1 the public and private sector with due regard to their fitness, 2 knowledge and experience in academic, scientific, medical, 3 legal, conservation, urban and regional planning, and informa4 tion media activities, as they relate to our industrialized con5 sumer-oriented society, and its effect upon our environment 6 and the ecologic balance.

7 (c) Members of the Council not regularly employed by 8 the Federal Government shall, while serving on the business 9 of the Council, be entitled to receive compensation at rates 10 fixed by the Secretary, but not exceeding $125 per day, in11 cluding travel time; and while so serving away from their 12 homes or regular places of business, they may be allowed 13 travel expenses, including per diem in lieu of subsistence, as 14 authorized by section 5703 of title 5 of the United States 15 Code for persons in the Government service employed 16 intermittently.

18 SEC. 105. The Secretary shall, when requested, render 19 technical assistance to local educational agencies, public and 20 private nonprofit organizations and institutions of higher 21 education in the development and implementation of programs of ecological-environmental education. Such technical 23 assistance may, among other activities, include making avail24 able to such agencies, organizations, or institutions personnel 25 of the Department of Health, Education, and Welfare or

1 other persons qualified to advise and assist the development

2 and carrying out of such education programs.

PAYMENTS

SEC. 106. Payments under this title may be made in 5 installments and in advance or by way of reimbursement,

6 with necessary adjustments on account of overpayments or 7 underpayments.

ADMINISTRATION

SEC. 107. In administering the provisions of this title, 10 the Secretary is authorized to utilize the services and facilities 11 of any agency of the Federal Government and of any other 12 public or private agency or institution in accordance with 13 appropriate agreements, and to pay for such services either 14 in advance or by way of reimbursement, as may be agreed

15 upon.

STATEMENT OF PURPOSE

SEC. 201. (a) The Congress hereby finds and declares 20 that American technology has contributed significantly to 21 the unprecedented economic and social progress of the United 22 States and its people; that technological advancement has 23 proceeded without adequate consideration of its consequences 24 upon the human environment; that industrial and techno25 logical advancement has created certain adverse effects upon

1 our environment and the ecological cycle upon which all life 2 depends; that new, independent, institutionalized organiza3 tions are needed within the Federal Government to assess on 4 a continuing basis the impact of the growth and spread of 5 various technologies upon national environmental goals and 6 resources; that decisions affecting the course of technology 7 and its long-term effects upon environment require the broad8 est possible public participation, and should not be delegated 9 solely to governmental, business, scientific, and political in10 terests; and that American technology can best promote the 11 continued economic and social advancement of the Nation, if 12 systematic assessment of the nature and effects of its develop13 ment is undertaken.

(b) It is the purpose of this title to create an advisory 15 commission to investigate, analyze, and recommend methods 16 to identify deficiencies in existing processes of assessment and

governmental decisionmaking with respect to the evolution of 18 technology and its adverse effect upon environmental quality

19 and ecological regimes.

ESTABLISHMENT OF COMMISSION

SEC. 202. There is hereby established an Advisory

Commission on Technology and the Environment (herein23 after referred to as the "Commission").

MEMBERSHIP

SEC. 203. (a) The Commission shall be composed of

26 twenty-one members to be appointed by the President from

1 the public and private sector with due regard to their fitness, 2 knowledge, and experience in scientific, medical, legal, public 3 administration, social and physical science, business, and 4 local, State, and Federal government activities. Representa5 tives of the public at large shall be included. Not more than 6 eight members shall be full-time employees of the United 7 States.

(b) Any vacancy in the Commission shall not affect its 9 powers.

(c) The President shall designate one of the members to serve as Chairman and one to serve as Vice Chairman of 12 the Commission.

(d) Eleven members of the Commission shall consti

tute a quorum.

DUTIES OF THE COMMISSION

SEC. 104. (a) The Commission shall undertake a com17 prehensive investigation and study of the present and prospective impact of technology upon the environment and the ecological cycle, and the existing governmental processes of assessment and decisionmaking with respect to the evolution of technology in the United States as it relates to environmental quality. It shall include without being limited

(1) an analysis and evaluation of particular areas

of technology by contracting with institutions of higher

learning and other private, nonprofit organizations to undertake studies of specific problems defined and selected by it, except that such problems shall involve technological developments or applications that are sponsored by the Federal Government or are otherwise affected in a direct way by Federal activity or regulation;

(2) an analysis, review, and evaluation of basic research on the subject of technological development and its impact upon the environment;

(3) a review and evaluation of specific assessments of present and future technological impact upon the environment made by Government agencies and departments, including criteria and procedures employed in the assessment process, the nature and technical adequacy of the evidence relied upon, and the representation of potentially affected interests; and

(4) an analysis and evaluation of continuing assessment systems in relevant departments and agencies of

the Federal Government and in the Congress.

(b) The Commission shall transmit to the President and

to the Congress interim reports and, not later than three years

22 after the first meeting of the Commission, one final report, 23 containing detailed statements of the findings and conclu24 sions of the Commission, together with its recommendations,
