now in Force upon Bonds given for Tobacco imported; and that if any Importer of Tobacco, who hath already given Security, or fhall before the faid Firft of June, One thousand seven hundred and fifty one, give Security for the faid Subfidy, fhall be defirous to dif charge his Bond or Bonds, or any Part thereof in Ready Money, before the Expiration of Eighteen Months from the Date thereof, he fhall be abated upon fuch Bond or Bonds, so much as the Discount at the Rate of Seven per Centum per Annum fall amount to in Proportion to the Time unexpired.

XXXII. And whereas by an Act of Parliament made in the Twelfth Year of the Reign of Her late Majesty Queen Anne (intituled, An Act for the encouraging the Tobacco Trade) it was enacted, That any Perfon importing Tobacco, that should pay down in ready Money the Subfidy of One Penny per Pound, due and payable by the Act of the Twelfth Year of the Reign of His late Majefty King Charles the Second, or by any Act or Acts continuing the fame, and fhould then defire to have the said Tobacco put into Warehouses under the Queen's and Merchants Locks, for the Security of the Remainder of the Duties, the Merchant or his Servants fhould have free Accefs into

the faid Warehouse at all seasonable Times, which faid Act was to continue in Force for Five Years, and to the End of the then next Seffion of Parliament: And whereas by an Act of Parliament and of 5 Ga. Perfons as shall inform, profecute, or fue for the fame; and that all the fame Penalties and Forfeitures fhall and may be :profecuted and fued for, and the Causes and Controverfies arifing thereupon, tried, heard, and determined in any of His Majefty's Courts of Record at Westminster (if the Offence fhall be committed in England, or if the Offender or Of fenders be in England at the Time of commencing the Profecution) or in the Court of Exchequer at Edinburgh (if the Offence fhall be committed in Scotland, or if the Offender or Offenders be in Scotland at the Time of the commencing the Profecution) at the Election of the Commiffioners of His Majesty's Cu>ftoms in that Part of the faid United Kingdom where the Offence or Offences fhall be committed, wherein no Effoin, Protection, Wager. of Law, or more than One Imparlance fhall be allowed any Law, Ufage, or Cuftom, to the contrary notwithstanding.

XXXIV. And be it further enacted by the Authority aforefaid, That if any Ac -tion or Suit fhall be commenced against any Perfon or Perfons, for any Thing done in pursuance of this Act, the Defendant or Defendants in fuch Action or General Iffue. Suit may plead the General Iffue, and give this Act, and the Special Matter in Evidence, at any Trial to be had thereupon; and that the fame was done in pursuance of and by Authority of this Act; and if it fhall appear fo to have been done, then the Jury fhall find for the Defendant or Defendants; and if the Plaintiff fhall be Nonfuited, or disconti
