And be it enacted, That this A&t shall Public Act. be taken and allowed in all Courts within this Kingdom as a public A&t; and all Judges, Juftices, and other Perfons, are hereby required to take Notice thereof as fuch, without fpecially pleading the fame.

An ACT for rendering more effectual an A&t passed in the Thirteenth Year of the Reign of his late Maefty King George the First, intituled, "An Act for improving the Navigation of the River Owze, in the County of York."

Preamble reciting 13 Geo. I.

WHEREAS the Trustees appointed to

put in Execution the feveral Powers and Authorities given by an Act paffedin the Thirteenth Year of the Reign of his late Majefty King George the First, intituled, An A&t for Improving the Navigation of the River Ŏwze in the County of York, have proceeded to improve the faid Navigation; and to that End have expended confiderable Sums of Money.

And whereas the Commiffioners appointed in and by the faid Act, in Conjunction, and with the Concurrence of the faid Trustees, have, in Pursuance thereof, laid the feveral Tolls or Rates therein mentioned on all Goods, Wares, Merchandizes, and other Commodities, to the very Extent of the Power given them by the faid Act; but by Reafon of the great Inequality and Difproportion of the Rates which the faid feveral Goods, Wares, and Merchandizes pay, the annual Income arifing therefrom is not fufficient to effect the Improvement of the Navigation of the faid River, and to anfwer the true Intent and Meaning of the faid Act, which would with more Eafe and Certainty be perfected, if the Tolls or Rates were more equally and proportionably laid upon the feveral Goods, Wares, and Merchandizes in the faid Act mentioned, according to the refpective Values, and it further Powers were given to the faid Trustees relating thereunto.

Be it therefore enacted, by the King's Moft Excellent Majefty, by and with the

the fame, That from and after the four-and- After June 24, twentieth Day of June, 1732, all and 1732, the folevery the Goods, Wares, and Merchan-lowing Duties dizes, and other Commodities carried and to be paid. conveyed on the said River Owuze above Wharf-Mouth (except fuch Manure, Dung, Compoft, or Lime only, as fhall be waterborne, and ufed and applied in Tillage; and also except all Timber, Stone, and other Materials made ufe of in or about the Works neceffary for improving of the Navigation of the faid River) fhall pay the Tolls or Rates following, that is to fay, For every Ton of Wines and Groceries, Almonds, Arrack, Brandy, Cyder, CyderEger, Hops, Fish Oil, Line Oil, Florence Oil, Sevil Oil, and Turpentine Oil, Rum, Spirits, Tobacco, Vinegar, Bacon, Hams, Sides, and Pork, Cafes and Chefts by Measure, China, Coffee, Cork, Drugs and Medicines. Dyers Ware (except Logwood, Copperas, and Allum) Flour, Glafs, (except green Glafs Bottles) Haberdafhers? Wares, Houthold Furniture, Iron wrought; Linen and Linen-Drapers' Wares, Lemons, Oranges and Nuts, Leather and Calves-Skin, Mercery-Ware, Silk and Woollen, Paper white, and Books, Gardiners' Seeds, Salt, Tea, and Woollen-Drapery Ware, 2s. 6d. respectively, and so in Proportion for any greater or less Quantity; for every Ton of Cheefe, Flax, Pewter, Soap, Marble, Bell-Metal, Brafs, Battery, and Copper, 2 s. refpectively, and fo in Proportion for any greater or lefs Quantity; for every Ton of Oak-Bark, Corn of all Sorts, Earthen-Ware, Green Glass Bottles, Iron caft and unwrought; Lead, white and red; Paper, Cap, white, and brown; Grafs-Seeds, Beans and Peafe, Rape-Seed,

Stone, Tallow, Tin-Plates and Wire, Timber, Oak, Ash, and Elm, 1 s. refpectively, and fo in Proportion for any greater or lefs Quantity; for every Ton of Allum, Copperas, Logwood, Brimftone, Bricks, Tiles, Coals, Hemp, Hay, Lime for Building, Lead, and Turfs, 6 d. refpectively, and fo in Proportion for any greater or lefs Quantity; for every Firkin, Pot, Cafk, or other Veffel of Butter, 1 d. for every Hundred of Oyfters, 1 d. and that all other Goods not herein particularly rated shall pay ad Valorem, fuch Rates or Duties as fhall be ascertained by the Commissioners appointed by or in Pursuance of the faid former Act.

And be it further enacted, by the AuThefe Duties thority aforefaid, That from and after the to be taken in-faid twenty-fourth Day of June, 1732, it ftead of those shall and may be lawful to and for the appointed by the former A&t. Trustees appointed in and by the faid former Act, and every of them, their, and every of their Succeffors and Affigns, and fuch Perfon or Perions as they shall nominate and appoint, and no others, from Time to Time, and at all Times thereafter, to ask, demand, recover, and take from all and every Person and Perfons that fhall carry and convey any of the aforefaid Goods, Wares, Merchandizes, and Commodities upon the faid River, above WharfMouth, the Tolls and Rates by this A& directed to be taken, and no others, in lieu and instead of the feveral Tolls and Rates impofed and charged upon Goods, Wares, Merchandizes in and by the faid former Act mentioned and expressed; and in Cafe of Neglect or Refufal of Payment thereof to the faid Truftees and their Succeffors, or to fuch Perfon or Perfons, and at fuch Places, and in fuch Manner as the faid Trustees and their Succeffors fhall from Time to Time appoint and direct;

and

and it fhall and may be lawful to and for the faid Trustees, their Succeffors and Affigns, or for fuch Perfon or Perfons as fhall be by them deputed and appointed for collecting thereof, by Warrant under the Hands and Seals of feven or more of the faid Trustees or their Succeffors, to ftop and detain any Ships, Pinks, Keels, Boats, Lighters, or other Veffels wherein fuch Diftrefs for Goods are carried, and for which the faid Non-payment. Rates are by this Act directed to be paid, until due Payment thereof, together with reasonable Charges for ftopping and detaining fuch Pink, Boat, Lighter, or other Veffel; and if fuch Pink, Boat, Lighter, or other Veffel fhall not be redeemed within ten Days after the taking thereof, it fhall and may be lawful to and for the Perfon who fhall ftop and detain fuch Ship or Veffel, to fell fo much of the Goods therein contained, as fhall be fufficient to answer the Tolls and Rates due and payable, and alfo the Charges of ftopping and detaining fuch Veffel, rendering the Overplus, if any be, to the Owner or Master of fuch Veffel, when demanded.

And be it further enacted, by the Au- Goods to be thority aforesaid, that it fhall not be law- entered before ful for any Master or Ruler of any Veffel unladen. navigating upon the faid River, between Wharf-Mouth and the City of York, to unlade or deliver any Goods from on board fuch Veffel, without firft making an Entry of the faid Goods fo by him intended to be unladen, with the Collector of the Tolls and Rates hereby impofed upon fuch Goods, Wares, and Merchandizes; and before the Mafter or Ruler of any fuch Veffel fhall unlade, or caufe to be unladen, any of the faid Goods, Wares, and Merchandizes at the City of York, he shall deliver unto the Collector a true Copy of his Bill VOL.
