4394. Unlawful to Manufacture or Sell Adulterated or Misbranded Foods or Drugs.-No.person, firm or corporation, shall manufacture or introduce into the State of Alabama or solicit or take orders for delivery, or to sell, exchange, deliver or have in his possession with intent to sell, or exchange any article of food or drugs within this state, which is adulterated or misbranded within the meaning of this Act, or that does not conform to the standards of purity enumerated and fixed under the provisions of Section 13 or the rules and regulations established under the provisions of Section 15, of this Act, and any person, firm or corporation who shall violate of the provisions of this Act, shall be guilty of a misdemeanor and for each offense shall, upon the conviction thereof, be fined not to exceed $100.00 and for each subsequent offense, and on conviction thereof, shall be fined not exceeding $200.00. Examination of Samples.-The examination of specimens of food or drugs, shall be made by the state chemist and assistants as herein provided for under the direction and supervision of commissioner of agriculture and industries or municipal or county inspectors where appointed for the purpose of determining from such examinations whether articles are adulterated or misbranded within the meaning of this article; and if it shall appear from any such examinations that any of such specimens are adulterated or misbranded within the meaning of this article the commissioner of agriculture and industries shall cause notice thereof to be given to

party from whom such sample is obtained. Any party so notified shall be given an opportunity to be heard before the commissioner of agriculture and industries and the attorneygeneral or the municipal or county inspector where appointed and circuit court solicitor, under such rules and regulations as may be prescribed by the commissioner of agriculture and industries; and if it appears that any of the provisions of this article have been violated by such party the commissioner of agriculture and industries or other assistants as herein provided for shall at once certify the fact to the proper
