[Sec. 133. The Congress of the United States reaffirms the authority of the Council of the District of Columbia, as authorized by the Street and Alley Closing and Acquisition Procedures Act of 1982 (D.C. code, sec. 7-421), to enact the Closing of a Portion of 8th Street, Northwest, and Public Alleys in Square 403 Act of 1984 (D.C. Law 5-148), and the Closing of a Portion of 8th Street, Northwest, and Public Alleys and Square 403 Emergency Act of 1984 (D.C. Act 5-206).]

[Sec. 134. (a) Section 906 of the Leadership in Educational Administration Development Act of 1984 (20 U.S.C. 4206) is amended

(1) by striking out "and" after the semicolon at the end of paragraph (4); (2) by striking out the period at the end of paragraph (5) and inserting in lieu thereof "; and"; and

(3) by adding at the end thereof the following new paragraph:

"(6) the term 'State' includes the 50 States and the District of Columbia.”. (b) The amendments made by subsection (a) shall be effective as though they had been included in section 906 of the Leadership in Educational Administration Development Act of 1984 at the time of its enactment.]

[GENERAL PROVISIONS]

[Sec. 201. Notwithstanding any other provision of law, appropriations made and authority granted pursuant to this title shall be deemed to be available for the fiscal year ending September 30, 1986.]

This Act may be cited as the "District of Columbia Appropriations Act, [1987] 1988"'.

EXPLANATION OF LANGUAGE CHANGES

[FISCAL YEAR 1987 APPROPRIATIONS]

Explanation: Deletes Title 1 and Fiscal Year 1987 appropriation because they relate to FY 1987 only.

FEDERAL PAYMENT TO THE DISTRICT OF COLUMBIA

Deletes 2. [1987, $444,500,000: Provided, That none of these funds shall be made available to the District of Columbia until the number of full-time uniformed officers in permanent positions in the Metropolitan Police Department is at least 3,880, excluding any such officer appointed after August 19, 1982, under qualification standards other than those in effect on such date]. Explanation: The District has been and will continue to be in compliance with the provision to maintain the average authorized strength of 3880 uniform officers; therefore the language is no longer necessary.

New

3. 1988, $425,000,000, as authorized by the District of Columbia Self-Government and Governmental Reorganization Act, Public Law 93-198, as amended (D. C. Code 47-3406).

Explanation: Appropriates the authorized level of the Federal
Payment instead of the $444.5 million appropriated by the
Congress in FY 1987.

Deletes 4. [FEDERAL PAYMENT FOR WATER AND SEWER SERVICES]

[For payment to the District of Columbia for the fiscal year
ending September 30, 1987, in lieu of reimbursement for charges
for water and water services and sanitary sewer services
furnished to facilities of the United States Government,
$28,810,000, as authorized by the Act of May 18, 1954, as
amended (D.C. Code, secs. 43-1552 and 43-1612)].

Explanation: The President deleted the lump-sum federal payment for water and sewer services and proposes that the individual Federal agencies reimburse the District directly for these services. This is contrary to the existing law, D.C. Public Works Act of 1954, as amended which requires that the amount for water and sewer services be included annually in the budget estimates of the Mayor and that the amount be appropriated annually to the District. Also there is no statutory authority to permit the District to bill or accept payments directly from the federal agencies.

Deletes 5. [FEDERAL CONTRIBUTION TO RETIREMENT FUNDS]

Explanation: The President deleted the separate account
approved by the Congress in the FY 1987 Appropriations Act which
was established in order to directly apportion any reductions
triggered under the Balanced Budget and Emergency Deficit
Control Act of 1985 (P.L. 99-177).

Deletes 6. [TRANSITIONAL PAYMENT FOR SAINT ELIZABETHS HOSPITAL]

Explanation: The President deleted the separate account established by the Congress in the FY 1987 Appropriations Act which was established in order to directly apportion any reductions triggered under the Balanced Budget and Emergency Deficit Control Act of 1985 (P.L. 99-177).

Deletes 7. [CRIMINAL JUSTICE INITIATIVE]

New

[For the design and construction of a prison within the District
of Columbia, $20,000,000, to become available on October 1, 1987
together with funds previously appropriated under this head for
the fiscal year ending September 30, 1986 and September 30,
1987: Provided, That the District of Columbia shall award a
design and construction contract on or before October 15, 1986:
Provided further, That the District of Columbia is directed to
proceed with the design and construction of a prison facility
within the District of Columbia without respect to the
availability of Federal funds: Provided further, That a plan
that includes the construcction of not less than a 700 bed,
medium security facility on the South part of Square E-1112 as
recorded in Subdivision Book 140, Page 199 in the Office of the
Surveyor of the District of Columbia is hereby approved:
Provided further, That this approval shall satisfy the
provisions as set forth in the first proviso under the heading
"Criminal Justice Initiative" in H.R. 3067 as enacted by
reference in section 101(c) of Public Law 99-190, approved
December 19, 1985: Provided further, That the $50,000,000
herein and heretofore made available for the prison project].

8. The $50,000,000 previously appropriated under "Criminal Justice
Initiative" for the fiscal years ending September 30, 1986,
September 30, 1987, and September 30, 1988 for the design and
construction of a prison within the District of Columbia shall
remain in the United States Treasury and shall be transferred to
the District of Columbia government only to the extent that
outstanding obligations are due and payable to entities other
than agencies and organizations of the District of Columbia
government, and payments to such agencies and organizations may
be made only in reimbursement for amounts actually expended in
furtherance of the design and construction of the prison.
