In Cafe of Death, &c. others to be chofen and appointed in their Room: And inCafe any Perfon, fo nominated or appointed, fhall happen to die or remove out of the faid Parish or Place for which he was fo appointed Surveyor or Collector as aforefaid, before his Year is expired, or fhall refuse or neglect to take upon him. fuch Office; in any of thofe Cafes the Churchwardens of the Parish or Place for which fuch Perfon, fo dying, removed,.. or refusing to act (in Cafe fuch Parish or Place be within the faid City or Suburbs) on the next Sunday after fuch Vancancy fhall have happened; and the Clerk of the Peace for the faid Liberty (in Cafe, fuch Vacancy fhall happen within the. fame) at the next General Quarter-Seffions, for the faid Liberty, or any Adjournment'. previous thereto, fhall give fuch publick. Notice, as herein before mentioned, of fuch Vacancy, and of the Day on which fuch Inhabitants as aforefaid of the fame Parish or Place are required to meet to fupply the fame; and fuch Inhabitants as · aforefaid of the fame Parish or Place thall and may, and are hereby required to meet, on the Day for which fuch Notice fhall be fo given, in the Vestry of the fame Parish, or in fuch other proper Place as aforefaid, and then and there they, or the major Part of them, fhall nominate and appoint fome other fubftantial Houfholder of the fame Parish or Place, liable to ferve Parish Offices as aforefaid, to fupply fuch Vacany along with the other Surveyor or Collector (as the Cafe may happen to be) of the fame Parish or Place. till the annual Day of Election of Surveyors and Collectors then next enfuing; and to act in the mean-time with the fame Power and Authority in all Refpects, as if fuch Perfon had been nominated one of the faid Surveyors at fuch annual Day of Election as aforefaid, aforefaid: And it is hereby further enacted, That every Perfon, who fhall be fo annually nominated and appointed to any fuch Office or Employment as aforefaid, or who shall be fo nominated and appointed in the Room of any other Perfon fo dying, removed, or refufing to act, fhall, within ten Days after fuch Appointment, accept of fuch Office or Employment to which he fhall be fo appointed in Pursuance of this Act, and fignify fuch his Acceptance by Writing under his Hand, in the publick Book to be kept for the Purpose of entering the Accounts of fuch Surveyors in each of the faid Parishes and Places; and if any Perfon, fo nominated and appointed, fhall neglect or refuse fo to accept of the Office or Employment to which he shall be fo appointed in Purfuance of this Act, fuch Perfon, fo neglecting or refufing, fhall forfeit the Sum of 51. to be levied and Penalty of Rerecovered as hereafter mentioned, and to fufal. be paid to the acting Surveyor or Surveyors of the fame Parifh, to go and be applied for and towards the Expence of lighting and maintaining the Lamps in the Parish or Place for which fuch Perfon hath fo neglected or refused to serve. Parishes for the And it is hereby further enacted, That Extraparochial fo much of the Street called New-Street, Places to be anotherwife Cumberland-Row, as is deemed to nexed to certain be extraparochial, fhall be construed and taken to be within the Parish of St. Mar- A&t. tin's, Coney-freet, in the faid City, for all the Purposes of this Act, and shall be within the Survey of the Surveyors of the faid Parish of St. Martin's herein before mentioned; and that the Place called MintYard, and fo much of the Street called Lendall, as is deemed to be extraparochial, fhall be conftrued and taken to be within the Parish of St. Wilfred in the faid City, for all the Purposes of this Act, and fhall be Kates to be be within the Survey of the Surveyors of the faid Parish of St. Wilfred herein. before mentioned, in the fame Manner as if the faid refpective Places had been antiently within the faid refpective Parishes : But that to all other Purposes to which this Act doth not extend, the faid respective Places, or so much thereof as is or are now extraparochial, fhall from henceforth Continue and remain as if this Act had not been made, any Thing herein contained to the contrary notwithstanding. And it is hereby further enacted, That made by the from and after the faid 25th Day of June, Surveyors for providing and 1763, theseveral Perfons who fhall be nomiighting Lamps. nated and appointed Surveyors of the faid refpective Parishes and Liberty, fhall, within fourteen Days after they fhall be fo refpectively appointed in every Year, meet at fome publick Place within their respective: Parishes and Limits, (Notice of every fuch Meeting being always given in their refpective Parish Churches as aforefaid, for the faid City and Suburbs, the Sunday next before fuch Meeting, immediately after Divine Service; and in the faid SeffionsHall, or Court-Houfe, for the faid Liberty, three Days before every fuch Meeting;. which Notice the Surveyors of each of the faid refpective Parishes, or one of them,. and the Conftable of the faid Liberty, are or is hereby required to give or caufe to be given) and then and there the faid: Surveyors, or one of them, together with fuch other Parishioners and Inhabitants of their faid refpective Parishes, and of the. faid Liberty, refpectively, being then af feffed to the Land-Tax at 41. by the Year, or upwards, as fhall be there affembled, or the major Part of them, shall and may, and are hereby empowered and required to: make a Rate or Affeffment upon all Houses and. publick or private Buildings of every Kind of Kind, which, at the Time of the making any fuch Rate, are affeffed or affeffable to the Land-Tax (Courts of Justice, Hofpitals, Alms-Houfes, and Work-Houfes for the Poor, only excepted); and upon all Frontfteads, Yards, Orchards, and Gardens, affeffed or affeffable to the LandTax, fituate, lying, and being within the faid Parishes refpectively, and within the faid Liberty; fuch Rate and Affeffment to be a Charge upon the Occupier or Occupiers of the Premifes fo rated, in Cafe there be a known Occupier or Occupiers thereof; and if not, then to be a Charge upon the Owner or Owners thereof rerefpectively; and in Cafe of fuch publick Buildings, then to be a Charge upon any Perfon or Perfons who fhall act as Owner or Owners, Governor or Governors, Director or Directors thereof refpectively, and to be made by an equal Pound-Rate in Proportion as the fame Premises are or fhall be affeffed to the Land-Tax; which Rate and Affeffment, when fo made in Pursuance of this Act, together with a Duplicate thereof, fhall be figned and confirmed by two or more Juftices of the Peace of the faid City and County of the fame, for and in respect of the refpective Parishes in the faid City and Suburbs, and by two Juftices of the Peace of the faid Liberty, for and in refpect of the faid Liberty. And it is hereby further enacted, That, after fuch Rate or Affeffment fhall be fo To be collected made and confirmed as aforefaid, one Part Quarterly. thereof, fo figned and confirmed, shall be kept by the faid Surveyors, or one of them, and the Duplicate thereof, fo figned and confirmed, fhall be delivered by the faid Surveyors, or one of them, to the two Perfons who fhall then be Collectors, appointed as aforefaid, of the Rates and Affeffments to be made by Virtue of this A&; ftices to appoint'; Act; and fuch Collectors, or one of them, are hereby required, without any other Warrant, to demand and collect Quarterly the feveral Sums specified in fuch Rate or Affeffment, of and from the feveral Perfons, who ought to pay the fame by the true Meaning of this Act, and to give Receipts, in Writing under their Hands, (if requi red) for what they fhall fo receive; and the fame, when fo collected and received, fhall be paid over Quarterly by the faid Collectors, or one of them, to the then Surveyors of the fame Parish or Place for which fuch Rate fhall have been made, to be applied as hereafter is directed; which faid Surveyors fhall give Receipts, in Wri ting under their Hands, to the faid Collectors for what they shall so receive. On Default of And it is hereby further enacted, That Appointment if in any Parish or Place, Parishes or Places, of Surveyors by within the faid City, Suburbs, or Liberty Parishes, Ju- aforefaid, no fuch Surveyors fhall be appointed in any Year, within the Time herein before limited and prefcribed for that Purpose, or fuch annual Rate fhall not be made, as is herein before directed, within the Time for that Purpose herein before limited, then the Mayor and any two other Juftices of the Peace of the faid City and County of the fame, (in Cafe fuch Default shall be in any of the Parishes of the faid City and Suburbs) or any two fuch Juftices of the faid Liberty, (in Cafe fuch Default fhall be in any Place within the faid Liberty) fhall and may nominate and appoint two of the most substantial Inhabitants of the refpective Parish or Place, Parishes or Places, wherein fuch Default fhall be, liable to serve Parish Offices therein, to be the Surveyors for fuch refpective Parish or Parishes, Place or Places, till the then next annual Day of Election of Surveyors as aforefaid, which Surveyors, |
