Explanation: Deletes the exceptions for the use of
Federal funds to perform abortions.

45. [Sec. 121. None of the funds appropriated in this Act may be used for the implementation of a personnel lottery with respect to the hiring of fire fighters or police officers].

Explanation: Deletes provision relating to the

implementation of a personnel lottery for hiring fire fighters or police officers as it is no longer relevant. There is no longer a need to hire a large number of police officers and fire fighters.

46. [Sec. 127. None of the funds appropriated by this Act may be used to transport any output of the municipal waste system of the District of Columbia for disposal at any public or private landfill located in any State, excepting currently utilized landfills in Maryland and Virginia, until the appropriate State agency has issued the required permits].

Explanation: Deletes provision prohibiting the of use of appropriated funds to transport waste outside of

currently used landfills until appropriate State agency has issued permits as it relates to the FY 1987 only.

47. [Sec. 129 (a) Section 131 of the District of Columbia Appropriation Act, 1986 (H.R. 3067 as enacted by reference in section 101(c) of Public Law 99-190), is amended

(1) by inserting "or leased after "owned" in
subsection (a); and

(2) by inserting before the period at the end of subsection (b)(3) the following: ", and includes any tax imposed with respect to the use or rental of a motor vehicle and levied on, with respect to, or measured by the sales price or market value of the vehicle or the gross proceeds from the rental".

(b) The amendments made by subsection (a) shall apply to all taxable periods described in section 131(c) of such Act].

Explanation: Deletes this provision as it relates to the
Congress and has absolutely nothing to do with the
District of Columbia government.

48. Sec. 126 No later than 30 days after the end of the first quarter of fiscal year [1987] 1988, the Mayor of the District of Columbia shall submit to the Council of the District of Columbia the new fiscal year [1987] 1988 revenue estimates as of the end of the first quarter of fiscal year [1987] 1988. [: Provided, That] These estimates shall be used in the fiscal year [1988] 1989 annual budget request [:]. [Provided further, That] The officially revised estimates at midyear shall be used for the midyear report.

Explanation: Technical adjustment to conform to the drafting style of the Council of the District of Columbia. 49. Sec. 127. Supplemental budget requests to this Act that relate to more than 1 appropriation title shall not be submitted by the Mayor of the District of Columbia to the Council of the District of Columbia less than 60 days prior to the scheduled start of the summer recess of the Council of the District of Columbia.

Explanation: Language requires the Mayor to submit the supplemental budget to the Council of the District of Columbia not less than 60 days prior to the start of the summer recess.

50. Sec. 129. The Council of the District of Columbia
recommends that the amount of the federal payment for the
fiscal year ending September 30, 1988, be restored from
$425,000,000 to $444,500,000 with the $19,500,000
increase to be dedicated solely to repayment of the
general fund deficit.

Explanation: The Council of the District of Columbia
recommends that the Federal payment be increased to
$444.5 million, the amount appropriated by Congress in FY
1987. The $19.5 increase over FY 1987 is to be used
exclusively for the general fund deficit.

51. [Sec. 132. The District of Columbia shall construct three signs which contain the words, "Sakharov Plaza". These signs shall be placed immediately above existing signs on the corners of 16th and L and 16th and M Streets, Northwest. These should be similar to signs used by the city to designate the location of Metro stations. In addition, a sign shall be placed on city property directly adjacent to, or directly in front of, 1125 16th Street designating the actual location of Andrei Sakharov Plaza. Hereafter the proper address of the Soviet Embassy in Washington, District of Columbia, shall be No. 1 Andrei Sakharov Plaza].

52. [Sec. 133. The Congress of the United States Reaffirms
the authority of the Council of the District of Columbia,
as authorized by the Street and Alley Closing and
Acquisition Procedures Act of 1982 (D. C. Code, sec.
7-421), to enact the Closing of a Portion of 8th Street,
Northwest, and Public Alleys in Square 403 Act of 1984
(D. C. Law 5-148), and the Closing of a Portion of 8th
Street, Northwest, and Public Alleys and Square 403
Emergency Act of 1984 (D. C. Act 5-206).

Explanation: Language is no longer necessary as street and public alleys have been closed.

53. [Sec. 134. (a) Section 906 of the Leadership in

Educational Administration Development Act of 1984 (20
U.S.C. 4206) is amended -

(1) by striking out "and" after the semicolon at the end
of paragraph (4);

(2) by striking out the perfod at the end of paragraph
(5) and inserting in lieu therof "; and "; and
(3) by adding at the end thereof the following new
paragraph:

"(6) the term 'State' includes the 50 States and the
District of Columbia."

(b) The amendments made by subsection (a) shall be effective as though they had been included in section 906 of the Leadership in Educational Administration Development Act of 1984 at the time of its enactment.]

54. [TITLE II

FISCAL YEAR 1986 SUPPLEMENTAL

DISTRICT OF COLUMBIA FUNDS]

Explanation: Language related to FY 1987 supplemental.

Ms. MARSHALL. Thank you, Mr. Chairman, and members of the Subcommittee. The fiscal year 1988 Appropriations Act contains 54 changes. Of this total, 10 represent new items, 34 represent deleted items, and 10 represent technical adjustments. I would like to briefly highlight some in each category.

NEW ITEMS IN FY 1988 APPROPRIATIONS ACT

Among the 10 new items is the appropriation of the Federal payment at $425 million, the amount authorized, instead of the $444.5 million that was appropriated by Congress in fiscal year 1987.

There is also authority to carry over funding for the Tenant Assistance Program and make those funds available until expended. Also included in that language is the 15 percent set aside for a program of single room occupancy.

LANGUAGE CHANGES MADE BY OMB

Mr. DIXON. Excuse me, Ms. Marshall, and let me try to make some sense out of this. Some of these language changes that you are testifying to have come up from the Federal Office of Management and Budget.

Ms. MARSHALL. Yes.

Mr. DIXON. And not from the District.

Ms. MARSHALL. The first one that I mentioned was included in the President's budget. What I am presenting to you today is our total Appropriations Act, which includes the Federal funds portion.

CHANGES IN THE FEDERAL PAYMENT LANGUAGE

Mr. DIXON. Item number 2 is the one that deals with the Federal payment.

Ms. MARSHALL. Yes.

Mr. DIXON. Last year it was $444.5 million?

Ms. MARSHALL. Yes.

Mr. DIXON. This year it is $425 million or $19.5 million less. Ms. MARSHALL. The $19.5 million was not authorized last year. Mr. DIXON. Right.

Ms. MARSHALL. It was appropriated by the Subcommittees and ultimately the Congress. Each year we get what is called a "pass back" from OMB. This year the pass back was at the authorized level of $425 million, or $19.5 million below the FY 1987 level.

Mr. DIXON. Right. Last year the Senate put the $19.5 million in and we agreed to it in conference.

Ms. MARSHALL. Yes, and allocated expenditure of the $19.5 million.

DELETION OF LANGUAGE REGARDING WATER AND SEWER PAYMENT

Mr. DIXON. Number 4 is the issue of the Federal water and sewer payment?

Mr. DIXON. This year OMB is saying bill each agency?

Ms. MARSHALL. Yes.

Mr. DIXON. And this year the District has estimated the bill to be $40,132,100?

Ms. MARSHALL. Yes.

Mr. DIXON. The budget request is asking that this lump sum payment be deleted but it is not the District that is asking for this deletion, it is OMB?

Ms. MARSHALL. Right. The Mayor is asking that the lump sum be appropriated until such time as the law is changed.

Mr. DIXON. Right. I just wanted to clear that up.

OTHER NEW LANGUAGE ITEMS IN FY 1988

Ms. MARSHALL. Okay.

Some of the changes that are in the District's portion of the Appropriations Act, as I mentioned, include the Tenant Assistance Program. The other is a requirement that the Mayor include funding in a fiscal year 1988 supplemental, for a pay raise for the Board of Education employees. That was based on an agreement with the Board of Education and the Mayor when they were negotiating the FY 1988 funding level for the Board of Education.

Also, in our Act you will see a new appropriation title called "Financing and Other Uses." Under that title we consolidated the Washington Convention Center, the Repayment of Loans and Interest, the Repayment of the General Fund Deficit and Short-Term Borrowing.

Authority is also requested to allow the Board of Education to implement the asbestos abatement and removal of capital programs approved in fiscal years 1986 and 1987.

As you know, the Department of Public Works implements the capital projects for the D.C. Public Schools, but there has been an agreement to extend that authority to the Public School System. We have provided the language in the Appropriations Act to accomplish this.

The next one is to allow lottery sales in certain areas of the Federal Enclave. The Lottery Board discussed this earlier at their hearing. We would hope that the Committee members would support this language as well as support language to allow lottery sales in certain areas of Georgetown.

The other new item is one that the Council put in requiring that the Mayor submit supplement budgets to the council 60 days prior to its recess. We are going to be in compliance with that this year. Our FY 1987 supplemental will be sent to the council on May 15th. Mr. DIXON. No controversy between the Mayor and City Council? Ms. MARSHALL. No.

Mr. DIXON. Okay.

ITEMS REQUESTED TO BE DELETED

Ms. MARSHALL. There were 34 items deleted in our Appropriations Act. There were deletions made by the Office of Management and Budget and the City Council. There were language items that were no longer required because they relate to fiscal year 1987 only, language items that restrict the use of appropriated funds and language items that bear no relationship to the District gov

ernment.
