A verified petition having been filed in the above-entitled case by Rodrigo P. Andes, married to Lydia M. Andes, herein petitioner and a resident of Barangay 55, Estanza, Legazpi City, represented by his Attorney-In-Fact, Celerina A. Bermido of 113 JB Alegre Street, Legazpi City, thru counsel, praying, among others, that after due notice, publication and hearing in conformity with the provisions of Republic Act No. 26, render a judgment directing the Registry of Deeds for the City of Legazpi to reconstitute the lost Original Certificate of Title (OCT) No. 12201, covering Lot No. 10558, of the Cadastral Survey of Albay (now Legazpi City) in the name of its original owner Antonio Padilla and prays that an order be issued directing the Register of Deeds of Legazpi City to issue a reconstituted copy of Original Certificate of Title No. 12201. The Lot covered by Original Certificate of Title No. 12201 is described as follows:

A parcel of land (Lot No. 10558 of the Cadastral Survey of Albay), with the

improvements thereon, situated in the Municipality of Legazpi. Bounded on the NE., by Lots Nos. 10557 and 1356; on the E., by the Tula-Tula River; on the SE., and S., by Lot No. 10554; and on the SW., by Lot No. 10559. Beginning at a point marked "1" on plan being S. 34 deg. 12' W., 694.43 m. from B.B.M. No. 64; thence S. 61 deg., 43' E., 34.40 m. to point "2"; thence S. 66 deg. 38'_., 109.83 m. to point "3"; thence E. O deg. 50' W., 28.73 m to point "4"; thence N. 88 deg. 50′ W., 28.41 m. to point "5"; thence S. 50 deg. 16' W., 16.49 m. to point "6" thence N. 82 deg. 31' W., 22.04 m. to point "7"; thence N. 36 deg. 52' W., 115.51 m. to the point of beginning; containing an area of Five Thousand One Hundred and Twenty-One square meters (5,121). more or less. You are hereby served this notice to appear before this Court at its session to be held at Regional Trial Court, Branch 1, Legazpi City on the 17th day of April, 2013 at 8:30 o'clock in the morning then and there to present such claims as you may have to said Lot No. 10558 or any portion thereof, and to submit evidence in support of such claim; and unless you appear at said Court at the time and place aforesaid, your default will be recorded and the petition for reconstitution of the Original Certificate of Title No. 12201, covering Lot No. 10558, in the name of Antonio Padilla, will be adjudicated and determined in accordance with law and the evidence before the Court, and thereafter you will forever be barred from contesting said petition or any decree entered thereon.

Let this Notice be published at the expense of the petitioner, twice in successive issues of the Official Gazette, and likewise be posted at the main entrance/ bulletin board of the Albay Provincial Capitol Building, at the main entrance/bulletin board of the Legazpi City Hall, Old Albay District, Legazpi City, at least thirty days prior to date of hearing.

AMENDED ORDER

A verified petition dated August 8, 2012 have been filed before this Court by petitioners, through counsel, praying that after due notice, publication and hearing, judgment be rendered ordering the

reconstitution and issuance of the owner's

duplicate copy of TCT No. RT-57848 (T302132) based on the original copy of the same title.

The petition alleges among others: "that petitioner is of legal age, single, Filipino and resident of Culianin, Plaridel, Bulacan, herein represented by her niece Epifania Dela Cruz-Navarro, also of legal age, married, Filipino and resident of the same above address, per Special Power of Attorney dated August 2, 2012; that petitioner is the registered owner of a parcel of land consisting of Six Hundred Twenty (620) Square Meters located at Culianin, Plaridel, Bulacan, and covered under TCT No. RT-57848 (T-302132); that sometime in July, 2012, the owner's copy of TCT No. RT-57848 (T-302132) was destroyed and deemed lost, the same having been almost wholly eaten and pulverized by termites in petitioner's house in the above given address as attested by herein petitioner in a Sinumpaang Salaysay dated August 2, 2012; that said loss was duly reported to the Registry of Deeds of Guiguinto, Bulacan; that the known owners/possessors of the adjoining lots are the following:

(a) Leonardo Villaverde of Culianin, Plaridel, Bulacan;

(b) Florentino Geronimo of Culianin, Plaridel, Bulacan; and

(c) Simeona Fabian of Culianin, Plaridel, Bulacan

that finally, there is a basis for reconstitution of the owner's copy of the title which is the original copy found at the Registry of Deeds, and that petitioner is willing to prove the merits of this petition including compliance with the jurisdictional requisites provided for by law."

Wherefore, the instant petition is hereby set for hearing on February 13, 2013 at 8:30 o'clock in the morning before this Branch of the court sitting at the Ground Floor of the New Bulwagan ng Katarungan, Malolos, Bulacan, on which date, time and place, all interested persons may appear and show cause, if any, why the instant petition should not be granted.

Let copies of this Order be published once in two (2) successive issues of the Official Gazette and the Ex-Oficio Provincial Sheriff of this Court is hereby directed to post copy of the same at the main entrance of the Municipal Hall of Plaridel, Bulacan, at least thirty (30) days prior to the date of hearing, all at the expense of the petitioner.

SECOND AMENDED ORDER

Petitioner in a verified Amended Petition, prays "that after due notice, publication and hearing, an order be issued by this Honorable Court to the Register of Deeds of the Province of Iloilo to Reconstitute to the Office file copy OCT No. 21124 based on the Owner's Duplicate Copy of the said title now in the possession of the petitioner."

Petitioner, alleges among others, that she is the owner of a parcel of land known as Lot No. 4128; that the said property is registered in the name of Concepcion Sales married to Resurreccion Sampani; that Concepsion Sales Sampani died in the year 1964 and upon her death, left the property to her children Soledad Sampani, Matilde Sampani, Angelica Sampani and Teresa Sampani; that the above-named children executed a Deed of Extra-Judicial Partition

and Sale on May 21, 1973 wherein the other heirs sold their share to Soledad Sampani and Teresa Sampani; that Soledad Sampani died in 1974 while Teresa Sampani died in the year 2000; that the heirs of Soledad Sampani and also the heirs of Teresa Sampani executed a Deed of Adjudication and Partition with Absolute Sale in favour of Yulomeo Florentino; that Julianita Sampani Prologo is the daughter of Soledad Sampani; that when petitioner sought to have the Deed of Extra-Judicial Partition and Sale and the Deed of Adjudication and Partition with Absolute Sale registered at

Sabio, Amelito Sampbrano, Marialyn Sompreque, Fe Sales and Leocardo Florentino, all of San Miguel, Iloilo; that the petitioner is presently in the possession of the property and she has not alienated the same nor has been used as security for any loan or financial obligation; that it is the desire of the petitioner to ask for the reconstitution of the file copy of Original Certificate of Title No. 21124.

The petition being sufficient in form and substance, it is hereby set for hearing on March 25, 2013 at 8:30 o'clock in the morning at the sala of Branch 35, Regional Trial Court, Iloilo Hall of Justice, Iloilo City, at which time and place, any interested person may appear and show cause why the petition should not be granted.
