custodia al que haya sido privado de su libertad, y sus actos constituyan hechos punibles, se dictará orden para dicho arresto, poniéndose al arrestado á disposición del juez ó tribunal correspondiente.

NEGATIVA DE UN JUEZ Á EXPEDIR EL MANDAMIENTO.

XXVIII. Cuando corresponda al juez de instrucción expedir el mandamiento de habeas corpus, si rehusare librarlo, podrá el solicitante acudir con su solicitud al presidente ó cualquier magistrado de la audiencia ó sala respectiva jurando haberse negado el juez á expedir el mandamiento.

PETICIÓN DE SEGUNDOS MANDAMIENTOS.

XXIX. No se podrá repetir la solicitud de mandamiento de habeas corpus por la misma prisión ó privación de libertad, á menos que nuevos hechos hayan desvirtuado los motivos que justificaron aquélla. Esos nuevos hechos deberán precisarse bajo juramento en la solicitud, para que sean apreciados antes de resolver sobre la expedición del

mandamiento.

La persona á quien se dirija un mandamiento de habeas corpus, deberá en su informe consignar si la prisión ó privación de libertad á que aquél se refiere ha sido ya objeto de otro mandamiento. En este caso, si en la solicitud del nuevo mandamiento no se llenan las exigencias del inciso anterior, se negará sin más trámites la libertad solicitada.

PENALIDAD CUANDO SE REHUSAN COPIAS.

XXX. Todo el que detenga á otro en virtud de cualquier autorización por escrito, estará obligado á entregar una copia de dicha autorización al detenido y otra á cualquiera que la solicite con el fin de obtener un mandamiento de habeas corpus á favor de la persona encarcelada ó que haya sido privada de su libertad. Si rehusare hacerlo así, indemnizara con cien pesos á la persona encarcelada ó que haya sido privada de su libertad, que serán reclamados por medio del ejercicio de una acción á nombre de ésta.

DEROGACIÓN.

XXXI. Todas las leyes, órdenes, decretos y demás disposiciones legales vigentes en la isla de Cuba, quedan derogados en la parte que se opongan á lo dispuesto en esta orden.

FECHA DESDE LA CUAL REGIRÁ ESTA ORDEN.

XXXII. Las disposiciones de esta orden surtirán sus efectos á partir del día primero de Diciembre de 1900.

PROCEEDING WHERE A WRIT IS REFUSED BY JUDGE OF INSTRUCCIÓN.

XXVIII. In cases where judges of instrucción have jurisdiction to grant writs of habeas corpus and refuse to do so, the petitioner may apply to the Chief Justice or any associate justice of the audiencia of the district, or in a proper case to the sala de lo criminal of the audiencia of Havana, setting forth on oath the fact of the refusal of the judge of instrucción.

WHEN SUBSEQUENT WRIT MAY ISSUE.

XXIX. But one petition for habeas corpus can be made for the same imprisonment or deprivation of liberty, unless new facts are alleged which destroy the reasons which justified the former decision, which new facts must be stated on oath in the petition, and their sufficiency will be judged by the judge or associate justice to whom it is issued. The person on whom a writ is served shall state in his return whether a previous writ has been issued for the same imprisonment or restraint, and if there has been a previous writ, the judge or tribunal shall summarily dismiss the application, except in the cases herein provided for.

PENALTY FOR REFUSING COPY OF PROCESS.

XXX. Any person who detains anyone by virtue of any written authority must deliver a copy thereof to the person arrested or restrained or to any person who applies therefor for the purpose of obtaining a writ of habeas corpus in behalf of the person imprisoned or restrained. If he refuses to do so, he forfeits one hundred dollars to the person imprisoned or restrained, to be recovered by an action in his name.

REPEALING PARAGRAPH.

XXXI. All laws, orders, decrees, or parts thereof, existing in the island of Cuba which conflict with the provisions of this order are hereby repealed.

WHEN THIS ORDER TAKES EFFECT.

XXXII. The provisions of this order shall go into effect December 1, 1900.

CUARTEL GENERAL DE LA DIVISIÓN DE CUBA,

Havana, 14 de Noviembre de 1900. El Gobernador General de Cuba, á propuesta del secretario de justicia, ha tenido á bien disponer la publicación de la siguiente orden:

Los incisos segundo y tercero del artículo 632 de la Ley de Enjuiciamiento Criminal, modificado por el párrafo VI de la orden del cuartel general de la División de Cuba, No. 181, serie de 1900, serán sustituidos por los incisos siguientes:

"Con tal objeto se entregarán los autos á cada defensor por dicho término de 5 días. Durante ellos estarán de manifiesto en la secretaría del tribunal la correspondencia, libros, papeles y demás documentos fehacientes no agregados á los autos.

"Si el procesado, ó persona civilmente responsable no tuviere constituido defensor en los autos, ni lo nombrase en el acto entregarle la copia á que se refiere el párrafo anterior de este mismo artículo, á pesar de ser requerido con tal objeto en ese acto, lo que se hará constar, el tribunal le nombrará defensor de oficio, con quien se entenderá dicho trámite.

"El término 5 días es improrrogable excepto si se alegare bajo juramento justa causa á juicio del tribunal, en cuyo caso podrá prorrogarse por otros cinco días á lo sumo. Si resultase no ser cierta la causa alegada, se aplicará la pena del perjurio. Si hubieren de formularse conclusiones por más de cinco procesados ó personas responsables civilmente, podrá reducirse el término prudencialmente por el tribunal para cada uno, ó bien señalarse un término común de 20 días, sin entrega de autos, teniéndose éstos de manifiesto en la secretaría para que en ella se instruyan los defensores.

"En el caso de entregarse los autos al defensor ó defensores, si no lo devolvieren con el trámite evacuado antes de comenzar la primera audiencia inmediata después de vencido el término, quedará de hecho incurso el moroso en una multa de cinco pesos en moneda de los Estados Unidos, por cada día de demora. El tribunal cuidará bajo su responsabilidad de que se hagan efectivas dichas multas."

HEADQUARTERS DIVISION OF CUBA,

Havana, November 14, 1900. The Military Governor of Cuba, upon the recommendation of the Secretary of Justice, directs the publication of the following order:

Paragraphs second and third of article 632 of the Law of Criminal Procedure, modified by Paragraph VI of Order No. 181, Headquarters Division of Cuba, series of 1900, are hereby amended to read as follows:

"With this purpose in view the records of the proceedings shall be delivered to each defending lawyer for the said period of five days. During the said period all correspondence, books and papers and other documents of proof not attached to the records shall be accessible at the clerk's office of the court.

"Should the prosecuted party or the persons civilly responsible not have a defending lawyer named in the records, nor should name one at the act of delivery of the copy to which the preceding paragraph of this article refers, notwithstanding being warned to do so at the said act, which fact shall be duly noted, the court shall appoint a defending lawyer in the case, in the exercise of its functions, in whom the charge of the case in its defense shall be vested.

"The period of five days shall not be extended except there be alleged under oath a just cause in the opinion of the court, in which case it may be extended at most for another five days. Should the alleged cause not be true the penalty for perjury shall be imposed. Should there have to be prepared a line of defense for more than five prosecuted parties or persons civilly responsible, the court may moderately reduce the period for each one, or it may specify a period of twenty days for the whole, without delivering the records of the proceedings, which must be accessible in the clerk's office to the defending lawyers in order that the latter may duly inform themselves thereof.

"In all cases where the records of proceedings are delivered to the defending lawyer or lawyers and the latter do not return them together with the line of defense adopted prior to the beginning of the first session of the court immediately following the termination of the period, the fact shall cause the party causing the delay to incur a fine of five dollars, United States currency, for each day's delay. The court on its own responsibility will cause the said fines to be collected."

CUARTEL GENERAL DE LA DIVISIÓN DE CUBA,

Habana, 15 de Noviembre de 1900.

El Gobernador General de Cuba, á propuesta del secretario de justicia, ha tenido á bien disponer la publicación de la siguiente orden:

I. Desde la publicación de la presente orden habrá en cada uno de los juzgados de primera instancia é instrucción de la isla de Cuba dos peritos calígrafos que tendrán por obligación auxiliar á los tribunales de justicia dentro del partido judicial en que residan en la práctica de cuantos actos ú operaciones puedan considerarse de su incumbencia.

II. Los peritos calígrafos á que se refiere el artículo anterior, podrán cobrar honorarios en los asuntos civiles á la parte interesada cuando no estuviere declarada insolvente, á razón de tres pesos moneda de los Estados Unidos por cada trabajo que realicen; y cuando éste consista en el examen y cotejo de escritos extensos, podrán cobrar además cincuenta centavos por cada hoja que hayan de examinar y cotejar, á excepción de la primera. Dichos peritos estarán obligados á prestar sus servicios en asuntos criminales sin retribución alguna; pero quedándoles reservada su acción para que puedan reclamar el importe de sus derechos en el caso de haber condena de costas á la persona que en ellas resulte condenada.

III. Las plazas de peritos calígrafos á que se refiere esta orden, serán cubiertas libremente por el secretario de justicia, en personas que tengan el título de maestro de primera enseñanza elemental ó de primera enseñanza superior, que no estén desempeñando ninguna plaza retribuida en el ramo de instrucción pública.

CUARTED GENERAL, DEPARTAMENTO DE CUBA,
Habana, 10 de Diciembre de 1900.

Para revelar de una carga innecesaria á los abogados de esta isla, el Gobernador General, á propuesta del secretario de justicia, ha dispuesto la publicación de la orden siguiente, que pone término á las relaciones oficiales entre el Gobierno y los distintos colegios de abogados de Cuba:

I. En lo sucesivo los jueces y tribunales no exigirán que se fijen en los poderes los sellos llamados de "Bastanteo" y "Aceptación."
