A verified petition was filed by the petitioner through counsel praying among others that after due notice and hearing a judgment be rendered in favor of the herein petitioner ordering the Register of Deeds of Quezon City to reconstitute the original copy of TCT No. 245033 and to issue an owner's duplicate copy of TCT No. 245033 in lieu of the lost one.

The petition alleged that the petitioner is one of the registered co-owners of the parcel of land located at Lot 24, Block 15 Brgy. Ugong Norte, Quezon City; that the petitioner purchased the said property to Sunvar Realty Development Corporation as shown by a Deed of Absolute Sale dated April 18, 1983; that the original copy of the aforesaid title with the Register of Deeds of Quezon City was destroyed on fire that razed the said office on June 11, 1998; that the owner's copy was lost turned over to their family lawyer, Atty. Lincoln Tan and the latter left for abroad in 2005 for an indefinite period of time and the petitioner can no longer contact Atty. Lincoln Tan; that petitioner exerted an effort to contact the whereabouts of Atty. Lincoln Tan but to no avail; that said property had been declared for taxation purposes, free from liens and encumbrances; that the owner's duplicate copy had never been sold, mortgaged or delivered to anybody to answer for any obligation; that there is no deed or other instrument for registration which affect the possession or ownership of this subject property.
