GUIDANCE LEVELS FOR

REPRESENTATIVE
RADIONUCLIDES IN FOODS FOLLOWING
ACCIDENTAL NUCLEAR CONTAMINATION

WHEREAS, the Philippine Nuclear Research Institute (PNRI) is authorized by Section 4 (a) of Republic Act (R.A.) No. 5207, as amended by Presidential Decree No. 1484, to issue orders with respect to atomic energy materials for the protection of the health and safety of the workers and of the general public;

WHEREAS, the Food and Agriculture Organization (FAO) of the United Nations and the World Health Organization (WHO) recognized the importance of developing international standards for the purposes of

protecting public health and minimizing disruption of international food trade;

WHEREAS, the Codex Alimentarius Commission (CAC), created jointly in 1963 by the WHO and the FAO, is a global agency that establishes international standards for substances potentially harmful to human health and the environment and provides a reliable standard-setting process to assist developing countries lacking the infrastructure to create domestic safeguards for food safety and health;

WHEREAS, the Codex Alimentarius Commission adopted CAC/GL 5-1989, "Guideline Levels for Radionuclides in Foods Following Accidental Nuclear Contamination for Use in International Trade”;

WHEREAS, the international trading of food that has been accidentally contaminated with radionuclides shall be subject to the recommendations of the Codex Alimentarius Commission.

WHEREAS, the PNRI adopts CAC/GL 51989 and establishes the following guidance levels for representative radionuclides in foods following accidental nuclear contamination as basis in ensuring that foods are safe for human consumption:

Before this court is a Verified Petition to

be Naturalized as a Filipino filed by the petitioner himself MOHAMMAD HASSAN HASSAN HAGHIGHI FARD also known as HASAN FARD

alleging among others: that he is of legal

age, married, an Iranian Citizen, and a resident of No. 100 Camia Road, Ayala Alabang, Muntinlupa City; that he was born on May 23, 1959; that he arrived in the Philippines sometime on October 31, 1980; that he is married to RUBY ANN V. FARD, a Filipina, on July 18, 1985, and has four (4) children with Ruby Ann, namely :1) Mehdi Hassan Haghighi Fard ii); Farah Christine Hassan Haghighi Fard iii); Farzaheh Hassan Haghighi Fard iv); Shahnaz Ann Hassan Haghighi Fard; and that in addition to his testimony, petitioner will present the following witnesses at the hearing of the

subject petition, namely: Mr. Rosauro L. Mangaser, residing at No. 19 Scarbourough St., Hillsbourough Subdivision, Alabang, Muntinlupa, Mr. Jose Daniel L. Balajadia, residing at 43 Stella Maris St., Brgy. Velonza, residing at 61B Datipnuna Ext. Kapitolyo, Pasig City, and Mr. Renato B. Loyola Grand Villas, Quezon City.

Finding the petition to be sufficient in form and substance, let this Petition be set for Initial hearing on February 10, 2010 at 1:30 o'clock in the afternoon at the Regional Trial Court Branch 203 Muntinlupa City at which date, time and place, interested persons may appear and show cause why the petition should not be granted.

The petitioner is directed to have this Order and the Petition and all its annexes be published once a week for three (3) consecutive weeks in a newspaper of general circulation in Muntinlupa City; and once a week for three (3) consecutive weeks in the Official Gazette; and be posted at Muntinlupa City, in the Barangay Hall where the conspicuous place in the City Hall of the petitioner resides; and in the Office of

the Local Civil Registrar of Muntinlupa City.

Likewise, let a copy of this Order and the Petition be furnished to the Office of the Solicitor General, the Office of Local Civil Registrar of Muntinlupa City and the Commissioner of the Bureau of Immigration and Deportation.

PETITION

Petitioner, by counsel, respectfully states:

1. Petitioner Mohammad Hassan Hassan Haghighi Fard a.k.a. Hasan Fard is of legal

age, married, Iranian Citizen, and a resident of No. 100 Camia Road, Ayala, Alabang, Muntinlupa. He was born in Tehran, Iran, on May 23, 1959. His father is Ahmad Hassan Haghighi Fard and his mother is Kobra Beigum Hosseini Hassan Haghighi Fard.

A copy of his translated Birth Certificate is attached as Annex "A" and two (2) copies of his latest photographs as Annexes "B" and "B-1".

2. Petitioner arrived in the Philippines sometime on October 31, 1980 on board the Thai International Airline plane and initially resided at 45 Maginoo St. V. Luna, Quezon City. Since then, he has continuously resided in the Philippines for a period of twenty eight (28) years before the filing of this Petition. He was issued his Alien Certificate of Registration (ACR) No. 321427 and Immigrant Certificate Residence (ICR) No. 222424, both on November 28, 1980.

Copies of the Certificate of Arrival issued by the BID, Alien Certificate of Registration (ACR) and the Immigration Certificate of Residence (ICR) are attached as Annexes "C", "D" and "E", respectively.

3. Petitioner studied in the Philippines at the University of Santo Tomas (UST) and finished the degree of Bachelor of Science in Electronics and Communication Engineering in 1985.

4. Petitioner is married to Ruby Ann V. Fard, a Filipina, on July 18, 1985 and they are happily married for the past twenty two (22) years. As a married couple, they initially stayed at No. 1 Arsenio Jizon, BF Homes, Parañaque City and transferred to their present abode at No. 100 Camia Road, Ayala, Alabang Muntinlupa.

Copy of the Marriage Certificate is hereto attached as Annex "F".

5. Petitioner has four (4) children with Ruby Ann, namely: i) Mehdi Hassan Haghighi Fard ii) Farah Christine Hassan Haghighi Fard ii) Farzaheh Hassan Haghighi Fard iv) Shahnaz Ann Hassan Haghighi Fard.

Copies of the Birth Certificates of petitioner's children are attached as Annexes "G", "H", "I" and “J”.

6. Petitioner's children are Filipinos, were all born in the Philippines and they were brought up embracing the culture, traditions and customs of a Filipino. His children had studied either at Ann Arbor Montessori, BF Homes Parañaque, International Christian Academy (ICA) (ICA) at Fourth Estate Subdivision, Parañaque, and at the British School Manila (BSM). All of these schools are duly recognized by the Department of Education, Culture and Sports. All of petitioner's children were taught Philippine history, government and civics as part of their school curriculum.

7. Petitioner has not been charged or accused, much less convicted, of any offense nor has he been involved in any felony. He has conducted himself in a proper and irreproachable manner during the entire period of his stay in the Philippines in relation with the duly constituted government as well as in the community in which he relates. He believes in the principles underlying the Philippine Constitution.

8. Petitioner is not suffering from any mental alienation or incurable disease. He has mingled socially with Filipinos and had learned to embrace the customs, traditions and ideals of the Filipinos.

9. He is gainfully employed and is presently holding the position of Assistant Vice President of Adcoms International and Chairman and Chief Executive Officer (CEO) of Trends and Technologies Inc.

10. Petitioner has been dutifully reporting his income and paying income taxes.

11. Petitioner posses all the qualifications for naturalization as a Filipino citizen as required under the law, and do not possess any of the grounds for disqualification.

Copies of the affidavits of Mr. Rosauro L. Mangaser and Mr. Jose Daniel L. Balajadia, both of Filipino Citizens and respected members of the community, attesting that Petitioner is a resident of the Philippines for the period required by law, that he is of good repute and has conducted himself in moral and irreproachable, and that the petitioner has, in their opinion, all the qualifications necessary to become a citizen of the Philippines and is not in any way disqualified to become a Filipino Citizen under the law, are attached as Annexes "K" and "L".

4. I have not commenced any other action or proceeding in any other court or tribunal involving the same issues raised in the Petition, and there is no other action or proceeding involving the same issues pending in any court or tribunal or agency of the government.

5. If I should learn hereafter that an action

involving the said issues has been filed or is pending before any court or tribunal, I undertake to notify this Honorable Court within five (5) days from such notice.
