CHAPTER I.

JUSTICES OF THE PEACE.

Election, Qualification and Term of Office.

SECTION 1. The powers of the government of the state of California are divided by the constitution into three separate departments: the legislative, the executive and judicial. Gen. Laws, 112.

SEC. 2. The judicial power is vested in a supreme court, in district courts, in county courts, in probate courts and in justices of the peace, and in such recorders' and other inferior courts as the legislature may establish in any incorporated city or town. Gen. Laws, 173.

SEC. 3. The legislature is required to determine the number of justices of the peace to be elected in each city and township of the state. Gen. Laws, 181.

SEC. 4. In accordance with the requirements of the constitution, the legislature has provided that there shall be elected for each township, two justices of the peace, except in the city and county of San Francisco there shall be but one justice of the peace for each township. In the city of Sacramento there shall be three justices of the peace elected; in the city of Marysville, two justices of the peace; and for the city of Oakland, one justice of the peace. . Gen. SEC. 5. Justices of the peace shall be elected by the qualified electors of their respective cities or townships. Gen. Laws, 4720.
