Before this Court is a petition filed by the heirs of the late Abner C. Espino, Sr. all represented by Abner S. Espino, Jr. through counsel praying that after due proceedings, including publication, service and posting, and Order be issued directing the Register of Deeds of Quezon City to issue new original Transfer Certificate of Title based on the existing owner's duplicate TCTs No. 67411, 207710 and 137693 that same to be regarded as the original certificates for all purposes of the law thereof in lieu of the lost/burned original in accordance with the provision of Section 110 of P.D. 1529 as amended, covering a parcels of land located in Quezon City, more particularly described as follows:

Technical Description of TCT No. 67411

A parcel of land (Lot 13, Block 436 of the subdivision plan (LRC) Psd-3743, being a portion of Block 429, described on plan Psd-46_ LRC (GLRO) Record No. 7681) situated in Quezon City, Island of Luzon, Bounded on the NE., point 1 to 2 by Lot 15, Block 436; on the SE., Point 2 to 3 by street Lot 20; on the SW.,

point 3 to 4 by Lot 11., Block 436; and on the NW., points 4 to 5 by Lot 12, and points 5 to 1 by Lot 14 both of Block 436 and all of the subdivision plan. Beginning at a point marked “1” on plan, being N. 49 deg. 42'E., 2_04.41 m. C.B.M. 37. Manila Cadastre, thence S. 7 deg. 38'E., 17.00 m. to point 2; thence S. 82 deg. 22'W., 12.00 m. to point 3; thence N. 7 deg. 38'W., 17.02 m. to point 4; thence N. 82 deg. 22'E., 5.00 m. to point 5; thence N. 82 deg. 22'E., 7.00 m. to the point of beginning; containing an area of Two Hundred Four (204) Square Meters, more or less.

A parcel of land (Lot 14-A of the subdivision plan (LRC) Psd-51087, being a portion of Lot 14, Block 435 (LRC) Psd-3743, LRC (GLRO) Rec. No. 7681), situated in Quezon City, Island of Luzon. Bounded on the NE., points 2 to 3 by Lot 16, Block 435, (LRC) Psd-3743; on the SE., point 3 to 4 by Lot 13, Block 435, (LRC) Psd374_, on the SW., point 4 to 1 by Lot 14-B of the subdivision plan; and on the NW., points_2 by street to 20, (LRC) Psd-3743. Beginning at the point marked "1" on plan being Deg. 14'E., 2586.26 m. from CBM 37, Manila Cadastre; thence N. 82 deg. 22'E., 6.00., to point 2; thence S. 7 deg. 38'E., 17._m. to point 3; thence S. 82 deg. 38'W., ____.00 m. to the point of beginning; containing an area of One Hundred Two (102) Square Meters, more or less.

Bounded on the NW., points 3 to 4 by Lot 17, Block 436, on the SE., points 4 to 5 by Street Lot 20; on the NW., points 5 to by Lot 13, Block 436; and on the NW., points 1 to 2 by Lot 14, and points 2 to 3 by Lot East of Block 436 all of the subdivision plan. Finding the petition to be sufficient in form and substance, the same is hereby set for hearing on May 29, 2012 at 2:00 o'clock in the afternoon before this Court, sitting at Rm. 210, 2nd Flr., Hall of Justice, Quezon City, at which place, date and hour, petitioner together with there counsel are hereby enjoined to appear in said hearing and show cause why the petition should be granted.

Let copies of this Order be published, twice in successive issues of the Official

Gazette and posted on the following conspicuous places, to wit: 1) on the bulletin board located at the main entrance of this Court; 2) on the bulletin board located at the lobby of this building and 3) on the conspicuous place of the subject properties or at the conspicuous place of the barangay hall where the properties are located, at least thirty (30) days prior to the date of hearing, copies of which must be served personally by the process server of this Court to the occupants or person in possession of the property and the adjoining lot owners thereof and likewise copies of the same together with the copies of the petition and annexes must be serve upon the Office of the Solicitor General, the Office of the Executive Director DENR-NCR, the Land Registration Authority, the Registry of Deeds of Quezon City, the office of the City Prosecutor of Quezon City and the Office of the City Attorney of Quezon City at the petitioners expense.

The "Compliance" filed by petitioner through Atty. Francis Carlo D. Taparan of Yap Ignalaga and Taparan Law Offices is noted.

A verified petition for reconstitution of the original copy of Transfer Certificate of Title No. N-137714 covering a parcel of land located at Lorenzo Sumulong Memorial Circle (Circumferential Road) Brgy. San Isidro, Antipolo City registered in the name of Spouses Ferdinand Cruz and Amelia M. Cruz has been filed with the Court by herein petitioner who alleged that the original copy in the custody of the Register of Deeds for Antipolo City cannot be located in its file per Certification dated February 14, 2011 issued by the Register of Deeds for Antipolo City (Annex "F") and at the same time, cannot also be located in the general file of the registry of Marikina City despite diligent efforts per Certification dated January 7, 2011 issued by said office. (Annex "G") The subject property as alleged by the petitioner, is bounded by the following adjoining owners namely: Maria Salud Flores with address at San Lorenzo Sumulong Memorial Circle (Circumferential Road) Brgy. San Isidro, Antipolo City and (2) Antonio Sorrenillo and Cornelia Carreon with address also at San Lorenzo, Sumulong Memorial Circle (Circumferential Road Brgy. San isidro, Antipolo City. The lessee in possession of the subject property is Louie D. Estrallanes/LDE Trading and MBE Forwarder with address at San Lorenzo Sumulong Memorial Circle (Circumferential Road) Brgy. San Isidro, Antipolo City.

As source for the reconstitution, petitioner attached to its petition a photocopy of TCT No. N-137714 issued by the Register of Deeds of Marikina (Annex "A"), photocopy of the duplicate owner's copy of TCT No. N-137714 (Annex "B") and the Certificate of Sale dated May 24, 2004 with Primary

successive issues of the Official Gazette as required in Section 3, Republic Act No. 26; and posted at the Bulletin Board of this Court, of the Provincial Capitol of Eastern Samar, and the City Hall of Borongan, at least thirty (30) days prior to the date of hearing; and let copies of this Order; together with copies of the petition, be sent by registered mail to the Honorable Administrator, Land Registration Authority and the Honorable Solicitor General, 134 Amorsolo St., Legaspi Village, Makati City; the Director of Lands, Manila, the Register of Deeds, Borongan, Eastern Samar; and personally to the adjoining owners, and the actual occupants of the subject property by the Sheriff of this Court, likewise at the expense of the petitioner.

Whereas, a verified petition has been filed with this Court seeking for the cancellation of old decree, re-issuance of another decree and issuance of original certificate of title for Lot No. 834, alleging among others that the same lot has been issued a decree of registration under Decree No. 557027 on May 10, 1935 but despite the issuance of the aforesaid decree, there is no sufficient showing that the corresponding original certificate of title (OCT) were issued pursuant to such decree and the subject lot is herein particularly described as follows:

"A parcel of land (Lot 834, Cad. 234, Surigao Cadastre), situated in the Barrio of Luna, City of Surigao, Province of Surigao del Norte, Island of Mindanao. Bounded on the SE., along lines 1-2-3 by Lot 849; on the SW., along line 3-4-5 by Lot 831; on the NW., along line 5-6 by Lot 833; on the NE., along line 6-7 by Lot 810; and on the E., along line 7-1 by Lot 835, all of Cad. 234, Surigao Cadastre.

Hall of this Court, on July 26, 2012 at 8:30 o'clock in the morning, at which place, date and hour aforestated, all interested persons are Inocencio Cortes now Marcos Cortes, Daniel Cotacte, Emilia delos Reyes and Roque Castillo, hereby enjoined to appear and show cause, if they have any, why the said petition should not be granted.

Let this notice be published twice in consecutive issues of the Official Gazette, at the expense of the herein petitioner.

Likewise, let copies of this notice be posted at the Bulletin Board of the Barangay Hall of Barangay Luna, Surigao City, where the subject lands are situated; at the Bulletin Board of the City Hall, Surigao City and at the Bulletin Board of the Hall of Justice, Capitol Compound, Surigao City, at least thirty (30) days prior to the aforesaid date of hearing.
