(Re: Initial Hearing)

On November 18, 2010, petitioner Naresh Galubrai Moorjani filed a Petition for Naturalization under Commonwealth Act (CA) No. 473, otherwise known as the Revised Naturalization Law, as amended, alleging in his petition that:

He was born on January 11, 1964 in Cagayan De Oro City, Philippines; he is a citizen of India; he lives in Archbishop Hayes corner President Roxas Streets, Pinikitan, Cagayan De Oro City, he is a businessman by occupation; he is married to Elsie Dayrocas Bas, a Filipina with residence at Agusan del Sur; he and his wife have five (5) children, namely, Chandreena, Suresh John, Pamesh Paul, Shameena Faith and Shivani Grace, all born in Cagayan De Oro City on November 7, 2000, March 9, 2002, May 30, 2005, October 10, 2007 and October 3, 2009 respectively; he has all the qualifications required under Section 2 of C.A. No. 473, as amended;

he is more than 25 years old and resided in the Philippines continuously since birth of for more than 46 years; he is a person of good moral character and believes in the principles underlying the Philippine constitution and conducted himself in a proper and irreproachable manner during the entire period of his residence in the Philippines in his relation with the constituted government as well as with the community in which he is living; he owns real estate in the Philippines whose value is not less than five thousand pesos and has a lucrative and lawful occupation as a businessman; he has enrolled his children in a private school recognized by the Department of Education where Philippine History, government and civics are taught or prescribed as part of the school curriculum; he is able to speak and write in English, Pilipino and any one of the principal languages in the Philippines; he is not opposed to organized government or affiliated with any association or group of persons who uphold and teach doctrines opposing all organized governments; he is not defending or teaching the necessity or propriety of violence, personal assault or assassination for the success or predominance of their ideas; he is not a polygamist or believes in the practice of polygamy; he has not been convicted of any crime involving moral turpitude; he is not suffering from mental alienation or incurable contagious disease; he has mingled socially with the Filipinos during the period of his residence in the Philippines or has evinced a sincere desire to learn and embrace the customs, traditions and ideals of the Filipino people; he is a citizen of India who is not at war with the Philippines and whose laws grant the Filipinos the right to become citizens of subject thereof; he is exempt from the requirement to make Declaration Of Intention to become citizen of the Philippines because he was born in the Philippines, studied primary, secondary and college education in a private school recognized by the Government and not limited to any race or nationality; he has continuously lived in the Philippines since birth or for more than 46 years before the filing of this Petition for Naturalization and he has given primary education to all his children in a private school recognized by the Government and not limited to any race or nationality, it is his intention in good faith to become a citizen of the Philippines and to renounce absolutely and forever all allegiance and fidelity to any foreign state or sovereignty if his petition is granted and particularly to India of which he is at present a citizen or subject and he will reside in the Philippine from date of filing of this petition up to the time of his admission to Philippine citizenship.

Attached to the petition were the Affidavit of Leonor Moya and Narciso Paasa (Annex "J"), petitioner's Certificate of Live Birth (Annex "A"), Certificate of Baptismal (Annex "A-1") and Certificate of Marriage (Annex "B"), the Certificate of Live Birth of petitioner's wife (Annex "C") and their children (Annexes Dto H), Annual Income Tax Return (Annex "I" with submarkings), petitioner's Certifications and Certificate of Graduation issued by Xavier University (Annexes "L" to "N"), Official Transcript of Records (Annex "O"), Alien Certificate of Registration (Annex "P"), and Immigrant Certificate of Residence.

WHEREFORE, finding the instant Petition to be sufficient in form and substance, let this case be called for initial hearing on November 18, 2013 at 8:30 in the morning before this Court.

Accordingly, at the expense of petitioner, let the copy of the entire Petition for Naturalization and this Order to be published once a week for three consecutive weeks, in the Official Gazette and also in a newspaper of general circulation in Cagayan de Oro City and the Province of Misamis Oriental, and posted at the main entrance of the Barangay Hall of Pinikitan, Cagayan de Oro City, the City Hall Building, Cagayan de Oro City, the Provincial Capitol Building and in the Hall of Justice Building, Cagayan de Oro City.

Furnish copies of this Order, together with the instant Petition and its annexes, to the Office of the Solicitor General, petitioner's counsel on record Atty. Leonardo N. Demecillo and petitioner Naresh Gulabrai Moorjani.

AFFIDAVIT OF WITNESSES

That We, LEONOR MOYA, of legal age, Filipino, married and resident of Nazareth, Cagayan de Oro City, and NARCISO PAASA, of legal age, Filipino, married and resident of Tibasak, Macasandig, Cagayan de Oro City and being severally, duly and respectfully sworn, depose and say: That we are citizens of the Philippines; that we have personally known in acquainted with NARESH GULABRAI MOORJANI, the applicant for admission for Philippine Citizenship; that petitioner has resided in the Philippines continuously preceding the date of the filing of this petition of which this affidavit is a part; that they have personal knowledge that petitioner is, and during all such periods has been a person of good moral character and morally irreproachable, attached to the principles underlying the Philippine Constitution; and well disposed to good order and happiness of the Philippines; that in their opinion, the petitioner has all the qualification necessary to become citizen of the Philippines and is not in any way disqualified under the provisions of Commonwealth Act No. 743 as amended.
