ORDER

A verified petition for reconstitution of original copy of Transfer Certificate of Title Nos. RT-1295288 and RT-1295289 of the Registry of Deeds of Cavite registered in the name of petitioner praying that after proper due notice, publication and hearing, an order be issued directing the Register of Deeds of Cavite Provice to reconstitute the said original copy of Transfer Certificate of Titles based on the owner's duplicate copy of the said titles.

Finding the petition to be sufficient in form and substance, let, therefore, this petition be set for hearing on April 25, 2012 at 8:30 in the morning before this Court located at the Hall of Justice, Poblacion, Bacoor, Cavite, at which date, time and place designated all interested parties who may

have interest in the above-entitled

proceedings may appear and show cause, if any, why the petition should not be granted.

At the expense of the petitioner, let copy of this Order be published twice (2) in successive issues of the Official Gazette, and in a newspaper of general circulation in the cities and province of Cavite once a week for three (3) consecutive weeks and the same be posted by the sheriff of this Court in three (3) conspicuous places in the Municipality of Bacoor, Cavite, where the property is located at least thirty (30) days prior to the date of hearing.

Whereas, a verified Amended Petition was filed by Ernesto J. Natividad, Filipino, of legal age, married and a resident of San

Fernando, San Jose, Antique, seeking for the cancellation of Decree of No. 425671 issued for Lot No. 1179 and issuance of a new decree of registration and Original Certificate of Title, alleging among others that he is a lawful co-owner and actual possessor of Lot No. 1179, which was originally adjudicated to his grandfather Benito Hiponia, who died intestate and left to this legitimate heirs the aforesaid lot. Since a decree has been issued for Lot No.

1179, petitioner honestly believed that a certificate of title has been generated for the said lot, however, despite diligent search, no original certificate of title could be found. A Certification issued by the Registry of Deeds for the Province of Antique likewise confirmed the fact that their office has no record of an original certificate of title issued for Lot No. 1179. The Land Registration Authority also issued a certification that indeed Decree 425671 was issued for Lot No. 1179 on March 2, 1931, but it is not among the salvaged decrees on file in their office, for copy of the same might have been lost or destroyed as a consequence of the last World War. The aforementioned parcel of land is more particularly described and bounded as follows:

"A parcel of land (Lot No. 1179, of the cadastral survey of San Jose and show on plan, AP- 25062. L.R.C. Cad. Record No. 216), situated in the Barrio of San Fernando, Municipality of San Jose, Province of Antique. Bounded on the NE., along line 1-2 by Lot 1185; on the SE., along line 2-3 by Lot 1177, both of Cad. 216, San Jose Cad., on the S., along lines 3-4-5 by Road (10m. wide); and on the W. along lines 5-61 by Lot 1184, Cad. 216, San Jose Cadastre, containing an area of Twenty Nine Thousand Eight Hundred Ninety One (29,891) square meters more or less."

3. Lot 1184 - Pedro Opiña, San Jose, Antique

Petitioner prays that after due notice and hearing, an Order be issued granting the petition and thereby thereby ordering the cancellation of Decree No. 425671 previously issued for Lot 1179 of the San Jose, Antique Cadastre; ordering the Land Registration Authority to issue a new Decree for Lot 1179 and to cause the preparation of the corresponding Original Certificate of Title in the name of the owner mentioned in the 1929 Cadastral Decision and forthwith, to transmit the same to the Registry of Deeds for Antique.

It appears that the Amended Petition is sufficient in form and substance, it is hereby set for initial hearing on May 16, 2012, at 8:30 o'clock in the morning, before this court sitting at the Justice Calixto O. Zaldivar Hall of Justice Binirayan Hills, San Jose, Antique, and anybody having interest thereon, who may be adversely affected thereby, may appear and show cause why said petition. should not be granted.

The Land Registration Authority and the Registrar of Deeds of the Province of Antique may file their comment and/or Opposition thereto, and the same must be received by the court at least three (3) days before the aforementioned date and time of hearing.

Let copies of this Notice of Hearing be posted on the bulletin boards located at the main entrance of the municipal building of San Jose, Antique, of the Provincial Capitol of Antique and of this court. Also, let a copy of the same be published twice or in two (2) consecutive issues of the Official Gazette, all at the expense of the petitioner.
