchased property was subject to extrajudicial settlement which has been already purchased by the Affidavit of Publication, copy of which hereto attached as Annex "E"; the original copy of said TCT No. 130 Lot No. 1720 of the Cad. Survey Mt. Dajo is still intact and in the possession of the petitioner; the following boundary owners of the above parcel of land are as follows: NE Road; SE Lot No. 1719; S Lot 1727; SW Lot No. 2728, and W Lot No. 1721. The attached as Annexes and made part of this petitions are: "A" TCT No. 130; "B" Tax Declaration No. 1240; "B-1" OR No. 9545846; "C" Certificate from the Register of Deeds; "D' and "D-1" Extra-Judicial Settlement with Sale; "E" Affidavit of Publication.

Finding the petition to be sufficient in form and substance pursuant to R.A. 26, in relation to P.D. 1529 let the hearing of the above-entitled petition be set on November 23, 2012 at 2:00 o'clock in the afternoon before the Regional Trial Court, Branch 4, Hall of Justice, Captiol Building, Patikul, Sulu, and other conspicuous places for the information of all concerned at least thirty (30) days before the date of hearing.

Alleged among others in the said petition and the facts showing that the herein petitioner, is of legal age, married, Filipino and a resident of Asturias, Jolo, Sulu, Philippines; that petitioner is the owner through purchased from the Heirs of Trinidad S. Navata and Calvin Navata of a parcel of land identified at Lot No. 94-NEW with improvements thereon, situated in the Municipality of Jolo, Sulu, containing an area of Three Thousand Six Hundred Fifty-Five (3,655) square meters, more particularly described as follows, to wit:
