on the face of the said Transfer Certificate of Title No. T-269703, there appears an annotation relating to Section 7 of R.A. 26 which was derived from Transfer Certificate of Title No. RT-40503 reconstituted administratively on February 28, 1994 as can be gleaned from the Certification (Annex D) dated September 27, 2011 checked and verified by Jocelyn R. Adriano and Nenita Guinto Macapagal, Records Officer, Registry of Deeds of Bulacan; likewise embodied in the certification is the statement to the effect, thus: "the two-year lien provided under Section 7 of Republic Act No. 26 annotated at the back of TCT No. T260703 has already expired on February 28, 1996 without anybody laying claim or interest thereon", since the administrative reconstitution of the previous title on February 28, 1994 from where the Transfer Certificate of Title No. T-269703 was derived or a transfer from and the lapse of the two

(2) year period under Section 7 R.A. No. 26 on February 28, 1996, no person or entity raised or made any claim of a right or interest to the property covered by said TCT No. T-269703; hence, the annotation of restriction relating to said Section 7 of R.A. No. 26 may now be accordingly cancelled; the real property covered by TCT No. T269703 and the improvements existing thereon have been declared for taxation purposes by the petitioners and the real property taxes due thereon for the year 2011 have been paid by them as evidenced by Tax Declaration No. 2006-23029-04496 (Annex C) for the land and, Tax Declaration No. 2006-23029-04569 (Annex E) for the two residential buildings and Clearance of Real Property Tax Payment (Annex F) dated October 4, 2011; petitioners had applied for a loan with UnionBank, Baliwag Branch, Baliwag, Bulacan and in the process was advised to effect the cancellation of the annotation inscribed on the subject TCT No. T-269703 which shall serve as collateral to secure the loan being sought by them with said bank, their loan application has already been approved and the real estate mortgage constituted on the property covered by the certificate of title has already been registered with the Register of Deeds of Bulacan.

Wherefore, finding the petition to be sufficient in form and substance, let the same be set for hearing on August 28, 2012 at 8:30 o'clock in the morning at which date and time all interested persons are enjoined to appear and show cause, if any, why the petition should not be granted.

Let a copy of this Order be published in two (2) consecutive issues of the Official Gazette and be posted by the Deputy Sheriff of this Court for at least thirty (30) days before the scheduled date of hearing at the

main entrance of the Provincial Capitol Building, Malolos City, Bulacan, at the Municipal Building of San Rafael, Bulacan and at the bulletin board of this Branch of Court at the expense of the petitioner.
