AMENDED ORDER

This is a verified petition filed by the petitioner, praying this Court that after due notice, publication and hearing, an Order be issued directing the Register of Deeds of this province to reconstitute the original copy of OCT No. P-3144 covering a parcel of land situated in Puerto Galera, Oriental Mindoro with an area of 15,464 square meters, registered in the name of Delfin Contreras married to Fabiana Abante, situated at Barangay Sinandigan, Puerto Galera, Oriental Mindoro, on the basis of the existing owner's duplicate copy thereof.

Finding the said petition to be sufficient in form and substance, let the initial hearing of the above-entitled petition be set on February 21, 2013 at eight thirty in the morning in the session hall of this Court sitting at the Hall of Justice, Provincial Capitol Complex, Camilmil, Calapan City, at which time and place all persons interested in opposing said petition should appear and explain why the said petition should not be granted.

Accordingly, pursuant to Section 13 of R.A. No. 26, as amended, let this Order be published at the expense of the petitioner,

ORDER

In the verified petition filed on 08 June 2012, petitioner, through counsel, Office of the Air Judge Advocate by Atty. Roper John B. Estepa with collaborating counsel, Endona, Rueda and Pama Law Office by Attys. Gener C. Endona and Ryan T. Rueda, prays that after due notice, publication and hearing, the Land Registration Authority be

ordered to reconstitute Transfer Certificates of Title Nos. 8708, 8710 and 13630, with corresponding owner's duplicates thereof and to transmit the same to the Register of Deeds of the Province of Pampanga for registration and issuance to the petitioner and that the Register of Deeds of Pampanga be ordered to register the issued reconstituted titles and to release the owner's duplicates thereof to the petitioner and have the original titles filed in the vault of titles of said registry.

The petitioner alleges that the Philippine Government had expropriated several lots in Floridablanca, Pampanga by virtue of Orders of Expropriation dated 18 May 1956 and 15 August 1974 issued correspondingly in Special Proceedings Nos. G.R. No. L6594 and G.R. No. L- 20620, the same to be utilized particularly by the Philippine Air Force and now identified as the Basa Air Base; that by virtue of the Expropriation Orders, petitioner occupied the properties and developed the same as a military base; that among the properties expropriated are TCT Nos. 8708, 8710 and 13630 all in the Registry of Deeds in Pampanga; that upon an inventory of the titles pertaining to Basa Air Base, TCT Nos. 8708 and 8710 could not be found among the files despite diligent efforts to locate the same and after verification from the Register of Deeds of Pampanga, said titles were certified to be among those lost/destroyed by ravages of lahar in 1995; that TCT Nos. 8708 and 8710 are still in the name of the previous owners, Spouses Joaquin V. Gozun and Ma. Nieves Toledo-Gozun who acknowledged the expropriation of said properties and executed proper documents in favor of the petitioner; that with respect to the lot covered by TCT No. 13630, the same was included in the Supreme Court decision in Expropriation Case No. G.R. No. L-6594 as acquired from the Estate of Alfonso de Castellvi; and that the properties subject of this petition are being used exclusively for operational purposes of the petitioner; that petitioner is in possession and control of the subject properties and declared the

same for taxation purposes in its name although being a government petitioner is exempt from payment of realty taxes; and that all the properties adjoining the subject lots are already owned and titled in petitioner's name, hence, notices to adjoining owners as to this petition may be dispensed with; and that the subject properties have not been sold, encumbered; transferred, or in any other manner disposed of to any person, entity or corporation and that the same are free from all liens and encumbrances except those encumbrances existing at the time of loss which petitioner is unaware of.

ORDER

A verified petition was filed on August 29, 2012 by petitioner, thru counsel, praying that after due notice, publication and hearing, an Order be issued directing the Register of Deeds of Zamboanga City, to Claudio De Ocampo, married to Marcela Eijan Santos based on Decree no. 193694, after payment of the fees prescribed by law.

The petitioner is a great grandchildren of Claudio De Ocampo, the registered owner of a parcel of land known as Lot No. 2414 covering by OCT No. 0-9266, situated at Bolong, Zamboanga City, she being one of the daughters of Jose Ocampo who in turn one of the children of Felix Ocampo, a son of Claudio Ocampo and Marcela Eijan Santos; that the adjacent boundary owners of the subject land are the following: on the SE., (Lot 1792) owned by Leoncio Enriquez of Bolong, Zamboanga City; on SW (Lot 5215-B) owned by Ausencio Cruz of Bolong, Zamboanga City; on SE (Lot 5215-C) owned by Teresa D. Cruz of Bolong, Zamboanga City; that per certification issued by the Register of Deeds of Zamboanga City, the original copy of said title cannot be found and is presumed lost or destroyed; that found among the records of said office is Decree No. 193694 which may be used as basis for its reconstitution; and that the subject title is free from any encumbrances or liens and that no deeds or instruments affecting the property have been presented for registration.

Finding the petition to be sufficient in form and substance, notice is hereby given that the said petition has been set for hearing on March 28, 2013 at 8:30 o'clock in the morning before the Regional Trial Court, Branch 14, this City, on which date, time and place, any person who may have interest on said parcel is hereby required to appear and show cause, if any there be, why said petition should not be granted.

Let this Order be published at the expense of petitioner twice (2) in successive issues of the Official Gazette and copies thereof be posted by the Sheriff of this Court, at the main entrance of the City Hall, this City, and in three (3) conspicuous public

Greetings.

Whereas, a verified petition has been filed by petitioner Armando Misolas, asking this Court to render judgment after due notice, publication and hearing, to issue an order directing the Register of Deeds of the Province of Albay to reconstitute the original copy of Original Certificate of Title No. 186 pertaining to Lot No. 12371 of the Cadastral Survey of Albay, with the same faith and credit as the owner's copy of said OCT No. 10886

That Petitioner is the owner of Lot No. 12371, situated in Bascaran, Daraga, Albay,

which is more particularly described, as follows.

A parcel of land (Lot No. 12371 of the Cadastral Survey of Albay) with the improvements existing thereon, situated in the municipality of Daraga. Bounded on the NE., by Lot No. 12372, 12393 and 12394; on the SE., by Lots Nos. 12398 and 12370; on the SW., by Lots No. 12369, 12370 and 12372; and on the NW., by Lot No. 12390 containing an area of Seventeen Thousand Eight Hundred and Forty Two (17,842) square meters, more or less Declared under Tax No. 331 assessed at P1940.

That petitioner acquired ownership over Lot No. 12371 by way of sale from Nicanor Misolas, who in turn have acquired the same by way of sale from Felix Misolas and Eladia Lianeta, who in turn have also acquired the same by way of sale from the original registered owners, the spouses Pedro Lodor and Juana Mirabona.

That petitioner desired that the title over Lot No. 12371 be transferred in his name

and he be issued a Certificate of Title, but he learned that the original copy of the said Original Certificate of Title No. 10886, supposedly on file with the Office of the Register of Deeds of the Province of Albay is missing and cannot be found in the said office.

That petitioner is in possession of Lot No. 12371 covered by Original Certificate of Title No. 10886. He is also the one religiously paying for the Real Estate Taxes therefore and has declared the same in his name, and that subject property is free from all liens and encumbrances and is not used as a security or to guarantee any obligation, and Original Certificate of Title No. 10886 is subsisting and was not cancelled by subsequent subsequent titles for any reason whatsoever,

Wherefore, notice is hereby given that said petition is set for initial hearing on 08 April 2013 to start at 8:30 o'clock in the morning at the Session Hall of this Court,
