1 (3) of this subsection. Such annuity shall begin on the first 2 day of the month in which such wife or husband dies or 3 remarries, and such annuity or any right thereto shall termi4 nate (A) upon restoration of the annuity of a remarried wife

or husband whose remarriage was later terminated, or (B)

as provided in paragraph (7) of this subsection. Upon the 7 death of the surviving wife or husband of any member whose 8 death was other than as provided in paragraph (1) of this 9 subsection, or of any former member, or termination of the 10 annuity of a child or student-child, the annuity of any other 11 child, student-child, or children shall be recomputed and paid

as though such wife, husband, child, or student-child had not 13 survived the member or former member.

"(9) Any member retiring under subsection (f), (g), 15 or (h) of this section, may, at the time of such retirement, 16 elect to receive a reduced annuity in lieu of the full annuity, 17 and designate in writing the person to receive an increased 18 annuity after the retired annuitant's death: Provided, That 19 the person so designated be the surviving spouse or child of 20 the retiring member. Whenever such an election is made, the 21 annuity of the designee shall be increased by an amount equal 22 to the amount by which the annuity of such retiring member 23 is reduced. The annuity payable to the member making such 24 election shall be reduced by 10 per centum of the annuity 25 computed as provided in subsection (f), (g), or (h). Such

1 increase in annuity payable to the designee shall be reduced 2 by 5 per centum for each full five years the designee is 3 younger than the retiring member, but such total reduction 4 shall not exceed 40 per centum. The increase in annuity pay5 able to the designee pursuant to this paragraph (9) shall be 6 paid in addition to the annuity provided for such designee 7 pursuant to paragraph (2), (4), or (8) of this subsection 8 and shall be subject to the same limitations as to duration and 9 other conditions as the annuity paid pursuant to paragraphs 10 (2), (4), (7), and (8) of this subsection. If, at any time 11 after such former member's retirement, the designee dies, 12 and is survived by such former member, the annuity payable 13 to such former member shall be increased to the amount 14 computed as provided in subsection (f), (g), or (h).

"(10) Each person entitled to benefits computed in 16 accordance with the provisions of this subsection shall be 17 entitled to receive, without making application therefor, with 18 respect to each increase in the salary upon which such bene19 fits were computed hereafter granted by law, an increase 20 in his relief or annuity. Such increase shall be in an amount 21 which bears the same ratio to such relief of annuity in effect 22 on the day next preceding such salary increase as such 23 salary increase bore to such salary in effect on the day next 24 preceding such salary increase. Each increase in relief or 25 annuity under this paragraph (10) resulting from a salary

increase shall take effect as of the 1st day of the first month

2 following the effective date of such salary increase."

4 Firemen's Retirement and Disability Act Amendments of 5 1969".

AN ACT

To provide that the widow of a retired officer or member of the Metropolitan Police Department or the Fire Department of the District of Columbia who married such officer or member after his retirement may qualify for survivor benefits.

Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That (a) subsection (a) (3) of the Policemen and Fire

4 men's Retirement and Disability Act (D.C. Code, sec. 45 521 (3)) is amended to read as follows:

"(3) The term 'widow' means the surviving wife of a

7 member or former member if

"(A) she was married to such member or former

member (i) while he was a member, or (ii) for at least

two years immediately preceding his death, or

"(B) she is the mother of issue by such marriage."

(b) The amendment made by this Act shall apply with 5 respect to any surviving wife of a "member" (as that term 6 is defined in subsection (a) (1) of the Policemen and Fire7 men's Retirement and Disability Act) or former member 8 irrespective of whether such wife became a "widow" (as 9 that term is defined in such amendment) prior to, on, or 10 after the date of the enactment of this Act, except that no 11 annuity shall be paid by reason of the amendment made by 12, this Act for any period prior to the first day of the first pay 13 period beginning on or after July 1, 1969.
