AND whereas by the said Act for annexing certain parts of certain counties of cities to adjoining counties, it is provided, that if any place or precinct which, for the purposes and under the provisions of that Act, and the said Act for the regulation of Municipal Corporations in Ireland, shall not be part of such borough as therein mentioned, shall have been liable before the passing of the said Acts. to contribute to any rate which shall have been, or ought to have been, or if the said Acts had not been passed would or ought to be, made for the purpose of satisfying any lawful debt to which the rate-payers 10 of the said borough or of any county were liable to contribute before the passing of the said Acts, and in case any difference shall arise concerning the proportion of such debt which ought therefore to be paid and contributed in respect of such place or precinct, or concerning the instalments by which, or otherwise concerning the manner in 15 which, the same ought to be paid, raised, levied or apportioned, the same shall be determined by arbitration as therein mentioned: AND whereas by an award under the hand and seal of an arbitrator duly appointed in that behalf, it was determined that the proportion of the debts to which the rate-payers of the county of the city of Cork 20 were liable before the passing of the said Acts, which ought to be

paid and contributed in respect of the portion of the liberties of the city of Cork not being part of the county of the city of the borough of Cork, and the instalments by which and the manner in which the same ought to be paid, raised, levied and apportioned shall be as hereinafter 25 provided; BE it therefore Enacted, That the proportions of the said debts to be paid and contributed in respect of the portion of the said liberties, not being part of the county of the city of the said borough, shall be deemed and taken to be the sum of Two thousand One hundred and Seventy-one Pounds Two Shillings and Sixpence, being part of a 30 sum advanced out of the Consolidated Fund for the suppression of the Cholera disease in the county of the city of Cork, and the sum of Twelve thousand Pounds, being part of a sum chargeable and payable under the provisions of the said Act of the third year of the reign of King GEORGE the Fourth.

And be it Enacted, That the said sum of Two thousand One hundred and Seventy-one Pounds Two Shillings and Sixpence shall be raised and levied off the portion of the said liberties of the city of Cork, not being within the county of the said borough, by Twenty-two instalments of Ninety-eight Pounds Thirteen Shillings and Ninepence each, 40 the first of such instalments to be leviable under the warrant of the Treasurer of the county of the city of Cork in like manner as the sums to be presented by the members of the Grand Jury of the Spring Assizes of the present year shall be raised and levied off the liberties of Cork, and to be paid to the said Treasurer on or before the First day of the Summer Assizes next after the passing of this Act, and the other instalments to be respectively leviable and raised under the warrants of the

Treasurer of the county of Cork in like manner as money pesented by
the Grand Jury of the county of Cork to be raised off the portion of
the said liberties of Cork, not being within the county of the city of
the said borough, shall be raised and levied, such other instalments to
be payable at the next Spring and every succeeding Assizes for the 5
county of Cork, until the whole shall have been levied and collected,
and shall have been fully paid and satisfied; and the respective Trea-
surers of the county of the city of Cork and of the county of Cork shall
pay and apply the instalments of such sum so received by them respec-
tively to and for the purposes appointed in relation to the money 10
originally presented, and of which the said sum of Two thousand One
hundred and Seventy-one Pounds Two Shillings and Sixpence forms
part.

And be it Enacted, That after Presentments shall have been made in manner herein provided by the members of the Grand Jury of the 15 county of the city of Cork who have served at the Spring Assizes of the present year, the Treasurer of the county of the said city shall add to the sums which shall under the provisions of this Act be so presented to be raised or be otherwise leviable upon the portion of the said liberties of the city of Cork, not being within the county of 20 the city of the said borough, such sum as the interest for One half-year upon the said sum of Twelve thousand Pounds shall, at the rate of Five Pounds per centum per annum, amount unto, and also a sum of Two hundred Pounds towards the discharge of a portion of the said principal sum of Twelve thousand Pounds; and the said Treasurer 25 shall, when making the calculations for the purpose of striking the poundage for the said portion of the said liberties, take the said sums into account, and the same shall be raised and levied off the said portion of the said liberties in like manner as money presented to be raised off the said portion of the said liberties shall be raised and 30 levied; and the said sum so to be raised for interest, together with the sum of Two hundred Pounds, so to be raised as an instalment towards the discharge of the said principal sum of Twelve thousand Pounds, shall, on the Eighth day after the next Summer Assizes, or so soon afterwards as conveniently may be, be paid to the Commissioners 35 named in the said Act of the third year of the reign of King GEORGE the Fourth; and the said sum of Two hundred Pounds, so to be raised as an instalment towards the discharge of the said principal sum of Twelve thousand Pounds, shall be applied by the said Commissioners in discharge of such of the sums borrowed by them as aforesaid as 40 they shall appoint for such purpose.

28. Levy of Debt And be it Enacted, That so soon as conveniently may be after the chargeable on next Summer and every succeeding Assizes, until the whole of portion of the said sum of Twelve thousand Pounds, together with interest thereon at the rate aforesaid, shall be paid off, the Treasurer of the

county of Cork shall add to the sum which at such Assizes respectively shall be presented to be raised upon the said portion of the said liberties of the city of Cork, not being included within the boundaries of the county of the city of the said borough, such sum as One halfyear's interest on the residue of the said sum of Twelve thousand Pounds then due shall amount unto, together with Two hundred Pounds as an instalment towards the payment of the said principal money, and shall, when making his calculations for the purpose of striking the poundage for the said portion of the said liberties, 10 take the said sums into account, and the same shall from time to time be raised and levied off the said portion of the said liberties in like manner as money presented to be raised off the said portion of the said liberties shall be raised and levied; and the said respective sums so from time to time to be raised for interest and 15 towards the discharge of the said principal money shall, on the Eighth day after each succeeding Assize, or so soon afterwards as conveniently may be, be paid to the said Commissioners, and the said respective sums of Two hundred Pounds so to be raised as instalments towards the discharge of the said principal money shall be applied by the 20 said Commissioners in discharge of such of the said sums borrowed by them as aforesaid, as they the said Commissioners shall from time to time appoint, until the whole of such sums shall be paid off.

And be it Enacted, That this Act shall be deemed and taken to be a Public Act, and shall be judicially taken notice of as such by all 25 Judges, Justices and others.

And be it Enacted, That in the construction of this Act every word importing the singular number only shall extend and be applied to several persons or things as well as one person or thing, and every word importing the masculine gender shall be applied to a 30 female as well as a male, unless there be something in the subject or context repugnant to such construction respectively.

For the Improvement of Health in Towns, by removing the
Interment of the Dead from their Precincts.

HEREAS the practice of Interment under Churches, Preamblo. Chapels and other places of Religious Worship, and within the precincts of large Towns in England, is injurious to Health, and frequently offensive to public decency, and it is expedient that the 5 same should be prevented;

That it may be Enacted, And be it Enacted, by The QUEEN's most Excellent MAJESTY, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Par10 liament assembled, and by the Authority of the same, THAT from After 1'Ocand after the First day of October One thousand eight hundred and Forty- , no burial or interment of any dead body shall take place in England, in or under any Church, Chapel or other place of Religious Worship, nor in or under any house or building inhabited by any 15 person whosoever; and the executor or administrator to the estate and effects of every such deceased person, and every person who shall aid or assist in the burial of the same, contrary to this provision, shall forfeit the sum of Five Pounds: Provided always, That nothing herein contained shall, with the consent of One of Her Majesty's Principal 20 Secretaries of State, prevent the interment of the dead body of any eminent public person in any vault or grave under Westminster Abbey or Saint Paul's Cathedral.
