ORDER

A verified amended petition was filed by the petitioners through counsel praying among others that after due notice and hearing a judgment be rendered in favor of the herein petitioner ordering the Register of Deeds of Quezon City to reconstitute the original copy of TCT No. 61148 and to issue an owner's duplicate copy of TCT No. 61148 in lieu of the lost one.

The petition alleged that the petitioners are the legitimate heirs of spouses Mercedes B. Luis and Rafael D. Luis who died on February 6, 1992 at Santo Tomas University Hospital and on March 30, 1986 at Philippine Heart Center in Quezon City respectively; that petitioners are represented by Ms. Lourdes L. Puzon; that the copy of the owner's duplicate of said TCT was safe kept by Natividad B. Luiz; that when she suffered a stroke, the other siblings realized that the owner's copy was lost; that efforts to locate the said TCT but it proved futile; that the original copy of the aforesaid title with the Register of Deeds of Quezon City was destroyed on fire that razed the said office on June 11, 1998; that said property had been declared for taxation purposes, free from liens and encumbrances; that the

This is a verified second amended

petition filed by petitioners-spouses George G. Luis and Anita G. Luis, and Gloria G. Cervas pursuant to the Decision dated

December 8, 2004 in Civil Case No. Q-0351236 of Branch 220, Regional Trial Court of Quezon City for the reconstitution of Transfer Certificate of Title No. 259059 in the name of spouses Lucia V. Zayas and Anselmo G. Zayas and the issuance of owner's duplicate thereof.

The second amended petition alleges that petitioner-spouses George G. Luis and Anita G. Luis are the plaintiffs in Civil Case Nos. Q-03-51236, entitled, "Sps. Engr. George G. Luis and Anita G. Luis vs. Daniel Casabar, et. al. before Branch 220, RTC, Quezon while petitioner Gloria Cervas is also a plaintiff in Civil Case No. Q-03-51272 in the same sala, entitled, Wilma Obcemiea, Rey Banguilan, Michael Fajardo, Arceli Arceo and Gloria Cervas, et. al. vs. Elpidio Salgado, et. al.; that on December 8, 2004, a decision was rendered in said cases in favor of the plaintiffs-petitioners, which

decision was affirmed with modification by the Court of Appeals on March 28, 2008, to wit: "Wherefore, premises considered, the instant Appeal is hereby partially granted. The Decision dated December 8, 2004 of the Regional Trial Court, Branch 220, Quezon City is hereby affirmed with modification as follows: a) Appellants Precision Development Corporation and Reynaldo Victoria are absolved from liability relative to the award of damages against appellees Spouses George and Anita Luis in Civil Case No. Q-03-51236; b) Except for appellee Gloria Cervas, the award of actual or compensatory damages in favor of the other appellees in Civil Case No. Q03-51272 is hereby deleted for want of proof; and c) c) Appellant Precision Development Corporation is likewise absolved from liability for damages in Civil Case No. Q-03-51272."; that pursuant to the Order dated May 5, 2009 of Branch 220, RTC, Quezon, plaintiffs' (herein petitioners) ownership of their respective units, include, as appurtenant to their units, a common interests in the common area which includes the parcel of land on which the subject property is located; that petitioners were placed in possession of the subject property covered by TCT No. 259059, located in Road 20, corner Mindanao Avenue, Quezon City; that the owner's duplicate of said title is not in the possession of the petitioner, they being the adjudged winning parties in Civil Case Nos. Q-03-51236 and 51272 respectively; that the reconstitution of the subject title is necessary for the registration of the Notice of Levy issued by the Deputy Sheriff of Branch 220, RTC, Quezon City inasmuch as there is no records whatsoever in the vault of the Registry of Deeds of Quezon City of TCT No. 259059, said title not being included among those titles saved during the fire that razed the Quezon City Hall Building on June 11, 1988 and there being no records indicating that said title was reconstituted administratively or judicially; that the Registry of Deeds of Quezon City could not issue the required certification of its loss or destruction considering that when the technical
