GREETINGS:

Whereas, a verified petition has been filed by Jose Lara, Feliza A. Lara and Myrna D. Marabella to reconstitute OCT No. 130215 covering Lot No. 9415 of the Cadastral Survey of Albay, now Legazpi City;

Whereas, it is alleged in the petition the petitioners are the actual co-owners and possessors of Lot No. 9415 of the Cadastral Survey of Albay, (now Legazpi City) having acquired the same by Deed of Extrajudicial Settlement of Partition and Sale from Rufo Londerio who likewise acquired the same by sale from Cirilo Malaca and that the original registered owners of said property are the spouses Cirilo Malaca and Dionisia Lara;

Whereas, Lot No. 9415 is covered by original Certificate of Title No. 130215 still in the name of the original registered owners the spouses Cirilo Malaca and Dionisia Lara;

Whereas, the owner's duplicate copy of Original Certificate of Title No. 130215 covering Lot No. 9415 is existing and in the possession of the petitioners, however, the corresponding file original in the Register of Deeds of Legazpi was lost or destroyed as a consequence of the last World War;

Whereas, said Original Certificate of Title No. 130215 covering Lot No. 9415 was in full force and effect at the time it was lost or destroyed and that no co-owners, mortgagees and/or lessees copies were issued and that no deeds or other documents had been executed or otherwise pending registration at the time of the loss or destruction of said Original Certificate of Title No. 130215;

Whereas, the boundary owners of Lot No. 9415 are as follows:

Whereas, it is prayed by petitioners that after notice, publication and hearing in conformity with the provisions of Republic Act 26, as amended, an Order be issued directing the Register of Deeds of Legazpi City, to reconstitute the lost Original Certificate of Title No. 130215, covering Lot No. 9415 of the Cadastral Survey of Albay (now Legazpi City) in the name of the original registered owners, Cirilo Malaca and Dionisia Lara, spouses, Filipino citizen and residents of Estanza, Legazpi City, upon payment of the corresponding fees.

Whereas, Notice is hereby given that said petition is set for hearing on January 30, 2002 at 9:00 o'clock in the morning at the Session Hall of this Court, Regional Government Center, Bulwagan ng Katarungan, Rawis, Legazpi City. Let this Notice of Hearing be published at the Official Gazette, at the expense of the petitioners, twice in successive issues at least thirty (30) days prior to the date of the hearing and also let copies of this Notice be posted in the Bulletin Boards of this Court, at the main entrance of the Provincial Capitol of Albay and City Hall of Legazpi City.

Whereas, a verified petition has been filed by the petitioner praying for the reconstitution of the lost Original Certificate of Title No. 35700 covered by Lot No. 2186 of the Cadastral Survey of Ligao, Albay (now Ligao City) in the name of the original registered owners, Spouses Celedonio Reyes and Maria Conmigo, pursuant to the provision of Republic Act No. 26, as amended, alleging among others, that the original copy and the owners duplicate copy of Original Certificate of title No. 35700 kept in

the custody of the Registry of Deeds of Albay were lost or destroyed as a consequence of World War II. Said parcel of land is hereunder described as follows:

"A parcel of land (Lot No. 2186 of the Cadastral Survey of Ligao), with the improvements thereon, situated in the Poblacion, Municipality of Ligao. Bounded on the NE. by Lot 2187 owned by Vedasto Ferer rep. by Gaudy Flores of Sorsogon City; on the SE. by San Jose St., represented the Provincial Engineer, Salugan, Camalig, Albay; on the SW. by Lot No. 2191 owned by the Heirs of Dr. Simeon del Rosario rep. by Lanny del Rosario, Don Jose St., Dunao, Ligao City; and on the NW. by Lot No. 2190-C2 owned by Ruben Quililan, Centro, Ligao City. * * containing an are of Five Hundred Nineteen (519) square meters, more or less."

Whereas, Notice is hereby given that the petition is set for initial hearing on January 24, 2002 at 8:30 in the morning at the Session Hall of this Court at which place, date and time, all interested persons are hereby cited to appear and show cause, it they have any, why said petition should not be granted.

Binalbagan Cadastre, on the basis of Decree No. 84527, a Certified True Copy of which was issued by the Office of the Clerk of Court of the Regional Trial Court of Bacolod City marked as Annex "D"; that petitioner alleges that she is the vendee of the above-numbered parcel of land which is more particularly described as follows:

"A parcel of land (Lot No. 403 of the Cadastral Survey of Binalbagan), with all buildings and improvements hereon, except those herein expressly noted as belonging to other persons, situated in the Municipality of Binalbagan. Bounded on the NE., by Lot No. 405; on the SE., by Lot No. 402; on the SW., by Calle Jasmin; and on the NW., by Lot Nos. 404 and 405. Containing an area of One Hundred Ninety-One (191) Square Meters, more or less."

That the petitioner acquired this parcel of land from Regalado Tubang as evidenced by a Deed of Sale marked as Annex "A"; and that Regalado Tubang acquired this parcel of land by virtue of the Declaration of Heirship and Sale executed by Estelita Matinong, the only heir of the registered owners, Spouses Agustin Matinong and Marion Sabillaga, copy of said original of the Original Certificate of Title No. document is marked as Annex “B”; that the

14863 kept in the file of the Office of the Register of Deeds for the Province of Negros Occidental covering Lot No. 403 was lost or destroyed during the war as evidenced by a Certification issued by the Office of the Register of Deeds of Negros Occidental, a copy of said document is marked as Annex "C"; that the above-mentioned lost certificate of title is free from all liens and encumbrances except that encumbrance relative to Sections 17 and 18 of Act No. 2259, as amended;

That the name and addresses of the adjoining owners of this Lot No. 403, Binalbagan Cadastre, are as follows:

Please take notice that the petition filed with this Court by the petitioner, Amado G. Corpus, Sr., over a certain parcel of land described in OCT No. 3752 of the Land Records of the Register of Deeds of Nueva Ecija, North Talavera, Nueva Ecija, covering a parcel of

Himamaylan City, Negros Occidental, August residential land, Lot No. 9 situated at Cuyapo,

Nueva Ecija, seeking the judicial reconstitution of said title which based on the certification issued by the Register of Deeds was not on their file and could not be located despite diligent efforts, exerted by the records personnel, pursuant to LRC Circular No. 35 in relation to Section 2 and 3 A to F of Republic Act No. 26 and P.D. No. 1529 and issuance of a second owner's duplicate copy of the same is set for hearing on February 5, 2002 at 8:30 a.m.

Your are hereby notified to appear at the date, time and place of hearing at the Regional Trial Court, Branch 31, Guimba, Nueva Ecija, and to show cause, if any there be, why said petition should not be granted.
