Finding the petition to be sufficient in form and substance, the Court resets the petition for hearing on June 19, 2013 at 8:30 a.m., at the Session Hall of Branch 7 of this Court, at which time and place all interested persons may appear and show cause why the petition should not be granted.

Whereas, a verified Petition was filed on January 4, 2013 by MA. PAZ BUQUING of legal age, married, Filipino and resident of Buhang Hamtic, Antique, and VIOLETA SUMUGAT, also of legal age, widow, Filipino and resident of Buhang Hamtic, Antique, represented by the Ma. Paz Buquing as her Attorney-in-Fact, seeking for the cancellation of Decree No. 701555 issued for Lot No. 5488 of the San Jose Cadastre, and issuance of a new decree and the corresponding original certificate of title thereto, alleging among others that originally, Lot 5488 was decreed as conjugal property of spouses Julio and Dolores Moscoso as shown by a certified copy of Decree No. 701555 (Annex "D"). Petitioners became the lawful co-owners and actual possessors of Lot No. 5488 after having purchased the said lot in a public auction sale on October 19, 2004. They believe that a certificate of title has been generated in view of the existing decree, however, upon query with the Registry of Deeds whether a title has been issued for Lot No. 5488, said office issued a Certification (Annex "E") that it has no record of an original certificate of title or transfer certificate of title issued for Lot 5488. Diligent search and queries from the previous owner and heirs of Lot 5488, regarding any certificate of title for the said lot, likewise proved futile. Hence, petitioners opted to file the instant petition.

Lot No. 5488 is more particularly described and bounded as follows:

"A Parcel of Land (Lot No. 5488, of the Cadastral Survey of San Jose), situated in the Barrio of Buhang, Municipality of San Jose. Bounded on the NE., by Lots Nos. 5489, 7697, 7008 and 7007; on the SE., by the Old Spanish Road; on the SW., by Lot No. 7010. And on the NW., by the Provincial Road. Lots Nos. 7008 and 5492, containing an area of Twenty Six Thousand One Hundred Eight (26,108) square meters more or less."

Petitioners pray that after due notice and hearing, Decree No. 701555 previously issued for Lot 5488 be cancelled and a new decree for the said lot be instead issued, and corresponding thereto, the Land Registration Authority be ordered to cause the issuance of the Original Certiticate of Title in the names of the owners mentioned in the decree and forthwith, to transmit the same to the Registry of Deeds for the province of Antique.

It appears that the Petition is sufficient in form and substance, it is hereby set for initial hearing on June 25, 2013 at 9:00 o'clock in the morning, before this court sitting at the Justice Calixto O. Zaldivar Hall of Justice, Binirayan Hills, San Jose, Antique, and anybody having ineterest thereon, or may be adversely affected thereby, may appear and show cause why said petition should not be granted.

The Land Registration Authority and the Registrar of Deeds for the province of Antique may file their comment and/or Opposition thereto, and the same must be received by the court at least three (3) days before the aforementioned date and time of hearing.

Let copies of this Notice of Hearing be posted on the bulletin boards located at the main entrance of the municipal buildings of Hamtic, Antique, of San Jose, Antique, the Provincial Capitol of Antique and of this court. Also, let a copy of the same be published twice or in two (2) consecutive issues of the Official Gazette, all at the expense of the petitioners.

In the instant verified amended petition for reconstitution and issuance of owner's duplicate copy, the petitioner, alleges that he is the appointed Attorney-in-Fact of the heirs of the deceased Spouses Agapito Silva and Rosa Javier who are the registered owners of a parcel of land covered by OCT No. T-13007 of the Registry of Deeds of Bulacan. The original of the said Certificate of Title is on file with the Office of the Register of Deeds. However on March 7, 1987, said Office was gutted down by fire and the said Certificate of Title was among those burned. Upon the death of the registered owners, the heirs executed on Extra Judicial Settlement of Estate for purpose of transferring the ownership thereof. They started, looking for the duplicate owner's copy thereof and avail. Thus, an Affidavit of Loss was executed to attest to the fact of loss of title.

WHEREFORE, finding the amended petition to be sufficient in form and substance, let the same be set for hearing on June 10, 2013, at 8:30 o'clock in the morning before this Court located at the Bulwagan ng Katarungan, Capitol Compound, Guinhawa, Malolos City, Bulacan at which date, time and place, all interested persons are hereby required to

appear and show cause, if any, why the petition should not be granted.

Let copy of this Order be published at the expense of the petitioner, twice in successive issues of the Official Gazette. Let also copy thereof be posted at the main entrance of the Provincial Capitol of Bulacan, City of Malolos, Bulacan and at the City Hall of Malolos, Bulacan, at least thirty (30) days prior to the date of hearing.

Let copies of this Order be sent to the Solicitor General, Land Registration Authority, the Bureau of Lands, the Register of Deeds of Bulacan, Guiguinto Branch, the Provincial Prosecutor of Bulacan, and the owners of the properties adjoining the subject parcels of land.

The petitioner is directed to furnish the above-named agencies with a copy of the petition together with its annexes and to submit proof of its compliance within five (5) days from receipt of this Order.

Finally, the petitioner is directed to secure the corresponding Report from the Land Registration Authority relative to the instant petition which should be made available during the presentation of petitioner's evidence.

ORDER

This is a verified petition for the reconstitution of the original copy and issuance of second owner's duplicate copy of OCT No. 87011 of the Registry of Deeds of Bulacan filed by petitioners Herminia Pablo, Filipina P. Santos, Enrico P. Santos and Pacita P. Santos through counsel Atty. Roldan E. Villacorta on November 16, 2012 and received by this Court on November 19, 2012, praying that after due notice and hearing, an order/decision be issued/ rendered, directing the Registry of Deeds of Bulacan (Guiguinto, Bulacan Branch) to order the reconstitution of Transfer Certificate of Title No. T-87011 and to order the issuance of second owner's copy of the

(2) they inherited the said property from Bienvenido Santos, the registered owner thereof as evidenced by a Deed of Extrajudicial Settlement of Estate executed by the petitioners on March 22, 2012; (3) the parcel of land embraced by the subject title is likewise covered by Tax Declaration No. 2006-22049-00324, issued by the Office of the Municipal Assessor of San Miguel Bulacan; (4) the real estate tax due the subject property for the previous and current years are already paid per Official Receipt No. 7351861 dated March 8, 2012 issued by the Office of the Municipal Treasurer of San Miguel, Bulacan, (5) the original copy of the aforesaid title on file with the Registry of Deeds of Guiguinto, Bulacan was destroyed and/or burned when the said office was razed to the ground on March 7, 1987 by fire per Certification issued by the said office; (6) the owner's duplicate copy of the said title which is used to be kept in possession and custody of herein petitioner Filipina P. Santos has been missing since 1987, and could no longer be located despite repeated, diligent and earnest efforts to locate it when the residential house of the said petitioner was burned on November 14, 1987; (7) no deed or instrument affecting the parcel of land described therein has been presented or is pending registration in the Office of the Register of Deeds of Guiguinto, Bulacan and that the aforesaid owner's duplicate copy of the said title was not delivered to any person or institution to secure the fulfillment of an obligation; (8) the original copy of the title is in full force and effect at the time of the Office of the Registry of Deeds was gutted by fire and the same is true with the owner's duplicate copy of the said title when it was lost or destroyed; the owners and their respective addresses of the lots adjoining the lot covered by the said title are the following:
