live, refide, or be employed, fhall forfeit, for every fuch Offence, the Sum of 5 s. and upon View of fuch Annoyance or Offence by any one of his Majefty's Justices of the Peace for the faid City, or Proof thereof made to him by the Oath of any Perfon, fuch Juftice may and is hereby impowered and required to iffue a Warrant under his Hand and Seal to the Conftable or Peace Officer of the Place where the faid Offence fhall be committed, for levying and recovering the faid Penalty by Distress and Sale of the Goods and Chattels of fuch.. Mafter or Mistress, rendering the Overplus to the Owner thereof, after deducting the neceffary Charges in making, keeping, and felling fuch Diftrefs; one Moiety of the faid Penalty, when recovered, fhall go to and be paid to the Informer, and the other Moiety to the Trustees for the Use of the faid Navigation; and for Want of fuch Diftrefs, then fuch Juftice shall and may, by Warrant under his Hand and Seal, commit fuch Mafter or Mistress to the common Gaol or Workhoufe of the faid City, there to remain until he or the fhall pay the faid Penalty.

And whereas the Navigation of the faid River may receive great Prejudice by washing down the Filth, Dirt, and Soil of the Streets, Lanes, and publick Places of the faid City and Liberties thereof, leading to or towards the faid River, Rivulets,or Water-Courfes running into the fame,

Be it therefore enacted, by the Autho- Affeffments for rity aforefaid, That it fhall and may be cleansing the lawful to and for the Juftices of the Peace Streets. for the faid City, at their General Quarter Seffions holden for the faid City, or the major Part of them, after the faid twentyfourth Day of June, 1732, to appoint one or more Perfon or Perfons to cleanfe the Streets, Lanes, and publick Places of the

faid City and Liberties thereof, leading to,
or towards, the faid River, or any Rivulets

and to carry off the Filth, Dirt, and Soil,
and for defraying the Charges thereof, an
Affellment or Affeffments, not exceeding
6 d. in the Pound in one Year, fhall and
may, from Time to Time, be equally
made upon all and every the Occupiers or
Owners of Houfes, Lands, Tenements, or
Hereditaments in the faid City and Liber-
ties thereof; and fuch Affeffment or Affeff-
ments fhall and may, from Time to Time,
be made by fuch Perfon or Perfons, and
levied and collected in fuch Manner as the
faid Juftices, by their Orders under their
Hands and Seals at fuch General Quarter-
Seffions, or the major Part of them ther
prefent, fhall direct and appoint in that
Behalf, and the Money thereby raised shall
be employed and accounted for according
to the Orders and Directions of the faid
Juftices, for and towards cleansing fuch
Streets, Lanes, and publick Places of the
faid City and Liberties thereof, from Time
to Time, and to no other Ufe or Purpose
whatfoever; and the faid Affeffment or Af
feffments being allowed under the Hands
and Seals of the faid Juftices at fuch Quar-
ter-Sefficus, or the major Part of them
then prefent, fhall and may be levied by
Warrant under their Hands and Seals by
Diftrefs and Sale of the Goods and Chat-
tels of fuch Person or Perfons (not paying
the fame) within ten Days after Demand
made thereof, rendering the Overplus (if
any be) to the Owner or Owners, after
deducting the Charges of making, keep-
ing, and felling fuch Diftrefs.

And be it further enacted, by the Authority aforesaid, That if any Action, Suit, or Information, fhall be commenced or profecuted against any Perfon or Perfons,

any Thing done in Pursuance of this Act, in every fuch Cafe, the Action, Suit, or Information fhall be brought within fix Months next after the Fact committed, and not afterwards, and fhall be brought in the County, City, or Place wherein fuch Caufe of Action fhall arife, and not elfewhere: And all and every Perfon or Perfons fo fued or profecuted, fhall and may plead the General Iffue, and give this Act General Iffue, and the fpecial Matter in Evidence at any Trial to be had thereupon, and that the fame was done in Pursuance and by Authority of this Act; and if it fhall appear fo to be done, or that such Action, Suit, or Information fhall be brought after the Time before limited for bringing the fame as aforefaid, or fhall be brought in any other County, City, or Place than wherein the Caufe of Action fhall arife, that then the Jury fhall find for the Defendant or Defendants; or if the Plaintiff or Plaintiffs fhall become Nonfuit, or difcontinue his, her, or their Action or Actions, after the Defendant or Defendants fhall have appeared, or if a Verdict fhall pass against the Plaintiff or Plaintiffs, or Judgment fhall be given against the Plaintiff or Plaintiffs upon Demurrer, then the Defendant or Defendants fhall recover treble Cofts, for which he or they fhall have the like Remedy for the fame as any Defendant or Defendants hath or have for Cofts of Suit in other Cafes by Law..

And be it further enacted, by the Au-Publick Act, thority aforefaid, That this A&t fhall be deemed, adjudged, and taken to be a publick Act, and shall be judicially taken Notice of as fuch, without fpecially pleading the fame..

Additional Building in the Caftle Yard.

In the Year 1780, an additional Building to the County Gaol at York was ordered by the Magiftrates to be erected under the Direction of Mr. Carr, in order to remedy many Inconveniences which the humane Mr. Howard obferved in the old Gaol. This Building confifts of feveral fpacious arched Cells for the Confinement of Felons for petty and other Offences, distinct from the more notorious Offenders; Apartments for Work-Rooms, and for the Confinement of Women and Debtors; diftinct Hofpital-Rooms for the Men and Women; and Apartments for the Clerk of Affize, County Records, &c. The Building extends in Length 105 Feet, in the Front of which there is a handsome Ionic Colonade or Loggio, fimilar to that in the Front of the Court of Justice, which is very convenient for the Prisoners to work or walk in under Cover.

In the Year 1782, the Chancel of the Church of AllSaints, Oufegate or Pavement, was taken down, and in 1783 the Eastern Wall was rebuilt, and the other Parts of it repaired and beautified, new Pews built in the West End of it in the Room of thofe that were taken from the Eaft, and a very elegant Marble Font erected in the Room of the old one. The Ground where the Chancel ftood was added to the Market-Place, and the Buildings in the Herb-Market were taken down, and the Ground given by the City to be added to the Church-Yard.
