Whereas, a verified petition has been filed by Petitioner through counsel, praying of this Honorable Court that after notice, publication and hearing, Original Certificate of Title No. 16848 be ordered reconstituted and the Office of the Register of Deeds of Albay be directed to issue the reconstituted certificate of title of the same, including the issuance of an owner's duplicate copy to the petitioner, to be accorded like faith and credence as that of the original thereof, which lot is more particularly described as follows:

owner of a residential lot situated in Bungahan, Malolos City, Bulacan and covered by Transfer Certificate of Title No. T-195911; that no co-owner's, mortgagor's or lessee's duplicate copy of this title had been issued by the Register of Deeds; that the location, area and boundaries of the subject property are indicated in its technical description found on Transfer Certificate of Title No. T-195911; that the subject property is in actual possession of the petitioner where her residential house is erected thereon; that the owners of the adjoining properties of the subject property are as follows: a) Desiree Domingo - Bungahan, Malolos City, Bulacan; b) Miguel Domingo - Bungahan, Malolos City, Bulacan; Mariano Domingo Bungahan, Malolos City, Bulacan; that the said property is declared under Tax declaration in the name of the petitioner and real property tax due thereon was duly paid in full to the government; that the original copy of TCT No. T-195911 on file with the Registry of Deeds of Bulacan was lost and destroyed due to fire conflagration that gutted the said office on March 7, 1987; that a certification was issued by the Register of Deeds to this effect while the owner's duplicate copy thereof is intact and in the possession of the petitioner; that there is no other deeds nor instruments affecting the subject property that had been presented for registration as the petitioner's ownership over the subject property is free from all kinds of lien and encumbrance in favor of any third party or person.

The Court hereby sets the petition for hearing on August 21, 2012 at 8:30 o'clock in the morning before this branch of the Court, on which date, time and place, all interested persons are hereby required to appear and show cause, if any they have, why the petition should not be granted.

Let copies of this Order be published in two (2) successive issues of the Official Gazette at the expense of the petitioner with the last issue not less than thirty (30) days prior to the date of hearing above-fixed. Also, let copies of this order be posted by the Deputy Sheriff of this Court, at the Bulletin Board of this Court, at the main entrance of the Provincial Capitol Building of Bulacan, Malolos, Bulacan, at the City Building of Malolos, Bulacan, and in a conspicuous place where the property is located.

Petitioner's ownership is by virtue of the Extra-Judicial Settlement of Estate with Sale of Portion executed by the Heirs of Placido Cuntapay who allegedly owns the subject property, namely: Alberta O. Quinto, Soliven C. Tuliao, David C. Del Rosario, Jr., and Nida Sabug. The Original Certificate of Title No. 7332 is particularly bounded and described as follows:

The petitioner is directed to publish this Order twice in successive issues of the Official Gazette and to post the same at a conspicuous place in the (a) Provincial Hall of Cagayan; (b) City Hall of Tuguegarao City, Cagayan and (c) Barangay Hall where the property is located at least thirty (30) days prior to the date of initial hearing.

Petitioner is further directed to serve a copy of this order to all the adjoining lot owners or their heirs and assigns, the heirs of the registered owner, his immediate transferor or vendees enumerated above and all other persons who may have interest on the title subject of this petition and thereafter file an affidavit of service as proof of compliance hereto.
