shall mix or caufe to be mixed any of his, her or their couches or floors, with any corn or grain of a former wetting or steeping, before the fame is put on the kiln for drying, on pain of forfeiture of the fum of five fhillings for every bufhel of corn fo mixed contrary to the true intent and meaning hereof.

XII. And be it further enacted by the authority aforefaid, That the faid forfeiture of five fhillings for every bufhel fhall be fued for, recovered, levied and mitigated by fuch ways, means and methods, as any fine, penalty or forfeiture is or may be recovered by any law or laws of excife, or by action of debt, bill, plaint or information in any of his Majefty's courts of record at Westminster, or in the court of exchequer in Scotland; and that one moiety of fuch forfeiture fhall be to his Majefty, his heirs and fucceffors, and the other moiety to him or them that fhall discover, inform or fue for the fame.

An alt for raising the fum of one million two hundred and fifty thousand pounds by fale of annuities to the bank of England, after the rate of four pounds per centum per annum, redeemable by parliament; and for applying the produce of the finking fund.

WHER

HEREAS by an act of parliament made in the twelfth year of the reign of her late majesty Queen Anne, intituled, An act for laying additional duties on foap and paper, and upon certain linens, filks, callicoes and ftuffs, and upon ftarch and exported coals, and upon ftamped vellom, parchment and paper, for raising one million four hundred thousand pounds by way of a lottery, for her Majefty's fupply, and for allowances on exporting made wares of leather, fheep fkins and lamb fkins, and for diftribution of four thoufand pounds due to the officers. and feamen for gun-money, and to adjust the property of tickets. in former lotteries; and touching certain fhares of flock in the capital of the South-Sea company; and for appropriating the monies granted to her Majefty, certain duties, rates, or impofitions, or additional duties, rates or impofitions on foap, paper, and upon certain linnens, filks, callicoes and fluffs, and upon ftarch and export ed coals, and upon stamped vellom, parchment and paper, were thereby granted to her Majefty for a term or terms of thirty two years, to be reckoned from the fecond day of August one thousand seven hundred and fourteen, and the yearly fum of one hundred and five thou fand pounds, by or out of the monies to arife by the faid additional duties, rates or impofitions, and to be brought into the receipt of exchequer, in cafe the fame should extend thereto, fhould be computed and reckoned a yearly fund, and in cafe the monies arifing into the ex

chequer for the faid duties should not amount to the fum of one hun dred and five thousand pounds per annum, then the monies fo arifing fhould be part of the yearly fund, towards anfwering and paying certain principal fums therein after appointed to be paid, for the fortunate and blank tickets in the lottery thereby established, amounting together to one million eight hundred feventy fix thousand four hundred pounds, with intereft after the rate of four pounds per centum per annam, with certain provifions for fupplying the deficiency of the faid fund of one hundred and five thousand pounds per annum from time to time, in cafe the faid additional duties, rates or impofitions fhould not be fufficient for that purpose; and by the fame act all the monies arifing by the faid additional duties, rates or impofitions, not exceeding one hundred and five thousand pounds per annum, were appropriated to pay off the faid feveral principal fums with intereft in the order and course thereby directed; and by the fame act the annual furplus of the faid additional duties, rates or impofitions, beyond one hundred and five thousand pounds per annum, was referved for the difpofition of parliament; and it was also provided by the said act, That if before the end of the faid term of thirty two years all the faid principal and intereft monies, and all other payments and charges by virtue of the faid act, fhould be fully paid and difcharged, then and from thenceforth the faid duties, rates and fums of money thereby charged, and the monies arifing thereby, should be referved for the use of the publick, and should be difpofed of by authority of parliament, and not otherwife: and whereas by another act of parliament made in the first year of the reign of his late majefty King George the Geo.i.stat.1. Firft, of glorious memory, intituled, An act for rectifying mistakes c. 2. in the names of the commiffioners for the land-tax for the year one thousand seven hundred and fourteen, and for raifing fo much as is wanting to make up the fum of fourteen hundred thousand pounds intended to be raised by a lottery for the publick fervice in the said year, amongst other things it is enacted, That yearly and every year, during the said thirty two years, the fum of one hundred and fixteen thousand five hundred and feventy three pounds, twelve fillings (in lieu of the aforesaid yearly sum of one hundred and five thousand pounds) to arife by or out of the monies arifing by the faid additional or new duties by the before recited act granted, and to be brought into the receipt of exchequer, in cafe the fame should extend thereto, should be computed and reckoned the yearly fund, and in cafe the monies arifing into the exchequer shall not amount to one hundred and fixteen thousand five hundred feventy three pounds twelve fillings per annum, then part of the yearly fund, towards the anfwering and paying off all and every the faid principal sums, amounting to one million eight hundred feventy fix thousand four hundred pounds, with intereft for the fame after the respective rates therein after mentioned, that is to fay, after the rate of four pounds per centum per annum for fo much thereof as should be contained in the fortunate tickets to be drawn in pursuance of the said acts, and after the rate of five pounds per centum per annum for fo much of the faid principal fums as fhould be contained in the other tickets, commonly called Blank Tickets, to be drawn pursuant to the fame afts,

with proper provisions for making good the deficiencies of the faid new fund of one hundred and fixteen thousand five hundred feventy-three pounds twelve shillings per annum, as by the faid recited acts, relation thereunto respectively being had, more fully may appear and whereas fo much of the faid principal fum as was contained in the faid fortunate tickets, carrying an intereft after the rate of four pounds per centum per annum, did amount to the fum of feven hundred and nineteen thousand and forty pounds, and so much thereof as was contained in the faid blank tickets carrying an intereft after the rate of five pounds per centum per annum, did amount to the fum of one million one hundred and fifty feven thousand three hundred and fixty pounds, both which fums together make the faid fum of one million eight hundred feventy fix thoufand four hundred pounds: and 6 Geo. 1. c. 4. whereas by an act of parliament made in the fixth year of the reign of his faid late majesty King George the First, For enabling the SouthSea company to enlarge the capital stock and fund of the said company, the faid additional duties, rates or impofitions were continued for ever, and thereby the then remaining principal fums charged thereon, were impowered to be taken into the capital flock of the faid South-Sea company, and the faid company was to be intitled to an annuity after the rate of four pounds per centum per annum, deemable by parliament, for fo much of the faid principal fums carrying intereft at four pounds per centum per annum, as should be Jo taken into their capital flock; and as to fo much of the faid principal fums carrying an intereft after the rate of five pounds per centum per annum, as should be taken into the Jaid capital flock, the faid company were to be intitled to an annuity after the rate of five pounds per centum per annum, until the feaft-day of the nativity of Saint John the Baptift which Jhould be in the year of our Lord one thousand feven hundred and twenty-feven, and from and after the faid feaft-day then to an annuity after the rate of four pounds per centum per annum, redeemable by parliament, in lieu of the former intereft or annuity payable for the fame, and to be charged on the faid additional duties, rates or impofitions; and also by virtue of the faid act the faid South-Sea company were to be intitled to an additional allowance for charges of management, to be afterwards fettled and adjusted in respect of the whole increase of their capital by virtue of that act, to be charged proportionally on the refpective duties and revenues on which the respective debts that should be taken into their capital were then charged: and whereas in pursuance of the last recited at the feveral following principal fums were fubfcribed or taken into the capital flock of the faid South-Sea company, videlicet, So many of the faid principal fums, carrying an intereft after the rate of four pounds per centum per annum, as amounted together to the principal fum of five hundred thirty eight thousand seven hundred and twenty pounds; and fo many of the faid principal fums, carrying an intereft after the rate of five pounds per centum per annum, as amounted together to the principal fum of eight hundred fixty five thousand two hundred and fifty pounds, both which principal Jums make together the principal fum of one million four hundred and three thousand nine hundred and seventy pounds, in respect whereof the said

company are now intitled to an annuity of fifty fix thousand one hundred and fifty eight pounds fixteen shillings, being after the rate of four pounds per centum per annum for the faid principal fum of one million four hundred and three thousand nine hundred and feventy pounds, redeemable by parliament, charged on the faid additional duties, rates or impofitions: and whereas the additional allowance to the faid company, by virtue of the last recited act, for charges of management, hath been fettled and adjusted at twelve thousand pounds per annum, and the proportional part thereof, in respect of the faid fum of one million four hundred and three thousand nine hundred and feventy pounds, which by virtue of the faid laft recited at is charged or chargeable upon the faid additional duties, rates or impofitions, amounts by computation to the yearly fum of fix hundred forty fix pounds twelve Shillings and two pence halfpenny: and whereas all the rest and restdue of the feveral principal fums so as aforefaid charged on the faid yearly fund of one hundred and fixteen thousand five hundred feventy three pounds and twelve fillings, to arife out of the faid additional duties, rates or impofitions (over and beyond the fums fo as aforefaid taken into the capital stock of the South-Sea company) have been paid off and discharged, by means whereof and of the provisions in the faid laft recited act, the faid former fund is ceafed and determined, and the said additional rates, duties or impofitions ftand now charged only with the said annuity of fifty fix thousand one hundred and fifty eight pounds fixteen fillings, payable to the South-Sea company, redeemable by parliament, and the faid proportional annual fum of fix bundred forty fix pounds twelve shillings and two pence halfpenny, payable to the faid company for charges of management as aforefaid, and fubject thereto, the furplus of the monies arifing from the faid additional duties, rates or impofitions, is liable to the difpofition of parliament: and whereas the governor and company of the bank of England have consented and agreed to advance and pay into the receipt of your Majesty's exchequer the fum of one million two hundred and fifty thousand pounds, at the times and in manner herein after mentioned, for the purchase of an annuity of fifty thousand pounds to be paid to them and their fucceffors for ever, fubject to redemption by parliament, to be charged on the faid furplus monies to arife for the additional duties, rates or impofitions, fo fubject as aforefaid: now we your Majesty's most dutiful and loyal fubjects, the commons of Great Britain in parlianient affembled, being defirous effectually to enable your Majesty to fecure and preferve the commerce, privileges and poffeffions of your Majefty and your subjects, and the balance of power in Europe, by a jutt, fafe and honourable peace, and at the fame time to raise the fupplies which we have chearfully granted to your Majefty for these purposes in the easiest manner we are able, for the benefit of your Majefty, have freely and voluntarily given and granted, and by this act do give and grant to your Majesty the fum of one million two hundred and fifty thousand pounds, to be raised in such manner and form as is herein after directed; and to that end do moft humbly beseech your Majefty, that it may be enacted, and be it enacted by the King's moft excellent majefty, by and with the advice and con

fent of the lords fpiritual and temporal and commons, in this present parliament affembled, and by the authority of the fame, An annuity of That yearly and every year from and after the feast day of the 50,000l. eita nativity of Saint John the Baptift which fhall be in the year of our Lord one thousand seven hundred and twenty nine, a certain yearly fum or fund of fifty thousand pounds, being after the rate of four pounds per centum per annum, for or upon the fum of one inillion two hundred and fifty thousand pounds to be raised by this act, be fettled and established and be payable in the manner and form herein after expreffed and declared, for fatisfying the annuities to be purchased in pursuance of this act from time to time, until the redemption thereof by parliament, according to the provifo or provifoes herein after for that purpole contained.

II. And for the better fecuring and establishing the faid fund, it is hereby enacted by the authority aforefaid, That the faid yearly fund or fum of fifty thousand pounds shall be and is hereby charged upon, and payable out of all the overplus or furplus monies of the said additional duties, rates or impofitions, Charged upon fo granted as aforefaid, which shall from time to time remain in the overplus the exchequer, after fatisfying or reserving there fufficient to faadditional du- tisfy fo much as fhall be incurred or grown due to the faid South-Sea ties, company upon their faid annuity, and additional allowance for charges of management; and the commiffioners of his Majesty's treasury now or for the time being, or any three or more of them, or the lord high treasurer for the time being, fhall, and they are hereby required quarterly in every year, after the faid feaft-day of the nativity of Saint John the Baptift which shall be in the year of our Lord one thoufand feven hundred and twenty nine, viz. on the respective feast days of Saint Michael the Archangel, of the nativity of our Lord Chrift, of the annunciation of the blessed Virgin Mary, and of the nativity of Saint John the Baptift, in each year, or within fix days after fuch feast-days refpectively, to cause the overplus or furplus monies of the faid additional duties, rates or impofitions, to be computed accordingly, and to caufe fuch furplus or overplus monies as fhall appear upon fuch respective computations, from time to time, or fo much thereof as fhall be fuficient, to be fet apart, reserved and applied for and towards the making good the faid yearly fund or fum of fifty thoufand pounds, or the quarterly proportions thereof, without diverting or misapplying any of the monies, which, by the faid act of the fixth year of his faid late Majesty's reign, ought to be referved or applied for or towards fatisfying the faid annuity or additional allowance to the faid South-Sea company.

III. And be it enacted by the authority aforefaid, That the governor and company of the bank of England fhall, and they are hereby required and enjoined to advance and pay into the receipt of his Majesty's exchequer, the full and intire fum of one million two hundred and fifty thoufand pounds of lawful money of Great Britain, in manner following; that is to fay, one moiety thereof
