I'm not mistaken, I think that it was July 1997.

Q.

What is Mr. Betts' job?

A. Well, he controls the financial and the

accounting part in the bank. He will be something like

the financial controller.

Q. What is his title?

A. Now it's vice-president. The executive

vice-president.

21

Q. As executive vice-president, is Mr. Betts

22

23

authorized to bind the bank? Is he authorized to make

Q. Thank you, sir.

Before we went off the record you had just

denied that in or around June of 1998, 15,000 shares of British Trade & Commerce Bank were owned by British Trade

& Commerce Bank Bancorp Trust represented by Mr. Rodolfo Requena, trustee with the beneficial interests being held

by Mr. John Long. Do you remember that testimony, sir?

[blocks in formation]

A.

Well, yes, the stock, they owned part of the

trust, but the beneficiary for the trust was not Mr. Long.

Q. Was it Mr. Long in 1998?

Q.

Not at the present time.

When was their beneficial interest in British

Trade & Commerce Bank transferred?

A. I don't have the exact date, but if I'm not

mistaken, I think that it was three months ago.

9

Q.

In or about May of the year 2000?

Probably. I'm not quite sure.

Q. How large a percentage of the ownership of

British Trade & Commerce Bank was held by the Long
children prior to May of 2000?

A. I'm not quite sure. I should see the numbers.
I think that it was 35 percent, but I am not sure.

Q. So they were the largest shareholders prior to May of the year 2000 of British Trade & Commerce Bank;

correct?

40

[blocks in formation]

Because that was placed in a trust, but Mr. Lor.g

25

was not representing that trust.

No, the bank is the owner of the stocks, the

Q. What is the current net worth of British Trade &

Commerce Bank?

A. Well, our financial statements, they reflect

like something like 200 or 300 million. I should see the

last financial statement.

Q. Do you have the financial statements of British

Trade & Commerce Bank?

A. Not with me.

Uh-huh.

Q. How much of that is in treasury stocks?

A.

When you talk about treasury stocks, are you

talking about the stocks, the bank stocks?

Q. No. Treasuries.

A. I don't know. I should see the composition

because I don't handle that directly. I should see it.

Q. What is your understanding?
