available and under active consideration for employment. If the individual is no longer available, or if he has otherwise been dropped from consideration, prompt report of that fact should be made to the office to which the request for investigation was originally submitted. Where the written inquiries were also clearly favorable, the complete results will be transmitted to the requesting installation on the CSC Form 715 referred to above.

Applicants and Emergency Appointees-Derogatory Information Disclosed

b. Where the written inquiries disclose any derogatory suitability information, the full results of the NACI will be provided on CSC Form 355 (Results of National Agency Checks and Written Inquiries under E.O. 10450 for Noncritical Sensitive Position). If the written inquiries disclose serious derogatory suitability information warranting conversion to limited investigation in a case involving a position in the competitive service, a report of that fact will be submitted on CSC Form 337A (Notice That Further Inquiry Is Necessary in a Case Involving a Noncritical-Sensitive Position). All further investigative action in the case will be suspended by the Civil Service Commission until the installation reply is received on this form. If further investigation is requested and the information developed is minor in nature, action will be taken in accordance with a above. If serious derogatory information is developed by the written inquiries, action will be in accordance with c, d, or e below.

(1) When the NAC discloses derogatory suitability information, the Civil Service Commission will furnish an advance report of that fact direct to the requesting installation on Form DI 372. Where feasible, a summary of this information will accompany the report. If the file is very lengthy, no summary will be furnished but a notice (DI 453) will be attached to the DI 372 indicating that the file will be available for review in the Commission's Central Office. If the requesting installation still desires to consider the applicant for employment, or to retain the emergency appointee, the DI

372 and DI 453 will be immediately forwarded to the Assistant Chief of Staff, Intelligence, Department of the Army, with a request that a representative review the file. Upon receipt of a report from the Assistant Chief of Staff, Intelligence, the installation will reply to the DI 372. If the installation is no longer considering the individual for employment, or if the individual is no longer available, the DI 372 will be returned indicating that fact, to the office to which the request for investigation was originally submitted.

(2) When the NAC discloses information

which requires referral to the FBI under section 8(d) of E.O. 10450, the Civil Service Commission will make such referral and, in addition, send an advance report to the requesting installation on DI 372A. A reply will be made on the form 372A within 5 days after receipt. Where the written inquiries develop information which requires referral to the FBI, the Civil Service Commission will make such referral and send a report to the requesting installation on CSC Form 337A. A reply will be made on the Form 337A within 5 days after receipt. All reports of investigations conducted by the FBI will be furnished to the Assistant Chief of Staff, Intelligence, Department of the Army, for appropriate action. Action When the Applicant Is Dropped From Consideration

c. When the installation reports to the Civil Service Commission that an applicant has been dropped from consideration, the NACI will be discontinued. In order to close out the case, the appropriate office of the Civil Service Commission will forward a report to the installation using either CSC Form 473 (Return of Applications After NACI Investigation in Cases of Persons Dropped from Consideration or Separated) or CSC Form 474 (Notice of Discontinuance of NACI Investigation and Retention of Application Regarding an Applicant). The civilian personnel officer of the installation will take prompt action to comply with the instructions on the form as to the disposition to be made of the report.

Action When the Individual Is Separated

d. When the installation reports to the Civil Service Commission that an individual was appointed and separated prior to completion of the NACI, the investigation will be discontinued. In order to close out the case, the appropriate office of the Civil Service Commission will forward a report to the installation using either CSC Form 473 or CSC Form 475 (Notice of Discontinuance of NACI Investigation and Retention of Application Regarding an Employee). The civilian personnel office of the installation will take prompt action to comply with the instructions on the form as to the disposition to be made of the report.

Action When Derogatory Information Exists for Person Appointed or Still Under Consideration

e. If the installation replies on either the CSC Form 372A or the CSC Form 337A show that the individual has been appointed or that he is still being considered for appointment, further action will be necessary to resolve the question of suitability for employment. The action taken will depend upon whether the position is in the competitive or excepted service, and whether or not the information disclosed appears to be disqualifying under the suitability standards of the Civil Service Commission.

(1) If the information in the file does not
appear to be disqualifying under the Civil
Service Commission suitability stand-
ards, the complete results of the NACI
will be transmitted to the installation by
CSC Form 355 in the case of both ex-
cepted and competitive positions.
(2) If the position is in the excepted service,

and serious derogatory information is
disclosed, the complete results of the
NACI will be furnished on CSC Form
355 transmitted by CSC Form 354 (Re-
sults of National Agency Checks and
Written Inquiries in a Case Involving an
Excepted Position in Agency with In-
vestigative Facilities). If the installa-
tion still desires to consider the applicant,
a request for such additional investiga-
tion as is necessary to resolve the question
of suitability for employment will be
submitted to the appropriate major com-
mand. In cases where the individual has

already been appointed, such additional investigations will be requested unless the investigative file available shows clearly that the individual is unsuited for continued employment.

(3) If the position is in the competitive service, and the information appears to be disqualifying, the NACI will be converted by the Civil Service Commission to a limited investigation. Upon completion of this additional investigation, if there is a favorable decision in an applicant case, the complete results will be furnished the installation with CSC Form 355. If the decision is unfavorable in an applicant case, the Civil Service Commission will notify both the individual and the installation by letter. If the individual has been appointed and the decision of the Civil Service Commission is favorable, the complete results will be furnished the installation. If the results are disqualifying, the Civil Service Commission will instruct the installation to remove the individual.

Appointees

f. Where an appointment is made to a sensitive position (noncritical) without a preappointment investigation, the reports of the NACI will be handled in accordance with paragraph 1-8. No advance NAC report will be made except where special request is made as provided in paragraph 1-7a(2), or except where the investigation will be converted to a full field investigation by the FBI.

SPECIAL PROCEDURES FOR OVERSEA COMMANDS

United States Citizens Recruited Within the

Command

1-11. a. The investigative requirements and the procedures to be followed for United States citizens recruited within an oversea command are the same as for installations in the continental United States. All forms required for initiating the NAC portion of an investigation for a sensitive (critical)

position will be routed to the Civil Service Commission, Bureau of Personnel Investigations, Division of Operations, ATTN: Control Section, Washington 25, D.C. Forms required for initiating an investigation for a nonsensitive position or sensitive position (noncritical) will be routed as indicated below:

United States Citizens Recruited Within the United States

b.(1) In order that oversea commands may be

provided with information upon which to grant interim security clearances immediately upon the arrival of an employee at his new duty station, a memorandum containing the following information will be included in the folder which the employee hand carries overseas:

"1. Favorable CSC Form DI 372A, Advance Report of Agency Check, dated CSC Serial No.

has been received. The results of the National Agency Checks and Written Inquiries under E.O. 10450 will be forwarded when completed.

2. Favorable Preappointment NAC under E.C. 10450 has been completed by the Civil Service Commission. CSC Form DI 372 dated ----, CSC Serial No. will be forwarded

under separate cover.

3. Last security investigation conducted meets the minimum requirements

of CPR 12 for assignments to

(a) Sensitive position (noncritical).

(b) Sensitive position (critical).

The existence of this memorandum is sufficient basis to justify the granting of an interim security clearance pending the the receipt of the individual's official personnel folder. As will be noted, the statement reflects security clearance or investigative data received from the personnel or other responsible official who had access to and who reviewed the individual's official folder. Such information is considered to be reliable official information and precludes the necessity for the initiation of an NAC. Inasmuch as the official personnel folder is not always available to processing stations, it must be assumed that a DA Form 873 (Certificate of Clearance and/or Security Determination Under EO 10450) is contained therein when responsible authority indicates that a security clearance has previously been granted. In those cases where item 3 of the memorandum has been checked and completed to indicate a previous clearance, and a subsequent examination of the personnel folder fails to reveal a DA Form 873, the responsible commander (pending verification of clearance status) may grant an interim clearance, an "access pending" clearance, or withhold clearance.

(2) The office to which recruitment responsibility has been assigned in accordance with CPR 01.1-4a will be responsible for the verification that the previous investigation meets the necessary requirements (CPR R2.2-16). If this verification is in the affirmative, memorandum will be prepared as indicated in (1) above, by the employing CONUS activity as indicated in CPR 01.1-6a (4). If the verification reveals that the investigative require

ments have not been met, the forms necessary to conduct the investigation will be obtained and forwarded to the appropriate area regional office of the Civil Service Commission. Upon completion of the required investigation, the employing CONUS activity will either issue the memorandum concerned and make it a

part of the selectee's file if the results were favorable, or discontinue processing if the results preclude the individual's being assigned overseas. Any additional investigative information and/or reports of investigation, will be forwarded to the oversea command as soon as available after departure of the employee.

3. Responsibilities. Initial determinations under these regulations, except as stated in paragraph 26g, are the responsibility of the local commander based upon an evaluation of the investigative record and the position and duties of the employee involved under local conditions according to the standard and criteria set forth in paragraphs 16 and 17. 5. (Superseded) Clearance of board and program personnel. All members of all boards and panels referred to in these regulations must have been the subject of a background investigation as defined in current regulations, or an equivalent investigation, with favorable results. Administrative personnel who are engaged in processing of cases under these regulations must have been granted at least a Secret clearance under appropriate regulations.

(20) (Added) Failure or refusal to sign a loyalty certificate, such as DA Form 1111 (Certificate of Nonaffiliation with Certain Organizations); pleading protection of the Fifth Amendment or of Article 31, Uniform Code of Military Jus tice, in refusing to completely answer questions contained in required security forms, personal history statements and other official documents; pleading protection of the Fifth Amendment or of Article 31, Uniform Code of Military Justice, or otherwise failing or refusing to answer any pertinent questions propounded in the course of an official investigation, interrogation, hearing, or examination, conducted for the purpose of ascertaining the existence or extent, or both, of conduct of the nature described in (1) through (19) above.
