§3.1 Purpose.

This subpart describes the central and field organization of the Federal Power Commission, including delegations of final authority and the established places at which, and methods whereby, the public may secure information or make submittals or requests. This subpart also describes the plan of organization and operation which will be observed by this Commission in discharging its lawful duties and responsibilities in the event of an armed attack upon the United States, its territories and possessions, in the event of official notification of the likelihood or imminence of such attack or at a time specified by au

thority of the President, whichever may first occur.

§3.2 Nature and responsibilities of the Commission.

The Federal Power Commission, established as an independent agency of the Federal Government by the Act of June 23, 1930 (46 Stat. 797), is responsible for: Administration and enforcement of the Federal Power Act and the Natural Gas Act; certain duties under the Flood Control Act of 1938 and subsequent Flood Control Acts, the River and Harbor Act of 1945 and subsequent River and Harbor Acts, and a number of other statutes, pertaining principally to Federal power projects; and certain functions pursuant to Executive Order 10485 (18 FR 5397, 3 CFR, 1949-1953 Comp., p. 970) relating to electric power and natural gas facilities located on the borders of the United States.

§ 3.3 Objectives.

The Commission originally was established to license non-Federal hydroelectric power projects. Through subsequent legislation, the Commission's authority has been expanded to include the regulation of electric power and natural gas in interstate commerce, the review of plans for Federal projects affecting electric power, and the approval of rates for the sale of surplus electric energy from certain Government projects.

§ 3.4 Organization.

The Commission consists of the fivemember Commission, the Chairman, the Executive Director, and the technical and administrative staff.

(a) The Commission. The members of the Commission are appointed by the President to five year terms, by and with the consent of the Senate. The Chairman is designated by the President, and a vice chairman is elected annually by the members of the Commission. Except as noted in paragraph (b) of this section, the Commission is responsible for all plans, pro

grams and actions of the agency. Any three members of the Commission constitute a quorum for the transaction of business.

(b) The Chairman. The Chairman is the chief executive officer of the agency, and is responsible for the conduct of all executive and administrative functions except those reserved to the Commission under Reorganization Plan No. 9 of 1950 (64 Stat. 1265) (3 CFR, 1949-1953 Comp., p. 1005).

(c) Executive Director. The Executive Director is responsible for the performance of executive and administrative functions delegated by the Chairman, and regulatory functions directed by the Commission.

(d) The Staff. The Commission staff consists of the following bureaus and offices. The organization and responsibilities of each are summarized herein, and are described in greater detail in the FPC Organization and Functions Manual.

(1) The Bureau of Natural Gas, responsible for providing technical staff assistance to the Commission in administering the Natural Gas Act and related Executive Orders, including the sale and transportation of natural gas in interstate commerce, and the operation of pipelines and producers engaged in interstate commerce. The Bureau consists of the Office of the Bureau Chief, the Pipeline Certificate and Curtailment Division, the Pipeline Rates Division, the Producer Division, and the Resource Evaluation and Analysis Division.

(2) The Bureau of Power, responsible for providing technical staff assistance to the Commission in carrying out the Federal Power Act, Water Resources Planning Act, and other statutes and Executive Orders pertaining to the sale and transmission of wholesale electric power in interstate commerce, the construction and operation of hydroelectric projects, water resources planning, the adequacy and reliability of the nation's bulk electric power supply, and investigations relating to electric energy. The Bureau consists of the Office of the Chief, the Rates and Corporate Regulation Division, the River Basins Division, the Power Surveys and Analyses Division,

the Licensed Projects Division, the Power Supply and Reliability Division, and regional offices located in Atlanta, Chicago, Fort Worth, New York and San Francisco.

(3) The Office of Chief Accountant, responsible for assuring that jurisdictional natural gas companies, electric utilities and licensees provide the Commission, investors and other interested parties with reliable accounting and related data. The office consists of the Office of the Chief, the Audits Division, and the Systems and Financial Reports Division.

(4) The Office of the General Counsel, responsible for providing legislative liaison and legal services to the Commission, including both representation of the Commission in the courts, before committees of the Congress, in conferences with other Federal and non-Federal agencies, and in various other public forums, and representation of the public interest in investigations by the Commission and in proceedings pending before it.

(5) The Office of the Secretary, responsible for maintenance of official Commission records; receipt, control and distribution of regulatory filings and Commission mail; issuance of formal Commission documents; preparation of Commission meeting agendas and minutes; conduct of the Commission's records management function; and performance of delegated regulatory functions on behalf of the Commission as described in § 3.5. The office consists of the Executive Secretariat; the Agenda and Minutes Division, and the Regulatory Support Services Division.

(6) The Office of Administrative Law Judges, responsible for the conduct of public hearings and disposition of related legal proceedings in assigned regulatory matters pending before the Commission, in accordance with the provisions of sections 556 and 557 of the Administrative Procedure Act and § 1.27 of this chapter.

(7) The Office of Special Assistants to the Commission, responsible for analysis of administrative hearing records and other contested actions before the Commission, as assigned,

and for the preparation of related Commission orders.

(8) The Office of Policy Analysis, responsible for providing technical studies and policy analyses of economic and environmental aspects of the Commission's regulatory and policymaking activities. The office consists of the Office of the Chief, the Econometric Analysis Division, the Economic Studies Division, the Reports and Statistical Analysis Division, and the Energy Systems Division.

(9) The Office of Administrative Operations responsible for the performance of administrative support services for the Commission and staff. The office consists of the Office of the Director, the Administrative Services Division, the Drafting Division, the Printing Division, and the Library Services Division.

(10) The Office of the Comptroller, responsible for providing financial and management analysis services to the Commission. The office consists of the Office of the Comptroller, the Management Analysis Division, and the Financial Management Division.

(11) The Office of Public Information, responsible for management of the Commission's public information program and activities.

(12) The Office of Personnel Programs, responsible for management of FPC personnel programs. The Office consists of the Office of the Director, the Personnel Operations Division, and the Employee Relations and Services Division.

(13) The Office of Regulatory Information Systems, responsible for management of the Commission's automated data processing program and the Regulatory Information System (RIS). The office consists of the Office of the Assistant Executive Director (RIS), the Systems Planning and Control Division, the Data Management Division, the Application Systems Development Division, and the Facilities Operation Division.

(14) The Oil Pipeline Board, responsible for carrying out the Commission's functions under sections 4, 6(3), 6(6), 15(7), 19a, and 20(1), 20(2), 20(3), 20(4), 20(5), 20(11) of the Interstate Commerce Act. Any reference to a
