PART 24-GENERAL PROVISIONS

24.2a Application of regulations relating to life preservers and fire extinguishers to barges carrying passengers towed by motorboats or motor vessels. [Added]

§ 24.2a Application of regulations relating to life preservers and fire extinguishers to barges carrying passengers towed by motorboats or motor vessels. The regulations requiring life preservers and fire extinguishers on motorboats and motor vessels shall apply to any uncertificated barge carrying passengers which is regularly operated with a motorboat or motor vessel. Where length or gross tonnage is significant in determining the application of the requirements it shall be measured by the length or gross tonnage of the barge. The placing of life preservers or fire extinguishers on the barge shall not exempt the towing or pushing motorboat or motor vessel from the regulations applicable to it. § 25.8-2 Eligibility for license.

CODIFICATION: In § 25.8-2 the phrase "local inspectors" was amended to read "Officer in Charge, Marine Inspection", by Regulation, Acting Commandant, Feb. 15, 1945, 10 F.R. 2037.

§ 25.8-3 Authority of supervising inspectors. [Revoked]

1 The former § 25.8-3 was revoked, and former §§ 25.8-4-25.8-9 were redesignated §§ 25.83-25.8-8, respectively.

CODIFICATION: By Regulation, Acting Commandant, Feb. 16, 1945, 10 F.R. 2041, § 25.8–3 was revoked and former §§ 25.8-4-25.8-9 were redesignated §§ 25.83-25.8-8.

§ 25.8-3 Professional qualifications and examination. (a) An applicant for a license as an operator shall submit a sworn application on the prescribed form to the Officer in Charge, Marine Inspection. The applicant shall be examined orally concerning his character and fitness to hold such license and a thorough inquiry shall be made into the proofs submitted concerning his character and ability. If, after the oral examination and investigation, the Officer in Charge, Marine Inspection, considers the applicant's capacity, knowledge, experience, character, and habits of life to be such as to warrant entrusting him with the duties and responsibilities involved in the operation and navigation of motorboats carrying passengers for hire, a license authorizing him to discharge such duties on any such motorboats for a term of five years shall be issued to him; except that when the applicant is the holder of a currently valid license as master, pilot, or other deck officer, a motorboat operator's license may be granted without requiring a physical or professional examination if recent service under his license can be shown, and such applicant shall not be required to surrender his license as master, pilot, or other deck officer.

(b) The examination will consist of questions on the regulations governing motorboats, the collision regulations applicable to the waters over which the applicant operates, fire protection and extinguishment, lifesaving equipment, the operation of propelling machinery, and, particularly, the safe and proper handling of gasoline motors, the proper method of operating and navigating motorboats carrying passengers, and simple first-aid. Although applicants will be examined only in the collision regulations applicable to the waters upon which they are operating, it will be incumbent upon them, should they at any time operate on waters for which the collision regulations differ, to familiarize themselves with the appropriate rules. CODIFICATION: The former § 25.8-4 was redesignated § 25.8-3, by Regulation, Acting Commandant, Feb. 16, 1945, 10 F.R. 2041, and

amended to read as set forth above. Prior to redesignation and revision, the section was amended as follows, by Regulation, Acting Commandant, Feb. 15, 1945, 10 F.R. 2037: In paragraphs (a) and (b) the words "local inspectors" were changed to the words "Officer in Charge, Marine Inspection"; in paragraph (a) the words "inspectors consider" were changed to the words "Officer in Charge, Marine Inspection considers".

§ 25.8-4 Physical qualifications.

CODIFICATION: The former § 25.8-5 was redesignated § 25.8-4, by Regulation, Acting Commandant, Feb. 16, 1945, 10 F.R. 2041. In paragraph (a) of this section, the word "inspectors" was amended to read "Officer in Charge, Marine Inspection", by Regulation, Acting Commandant, Feb. 15, 1945, 10 F.R. 2037.

§ 25.8-5 Preparation of licenses.

CODIFICATION: The former § 25.8-6 was redesignated § 25.8-5, and all of the section preceding the words "every person" was deleted and the words "every person" were amended to read "Every person," by Regulation, Acting Commandant, Feb. 16, 1945, 10 FR. 2041.

§ 25.8-6 Renewal of license.

CODIFICATION: The former § 25.8-7 was redesignated § 25.8-6, by Regulation, Acting Commandant, Feb. 16, 1945, 10 F.R. 2041, and in paragraphs (a) and (b) the word “inspectors" was amended to read "Officer in Charge, Marine Inspection", by Regulation, Acting Commandant, Feb. 15, 1945, 10 F.R. 2037.

§ 25.8-7 Lost license.

CODIFICATION: The former § 25.8-8 was redesignated § 25.8-7, by Regulation, Acting Commandant, Feb. 16, 1945, 10 F.R. 2041, and the following changes were made in paragraph (b), by Regulation, Acting Commandant, Feb. 15, 1945, 10 F.R. 2037: The phrase "an office of local inspectors, the local inspectors" was amended to read "his office, the Officer in Charge, Marine Inspection"; the words "local inspectors" were changed to "Officer in Charge, Marine Inspection"; the word "Director" was changed to "Commandant"; the words "they shall" were changed to "he shall".

§ 25.8-8 Suspension or revocation of license.

CODIFICATION: The former § 25.8-9 was redesignated § 25.8-8, by Regulation, Acting Commandant, Feb. 16, 1945, 10 F.R. 2041, and in paragraph (a) the words "local inspectors" were amended to read "Officer in Charge, Marine Inspection", by Regulation, Acting Commandant, Feb. 15, 1945, 10 F.R. 2037.

FIRE EXTINGUISHING EQUIPMENT

§ 27.3-3 Machinery spaces and tank spaces.

(c) All vessels using fuel having a flash point of 110° F. and lower and all vessels of more than 300 gross tons regardless of the flash point of the fuel used shall be fitted with an approved carbon dioxide fixed system in the machinery space. In addition all vessels using a fuel having a flash point of 110° F. and lower shall be fitted with an approved carbon dioxide fixed system in the fuel tank space.

CODIFICATION: 27.3-3 the section headnote and paragraph (c) were amended as set forth above, by Regulation, Acting Commandant, Oct. 23, 1945, 10 F.R. 13272.

INSTALLATION REQUIREMENTS FOR VESSELS USING LIQUID FUELS STORED AT ATMOSPHERIC PRESSURE AND TEMPERATURE AND HAVING FLASH POINTS OF 110° F. OR LOWER

CODIFICATION: The center heading preceding § 27.4-1 was deleted and a new heading, as set forth above, was inserted, by Regula'tion, Acting Commandant, Oct. 23, 1945, 10 F.R. 13273.

§ 27.4-1 Machinery and exhaust pipe. All installations shall be of marine type engines designed for rugged service. The following requirements shall govern all installations and be effective on new vessels or vessels converted to passenger service for the first time, construction of which is commenced on or after December 1, 1945, and to all existing vessels in so far as practicable:

(a) Drip collectors under carburetors. All carburetors, except the down ́draft type, shall have integral therewith or properly connected thereto, a drip collector of adequate capacity which shall be so arranged as to permit ready removal of fuel leakage and to prevent such leakage from reaching the bilge. Drip collectors shall be covered with flame screens.

(b) Backfire flame arrestors. All carburetors of every engine installed on all motorboats and motor vessels after April 25, 1940, shall be fitted with approved backfire flame arrestors and air intakes shall be so directed that backfire cannot blow down into the bilge.

(c) Exhaust manifold. The exhaust manifold shall either be water jacketed and cooled by discharge from a pump which operates whenever the engine is running or woodwork within 9 inches shall be protected by 8 inch asbestos board covered with not less than #22 USSG galvanized sheet iron or non-ferrous metal. A dead air space of 1/4 inch shall be left between the protecting asbestos and the wood, and a clearance of not less than 2 inches maintained between the manifold and the surface of such protection.

(d) Exhaust pipe. The exhaust pipe shall be gas tight and the installation shall comply with one of the following requirements:

(1) All of the engine cooling water shall be discharged through the exhaust pipe and this water shall enter the exhaust pipe at a point as near to the manifold as practicable.
